Federal Judge Rejects Jan Brewer's Challenge To Arizona Immigration Lawsuit

Arizona Immigration Lawsuit Challenge

A federal judge has dismissed challenges to a civil rights lawsuit against Arizona's controversial immigration law, allowing the action against the recently enacted law to proceed.

U.S. District Judge Susan Bolton ruled Friday that motions filed by Arizona Gov. Jan Brewer, Maricopa County Sheriff Joe Arpaio and Pinal County Sheriff Paul Babeu that were designed to force the dismissal of lawsuits against the enacted immigration enforcement measure were not sufficient.

"While Governor Brewer correctly points out that, for the most part, the organizational plaintiffs' allegations involve threats of future harm, the threat of future harm is sufficiently imminent," Bolton ruled, according to Courthouse News Service.

In her decision, Bolton also found that "race, alienage, or national origin discrimination was a motivating factor in the enactment of S.B. 1070," and maintained that the lawsuit was appropriate due to the "alleged harm to the organizational plaintiffs will occur if S.B. 1070 goes into effect, regardless of how it is enforced or applied."

Bolton found merit in the plaintiffs' arguments for potential Fourth Amendment and 14th Amendment violations because the immigration law "contains no meaningful procedural safeguards against erroneous deprivations of liberty, and immigration status is not something that is easily ascertainable. A person who is lawfully present in the U.S. may look and act the same way as a person who does not have permission to be in the country, and plaintiffs' allegations of 'subjective and arbitrary' detention decisions by law enforcement agents are plausible."

Calls by the plaintiffs, which include groups such as the ACLU, Friendly House and labor unions, for a full injunction of S.B. 1070 were rejected however, because Bolton had already placed a stay on what she believed to be the most controversial aspects of the legislation.

The Arizona Republic reports that "there will be a hearing regarding that stay in San Francisco on Nov. 1 before the U.S. Court of Appeals for the Ninth Circuit."

Bolton also found merit in Brewer's challenge of a First Amendment complaint in the lawsuit, ruling that S.B. 1070 "does not purport to limit the rights of individuals to speak." The plaintiffs had argued that the law would cause people to be scared to speak a non-English language or with a foreign accent.

A total of seven lawsuits have been filed against Arizona's new immigration law, Judge Bolton has already dismissed two and is still scheduled to hear the final two.

Before Jan's debate travesty, she held a 20 point lead over challenger State Atty General Terry Goddard. After the debate she said she wouldn't debate him again unless the poll numbers tightened up. Since immigrants routinely vote democrat, again, in an effort to scare Whites into blindly voting republican (and unknowingly supporting the real republican platform: tax cuts for the top 2% and abolishing Medicare and Social Security), tea klansmen have concocted outrageous lies that marauding Mexicans are beheading Americans on the Arizona border. In fact, since 2006, border-towns in Arizona have reported a significant decline in illegal immigrant related property and violent crime, and in just 19 months, the Obama Justice Department has apprehended and deported more illegal aliens than the Bush Justice Department accomplished in 8 years. Plain and simple: Brewer pushed SB 1070 to reward her single largest campaign contributor—Corrections Corporation of America (CCA), which, with the new law, will reap huge profits from operating jails that house illegal immigrants. In Arizona, and thanks to Brewer, CCA rakes in $132 million annually, and with the new anti-immigrant law, watchdog groups are projecting a 22% increase in immigrant detainees, which, in turn, will increase CCA profits by a whopping 37%. Due to SB 1070 and ongoing republican inspired scare tactics, tourism related revenue is down 29%, yet Brewer continues to perpetuate the “southern strategy” by making baseless claims that illegal immigrants account for all drugs brought across the border, a statement soundly refuted as patently false by the U.S. Border Patrol.

I wish that was true, but Arizona legislature has been dominated by the republicans since 1966. She is in hiding and says debating is too hard.

The last thing the Governor needs is for the courts to find 1070 constitutional! Yes Arizona, this was never about doing something about illegal immigration, it was about dividing the poorest white voters from their natural allies the growing Hispanic and minority voters of Arizona. And it has been hugely successful in doing this! The last years have shown a changing demographic in Arizona, and these changes did not favor the fortunes of the GOP! Add to that the growing poverty of lower middle class whites and we could have seen a new Democratic coalition in Arizona. Enter 1070, and the flames have been fanned, GOP wins in Arizona in 2010. Of course the future will be very different and the GOP will pay dearly for the success of today. Hispanics, even young Cuban Americans, are sickened by the spectacle that the Governor has produced in her desperate attempt to roll back the coming tide. Division and hate have a short shelf life in Arizona!

The feds need to arrest this woman for treason and sedition. Once the SCOTUS rules that the whole state of Arizona is out of step with the nation, they need to remove her from office. Poetic justice would be it if came at the hands of the immigrants she profiled.
