Steven Hayes Convicted In Petit Home Invasion Murders

NEW HAVEN, Conn. — A paroled burglar was convicted Tuesday of murdering a woman and her two daughters in their suburban home during a night of terror that drew comparisons to "In Cold Blood" and bolstered efforts to retain the death penalty in Connecticut.

The mother was sexually assaulted and strangled. Her two girls died of smoke inhalation after the youngest was sexually assaulted, they were tied to their beds and doused in gasoline, and the house was set on fire.

Steven Hayes, 47, could be sentenced to death. His attorneys have admitted his involvement and will argue for a life sentence.

Prosecutors said Hayes and another ex-con broke into the family's house in Cheshire in 2007, beat the girls' father with a baseball bat and forced their mother, Jennifer Hawke-Petit, to withdraw money from a bank before she was sexually assaulted and killed. Eleven-year-old Michaela and 17-year-old Hayley were tied to their beds, with pillowcases over their heads, before they were killed by the gas-fueled fire, authorities said.

The crime drew comparisons to "In Cold Blood," Truman Capote's chilling book about the 1959 murders of a Kansas family, and prompted more Cheshire residents to get guns. It also led to tougher laws for repeat offenders and home invasions, and Connecticut Gov. M. Jodi Rell cited the case when she vetoed a bill that would have abolished the death penalty.

The girls' father and the lone survivor, Dr. William Petit, appeared to stifle tears as the verdict was read. His head down, he sucked in his bottom lip.

"There is some relief but my family is still gone," Petit said afterward, his father and other relatives clutching him. "It doesn't bring them back. It doesn't bring back the house that we had."

Hayes showed no emotion as he stood for the verdict, which triggers the trial's second phase, beginning Oct. 18, in which the same jurors will decide if Hayes should be executed.

Petit said he hoped the jurors would use "the same diligence and clarity of thought" as they consider the sentence.

Hayes' defense conceded most of the evidence on the trial's first day, but his attorneys blamed his co-defendant, Joshua Komisarjevsky, for escalating the violence at every critical point, starting with William Petit's beating. Prosecutors rejected that argument, saying the two men were equally responsible for the crime.

Komisarjevsky faces trial next year and also could be sentenced to death.

Hayes' jury heard eight days of gruesome testimony and deliberated for five hours over two days.

He was convicted of 16 counts, including six capital felony charges, three murder counts and two charges of sexually assaulting Hawke-Petit. The capital offenses were for killing two or more people, the killing of a person under 16, murder in the course of a sexual assault and three counts of intentionally causing a death during a kidnapping.

During the penalty phase, which is expected to last up to a month, Hayes' attorneys will try to persuade the jurors to spare him the death penalty. They argued during the trial that prosecutors failed to prove Hayes intended to kill the girls.

Attorneys not involved in the case said Hayes' lawyers will have difficulty showing mitigating factors that would favor prison over execution.

"If there was ever to be a hue and cry for the application of the death penalty, this case is it," said defense attorney Bruce Koffsky.

Another defense lawyer, Hugh Keefe, said: "I've never seen a case where the evidence is so egregious. Not even his mother loved him."

Prosecutors have said the crime was especially cruel and depraved.

Komisarjevsky spotted the mother and her two daughters at a supermarket, followed them to their home, then returned later with Hayes, authorities say.

During the trial, authorities showed text messages between the men hours before the crime in which Hayes told Komisarjevsky that he was "chomping at the bit to get started."

Authorities say the men were caught fleeing the scene.

Hayes, still reeking of gasoline, gave an emotionless confession to police in which he said he was financially desperate when the men hatched a plan to break into a house, tie up the family, rob them and flee. But Hayes said "things got out of control," a detective testified.

Hayes told authorities he sexually assaulted Hawke-Petit after Komisarjevsky, 30, told him he had to – to "square things up" – because Komisarjevsky had sexually assaulted Michaela, a detective testified.

A prison officer, Jeremiah Krob, said he overheard Hayes tell another inmate that he killed Hawke-Petit after Komisarjevsky told him he had to do it.

Hayes said Komisarjevsky sexually assaulted Michaela, took cell phone pictures of her that he tried to e-mail to friends and doused her in gasoline, Krob testified. Krob said Hayes admitted pouring gas on the stairs but told the other inmate he didn't believe he could be charged with arson because he didn't light it.

Jurors apparently agreed: They acquitted Hayes of an arson count.

William Petit told the jury he woke up on his couch the morning of July 23, 2007, in pain and feeling the sensation that blood was running down his face. He saw two people standing nearby.

"If he moves, put two bullets in him," Petit recalled one of the assailants telling the other.

Petit said the men took him to his basement and tied him to a post.

Jurors saw photos of the victims, charred beds, rope, ripped clothing and ransacked rooms. A medical examiner described the painful and panic-stricken smoke inhalation death likely suffered by Michaela. Hayley's injuries suggested she managed to free herself and was burned as she tried to flee. She also died of smoke inhalation.

