Adam Lambert DENIES Battery Accusation

A Miami paparazzo has filed a battery complaint against Adam Lambert after the two were seen grappling with each other on the beach, TMZ reports.

According to the police report, the victim claims Adam grabbed his backpack "where the camera was placed" and "wrestled [the photog] to the ground forcefully." The photos of the scuffle, however, show the victim holding his camera in his hand.

"Eeew paparazzi killed my peaceful afternoon on the beach! #howisthisok?" Adam tweeted on Thursday. Then he wrote of his unusual outfit: "Hahha the photos are hilarious !! Lol please everyone forgive me for that hat. - I was attempting a disguise- clearly failed. Hahah"

On Friday Adam took to Twitter again to defend himself: "Battery? Nope. I attempted to grab a camera, no punches were thrown and no one was on the ground.... It was literally harmless. If embarrassment is a crime- thats all I'm guilty of."

He was staying at the Raleigh Hotel. The beach is public. If he stayed by the pool, which is private property, no one would have snapped him. Guess he still needs to learn how to navigate those annoying paps.

If I were on a jury I'd never convict someone for assaulting paparazzi. Unless they used lethal force, then I'd give them a reprimand.

Sorry, but if it was a public place, Adam has no right to try and stop someone from taking a picture of him, regardless of who it is. Once you are in public, you have no expectation of privacy.

It's all spelled out in the Fourth Amendment to the Constitution ... here are some details on how the Fourth Amendment will — or won't — protect you in public places:

"It may sound obvious, but you have little to no privacy when you are in public. When you are in a public place — whether walking down the sidewalk, shopping in a store, sitting in a restaurant or in the park — your actions, movements, and conversations are knowingly exposed to the public. That means the police can follow you around in public and observe your activities, see what you are carrying or to whom you are talking, sit next to you or behind you and listen to your conversations — all without a warrant. You cannot necessarily expect Fourth Amendment protection when you’re in a public place, even if you think you are alone. Fourth Amendment challenges have been unsuccessfully brought against police officers using monitoring beepers to track a suspect’s location in a public place, but it is unclear how those cases might apply to more pervasive remote monitoring, like using GPS or other cell phone location information to track a suspect’s physical location."

You may think it is BS but I believe in our Constitution and the rights it affords all U.S. citizens.
