Philippine Dad Convicted Of Rape Gets 14,400 Years

MANILA, Philippines — A Philippine court has sentenced a father to 14,400 years in prison after he was convicted of the near-daily rape of his teenage daughter over the course of a year.

A trial court originally condemned the man, a motorcycle taxi driver, to die in March 2006 after he was convicted of 360 counts of rape allegedly carried out during the year his wife worked in Hong Kong.

The Philippines repealed the death penalty in June 2006 and the Court of Appeals in Manila affirmed the conviction on Sept. 8 but lowered the sentence to 40 years' imprisonment – the maximum now allowed by law – for each count of rape, according to a copy of the decision obtained Friday.

The then-13-year-old victim, now 22, said her ordeal began in January 2001, when her mother left for work in Hong Kong as a domestic helper and left her three children with their father in Los Banos, a township just south of Manila.

She said he forced her to have intercourse with him almost every day, except when she had her period or on holidays, when he would make her perform oral sex.

The ordeal only ended after she and her siblings spent a vacation with their mother's relatives. Reluctant to return to her father at the end of the vacation, she broke down and told her family about the abuse. Her mother returned home from Hong Kong and helped her file the case.

The appeals court affirmed the lower court's dismissal of the defense's contention that the man's wife made up the allegations to get custody of the children and marry a foreigner.

Courts do not routinely announce their decision to reporters, and the little-known case escaped media attention until journalists checked the appellate court's recent decisions.

The defendant can still appeal to the Supreme Court. It was not clear if he would and calls to his lawyer's phone were unanswered.

Seems like a fair sentence to me 40 years for each count 14, 400 . Death penalty would not allow his conscience time to show him the damage he has done.

Having to die in prison is a better punishment for him than a death sentence. The guilt will be enough to kill him... that is if he feels any.

He raped his daughter almost 365 times, he had plenty of time to reflect on his actions and feel guilty about them but the fact that he did it on a daily basis shows he has no guilt. People who rape their kids do not feel guilt, you incorrectly assume that just because he's been put in prison he will be remorseful.

Screw guilt, the guy face a life of Hell and torture!

Besides, even if some people richly deserve to die, we set laws to fit society as a whole. Since some people will always be unjustly convicted in any country, life in prison as an alternative to DP is a way of protecting the INNOCENT.

The DP is simply a form of vengeance which puts anger over justice. It is mob rule in its worst form!

Adding a "Bubba" to his sentence would be a good start for this animal. They should hold a contest to gather suggestions for additional "creative" implements for his time of reflection. Notice I haven't mentioned anything of rehabilitation, rehabilitation is something possible for humans. I hope medical science will disect this animal's brain, infact don't they do a lot of brain surgeries while the patient is awake? Just a thought...

now, if capital punishment were applied, would people here protest it?
what if the method was beheading or stoning?

Why do people feel its OK for only some types of capital punishment?

Bread, water and a 3X 6X6 cell with no sunlight for the rest of its life is fine by me.

I'm not a major proponent of capital punishment, except for those that abuse children. Children don't have a choice in their abuse. They are not adults who can decide to leave an abusive relationship. And in this case, he raped her virtually every day for a year. How could anyone do that to their own child?

It is abominable to me wherever it occurs and who knows if the probability of it happening at home is lessened because lowlifes can find vulnerable children OS or if it feeds their selfish appetites all the more.

Maybe rather than incarcerating this deviate (where he'll conveniently for other molesters be yesterday's news) he could be taken around the world, city by city, making the 6 o'clock news each day; an anti-celebrity.

Then again the stress or shame I was hoping to put on those like him may just cause them to harm others even more.

It happens a whole lot in our country, but judges try to keep the "family" together. People do not believe children. Look what happened with Michael Jackson. The jury said afterward that they did not like the boy's mother. Not one word about the case being poor--just that the mother was arrogant. They also creamed her for having an earlier lawsuit. Apparently you can only get justice if you have lived a perfect life.

I don't take issue with what you say about past misdemeanors and justice but it may be rash to make generalisations this way.

In the case you mention, the jury got it exactly right but unfortunately your comment gives the impression to me you may think otherwise, even though you state that the case against him was poor.

It was the media that went with the more sensationalistic aspects of the case and that is maybe why we are left with the impressions you note. The whole thing was implausable and the mother's character no doubt reflected that to the jurors.
