WASHINGTON — The Defense Department said Tuesday that it is accepting openly gay recruits, but is warning applicants they might not be allowed to stick around for long.

Following last week's court ruling that struck down a 1993 law banning gays from serving openly, the military has suspended enforcement of the rule known as "don't ask, don't tell." The Justice Department is appealing the decision and has asked the courts for a temporary stay on the ruling.

The Defense Department said it would comply with the law and had frozen any discharge cases. But at least one case was reported of a man being turned away from an Army recruiting office in Austin, Texas.

Pentagon spokeswoman Cynthia Smith on Tuesday confirmed that recruiters had been given top-level guidance to accept applicants who say they are gay.

Recruiters also have been told to inform potential recruits that the moratorium on enforcement of "don't ask, don't tell" could be reversed at any point, if the ruling is appealed or the court grants a stay, she said.

The uncertain status of the law has caused much confusion within an institution that has historically discriminated against gays. Before the 1993 law, the Defense Department banned gays entirely and declared them incompatible with military service.

Douglas Smith, spokesman for U.S. Army Recruiting Command based at Fort Knox, Ky., said even before the ruling recruiters did not ask applicants about their sexual orientation. The difference now is that recruiters will process those who say they are gay.

"If they were to self admit that they are gay and want to enlist, we will process them for enlistment, but will tell them that the legal situation could change," Smith said.

He said the enlistment process takes time and recruiters have been told to inform those who are openly gay that they could be declared ineligible if the law is upheld on appeal.

"U.S. Army Recruiting Command is going to follow the law, whatever the law is at the time," he said.

U.S. District Judge Virginia Phillips, who had ordered the military to stop enforcing "don't ask, don't tell," was expected to deny the administration's request to delay her order. That would send the case to the 9th Circuit Court of Appeals.

After Phillips' ruling last week, Omar Lopez – discharged from the Navy in 2006 after admitting his gay status to his military doctor – walked into an Army recruiting office in Austin and asked if he could re-enlist. He said he was up front, even showing the recruiters his Navy discharge papers.

"They just said, `I can't let you re-enlist because we haven't got anything down from the chain of command,'" Lopez, 29, told the AP in a telephone interview. "They were courteous and apologetic, but they couldn't help me."

Smith was unable to confirm the account. She said guidance on gay applicants had been issued to recruiting commands on Oct. 15.

Lifting the disrimminatory DADT rule will not result in any kind of chaos. The military will not tolerate inappropriate behavior, including illegal liasons, str8 or gay. It seems to me, homophobes are worried about LGBT troops turning the barracks and showers into some kind of gay 0rgy. That will NOT happen. Miliary members are very well trained as to the guidelines and rules they must follow.

If they choose not to, they do so at their own peril; they can get a dishonorable discharge, if their violation is serious enough.

so gay military personal will do what they've always done. Follow the rules, be the best they can be, and serve their country. They are not out to molest or 'convert' str8 soldiers. (Or eachother, for that matter!)

The statistic I always seem to find (probably from the right) is that 6% - 10% of the population are part of the LGBT community (or should be.) That's not very many! So why all the panic??

I am ALL FOR following the U.S. Constitution, and therefore banning ALL TYPES of laws that amount to discrimmination.

I am not for promoting inappropriate behavior in the military, and I;m also not afraid that repealing DADT will result in that.

The right-wing usually peg the LGBT population at around 2-3%. This bolsters their argument that it's too small a number to treat equally. LGBT groups place it closer to 10%

Having lived in military barracks long before DADT, I can tell you gays can and do ignore those rules. There is nothing more disgusting than being awakened to squeaking bed springs in the middle of the night and finding your cube mate in a compromising gay fling.

It is my understanding that such behavior is illegal, and those involved should be warned by thier cube mates who've witnnessed it (it you;re a nice guy) or reported, if your strictly "by the book".

It is also my understanding that anyone, STR8, or LGBT, would be offended by that kind of behavior in the bunks. What anyone does in private, in their own time, is their business. Being in the barracks, or 'cube', is NOT in private, and NOT in their own time.