When asked Tuesday how he would find the strength to attend the penalty phase and then another trial filled with the same horrifying testimony, Petit said: "If your family was destroyed by evil, I think you would all try to do the same thing and be there for your family."

Attorney Ullman takes people for fools. If life behind bars REALLY was a worse fate than death--that would mean this lawyer is trying to get his client the worst outcome possible. He's ASKING for it! Wouldn't that be unethical--a wrong thing for a lawyer to do? Does Ullman expect us to believe that his murderer client is so magnanimous that he WANTS the worst possible fate for himself? No, here in the real world, we all know that death (which this monster deserves) is worse than three hot meals a day, medical care and chatting with other lifers on the unit all day. Ullman should do time for asking us to believe that Hayes is so repentant that he WANTS to have the harshest sentence. Sure he does.

One of the things that test a person's maturity and civility is how they react when faced with a story like this.

Giving in to one's barbaric side and suborning cruelty, torture, and commission of crimes in retaliation for other crimes is not what a civilized person should do.

An eye for an eye makes the whole world blind.

We, the good people of the world, established justice because we are better than the bad people of the world. Not because we are meaner than the bad people.

Just because someone has a heartbeat, that doesn't automatically mean their life is 'precious'. It is the decisions you make and the actions you take that make a life worthwhile. These two criminals have clearly demonstrated that their life is only preserved through putting others in peril. By their actions, they have forfeited the right to live in our society. I see no reason to house, clothe and feed them and allow their toxicity to be shared with other inmates who may not be as vile as they are as of yet.

Execute them. Do so in a manner consistent with the deaths of their victims. If no one else is willing, I volunteer to light and toss the match.

A lynch mob is a group of people, acting under their own will, who set out to impose a sentence of death upon someone. They are not sanctioned by duly constituted government and their actions are viewed as murder, which is the taking of a human life outside of the power, consent, and approval of the government.

This guy was tried and convicted in open court. I suggested the state follow through with execution in a manner consistent with the horror he visited upon his victims. In no way did I suggest a 'lynch mob' or any such thing. I simply volunteered my services if no one else was willing to do the job.

Of course, you know all of this. You just don't like my view, have nothing worthwhile to write to oppose it, and demonstrate your lack of thought in your snarky one line post. It would be funny if it wasn't just so sad.

Step One, put a plastic bag over their heads. Step Two, break their shins with a sledgehammer, with the plastic bag over their heads they will not be able the scream, it amplifies the pain, keep the bag on for 30 seconds. Step Three, release bag for 60 seconds. Step Four, Repeat step one, two and three, using their arms this time. This protocol should be carried out every 8-12 weeks depending on the healing time, for this rehabilitation program to work for certain.

If anyone needed to be backed up against a wall to post for rifle fire, this sadistic waste of protoplasm is the one. Next Tuesday at noon sounds good. I would not even be too hard on someone deciding that the belly button made a fine target. Then squad can then take their time, clear and clean their weapons, then reload in plenty of time for his partner next year.

Horrible story, but at least he will have some closure.

What is so strange to me, is that I saw this on the news recently, with photos of the mother at the bank, and I had the impression it had just happened.

I'm surprised to hear that it happened in 2007.

I don't think closure is even remotely possible in this case. I read the article and I'll tell you it even brings tears to my eyes. Can't imagine what the father has and is going through. How can monsters like these even exist in this day and age? I don't know if it's society, genes or what but I wish we could find a cure or some way of preventing this kind of stuff from happening though I doubt we ever will.

If we keep executing these rodents, we will never learn what makes them tick, and possibly, how to keep your kid or your neighbor's kid from falling into the same psychotic red-zone. We should poke and prod them like an alien abduction, doing brain scans and every experiment known to man. There is a wealth of information in a malfunctioning brain. Fry them, and though we may feel better, we learn nothing.

What really upsets me about this horrible crime is that the police sat outside the house while the criminals were murdering these kids. You can't count on the police to save you in these instances. They stick with the script when the criminals aren't following one. The mother tried to get help and didn't receive it.

If you do a little more research yourself you will notice that it took 30 minutes from the moment the police were notified of the invasion/hostage situation to have a single squad car show up on the scene. Disgusting!

I am 100% fine with death penalty for these two sub-humans, but I must admit a part of me feels as though capital punishment is too good for them. There's not enough suffering first. Could we send them to Gitmo, waterboard them a few times a day until the execution? Hang them upside-down in a dungeon somewhere? Lethal injection seems like we're letting them off too easy for what they did.

What I can't figure out is the acquittal on the arson charge.

First of all, everything that happens in the commission of a felony is the fault of everybody there.

Secondly, unless that state has weird laws, when you pour gasoline you aren't exonerated from arson charges just because you didn't strike the match.

Very weird verdict.

I would ask the AG and State legislature to expedite any so-called "automatic appeals" process when the death penalty is handed down.

Then I would hang them publicly.