Any sexual conduct while on duty, or at work (unless you're a who're) is unacceptable, and in the military, is also illegal. You don't have to put up with that; nobody does.

And please don't try to insinuate that this is normal or common for gay servicepersons; the vast majority have more integrity, and sense, than to be sexually active in their bunks.

What has always bugged me about this issue is that the argument against allowing openly gay soldiers was that they would affect "cohesion" (which is code for saying, "We wanna let bigots be bigots"). Now think about that for a moment. The implication is that those in command can't do anything about the attitudes of those in their charge. The US military has made a practice for decades if not centuries of molding young minds into fighting machines. They use techniques that basically reprogram the way recruits think. And we're supposed to believe that they couldn't train recruits to accept the mere presence of homosexuals (no one is suggesting that it be okay for gays to proposition their fellow soldiers.)?

It's all about how the top brass wanna handle it; if they wanted gays in the military, there would be gays in the military. My dad was a 20-year Navy man who was, shall we say, not the most open-minded person, but it was clear to me from all the stories I heard over the years that all he cared about with respect to soldiers was wether they did what a soldier was supposed to do to ensure success. He had some racist views, but those became irrelevant when he and his men had to get a job done. This anti-gay lunacy has to end.

I think it has to do with the blessing of God and they way you live to get them. Liberty and freedom were obtained by Christian beliefs. The gay lifestyle is total slavery and bondage from what we as Americans have fought for. God insists you choose your path cause he places you at a crossroad of life or death. You will choose one or the other. Family is a church/God creation and not a state one. War is uncivilized in a progressive society. America is in chaos and completely uncivilized at the moment. I voted for Obama once and I will vote for him again. I don't like tea unless it is green.

"Openly gay" is made to seem bad. Does anyone refer to the heterosexual community as "openly straight"? It's simply gay people living life normally, and for that we are punished.

Hooray!!! Hooray!!! Open and Honest!!! How can men and women serve "HONORABLY" when they are standing on a lie...this took too long to do. Having said that, I will pray that those who are gay are protected they way they should be. Remember, the country was ready for a Black President, until they actually got one. There are still going to be those in the military that do not want to share a barrack with a person who "openly" admits to being gay...it's one thing to think that someone next to you is gay...but another to know. I think that is the only reason why the Administration wants to delay this action...to make sure everything is in place for the safety of these brave men and women. Nevertheless --- CONGRATS!!!

I wonder if some of this fear of gays has to do with people not knowing anyone who is openly gay. I work with openly gay people and...they're people. Normal, everyday people. This is why I do not understand homophobia. It has no basis in reality.

In the Vietnam draft, we tried to appear aroused while standing in line with our post-pubescent mostly hairless, mostly black friends, neighbors, and less than outstanding college dropouts, knowing that any showing of a possible flair toward men would be the first ticket to get out of line. The penntagon is ready to accept all comers, and if not enough apply, the next thing will likely be a full blown draft, hopefully with a national lottery, with no 4-F's. Are you feeling lucky conservatives?

Kudos to Dan Choi, & other outstanding Gay & Lesbian armed service members for weathering the inevitable storm. They took the only Ethical path. The question begs: Why will our President not do likewise ? To speak w/a forked tongue suggests strongly that either he is being manipulated, or unable to stick to a principled course of action. Neither trait is characteristic of a Leader, but the ones indelibly left by his actions on Afghanistan, DADT, & now P19.
Perhaps more ludicrous, is the pentagon ordering recruiters to tell incoming service people that they may be living on borrowed time, if El Supremo sides w/Barama. Just the fetid fact this is being done, speaks volumes as to how corrupt the entire shithouse has become. Maybe one day, America will catch up with Europe, & dispense with racial & sexual prejudice in the armed services.

typical of this government and military policies..they are once again lowering the bar on "honorable service" let them take all the gang members..people with criminal records...america's finest..gay people dont bother with them...find some other way to go to college or get retirement benefits...its obvious they dont want you.....let the straight ones come home in the boxes or minus their limbs...colleges dont discriminate on that stuff.
