Gross Racial Disparities In California Pot Arrests

SAN FRANCISCO -- Attorney General Eric Holder ruffled some feathers with his recent promise to "vigorously enforce" marijuana prohibition in California even if the state ballot initiative seeking to legalize marijuana passes on November 2.

He might have some trouble with fair implementation: Studies show minorities are much more likely to be arrested for pot possession in California than whites, even though minorities are less likely to smoke pot.

A recent report by the Drug Policy Alliance found that from 2006 to 2008 "police in 25 of California's major cities arrested blacks at four, five, six, seven, and even 12 times the rate of whites." The City of Los Angeles, for instance, "arrested blacks for marijuana possession at seven times the rate of whites," even though young white people consistently report higher marijuana use than blacks or Hispanics, according to the National Survey on Drug Use and Health.

In the last 20 years, California authorities made 850,000 arrests for possession of small amounts of marijuana. There's no reason to believe the disparity in arrests is confined to the state.

Indeed in New York City, under the leadership of Mayor Michael R. Bloomberg, pot arrests have skyrocketed -- and roughly nine out of ten people charged with violating the law are black or Latino.

On Wednesday the DPA released a second report highlighting the disparities between white and Latino arrests in the Golden state. Findings showed that from 2006 to 2008 "major cities in California arrested and prosecuted Latinos for marijuana possession at double to nearly triple the rate of whites." In San Jose, the third largest city in the state, police arrested Latinos at more than twice the rate of whites. Glendale, California -- where Latinos make up only 17 percent of the population of almost 200,000, but 30 percent of those arrested for marijuana possession -- had the highest Latino arrest rate of the 33 cities surveyed.

The report's authors cautioned that the findings should not be attributed to racist cops.

"The disparities documented in the report are the result of routine police practices, not the result of racists cops here and there," Stephen Gutwillig, state director of the Drug Policy Alliance, told reporters on a conference call Wednesday. "This is a system-wide issue."

The report's authors, led by Queens College sociologist Harry Levine, have noted that marijuana possession arrests can have serious consequences, creating permanent "drug arrest" records that can be easily found on the Internet by employers, landlords, schools, credit agencies, licensing boards and banks.

Several weeks ago, California Gov. Arnold Schwarzenegger signed a law, effective in January, which downgrades possession of an ounce or less of marijuana from a misdemeanor to an infraction. But Gutwillig said the new legislation will not eliminate the problem.

"The recent downgrading by the governor which lowers the penalty from a misdemeanor to an infraction is absolutely a step in the right direction," he said. "But targeting of Latinos will continue."

Every minority leader should be vocally supporting Prop 19. It's the social justice issue of our times.

BTW, it's not just the minorities that get hit hard by the cops for pot possession. Poor white folks also have it pretty rough too.

This video attests to that. Check out the cops busting down the dude's door. They're pretty good using that riot gear to show a toy-sized dog what's up.

It is no coincidence that prohibition appeared at about the same time that we started to consider the rights of African Americans and other ethnic minorities in the US. And the funny thing is, that happened because of the prohibition of alcohol. The speak easy's employed the black jazz and blues players of the day to entertain their customers, and they began to mix with whites and became stars challenging accepted notions of the day. Then prohibition ended and along came the next prohibition. But this time only ethnic minorities had any real experience with the substance being banned so the persecution and prejudice went unnoticed by the majority of the white community.
At one time it was possible to discriminate against a person on the basis of colour but once that was challenged a new method of discrimination had to be found and drug prohibition was perfect. It created a new subculture that could be persecuted and blamed for all our problems with impunity and no one would be any the wiser, except one day they would be. You can't fool all of the people all of the time.
Please vote to end this discriminatory and dangerous law that has divided friends, families and nations. End the war on peace.

Its not just in California, it's everywhere. It happened in Houston yesterday. These 2 guys were campaigning making frequent stops, cops followed them its on abc13.com. It was not fair how they were treated. Cops decided to take things in their own hands and search the car even tho they found nothing. 2 guys. 1 black and 1 white.

The reason for this disparity is a lot simpler and less sinister than what most people think. Many minorities live in high crime areas and there are more police working in high crime areas. Because of the higher number of police officers per capita in those areas, there will obviously be higher arrest rates. If someone bothered to do a study of pot arrests by zip code I'm sure there will be a direct correlation.

Frequently the law is used as a club to beat groups or individuals. When Nancy Reagan began her famed "Just say no" campaign our cowardly politicians followed right along and past many draconian drug laws, they did a great job packing the prisons but nothing else changed. We get to live with "the Drug War" to this day, we get to pay for it, we get to see people caught up in it. Legalize it and be done.

Sad to say, but this is absolutely true.

The only motivation for criminalization in the first place was to prevent miscegenation. How could you support this law and not be racist?

Why does California continue to be so racist? And people talk about the South being racist. I've been to the South and it's not that racist!

My white friend who lives in California, is always asked by his Hispanic friends if he would go places at night in the car with them so they wouldn't be pulled over for being Hispanic. This is ridiculous!

One of his Hispanic friends was pulled over and charged for having a baseball bat in his car as a "weapon". This charge was later thrown out because he talked to the DA.

Can you imagine any white person ever being in trouble for having a baseball bat in the back seat of their car?

lots of white cops in cali are racist, however there are more minorities on the police force in cali then any other state.

The author of the article had the audacity to quote the director of the Drug Policy Alliance "The disparities documented in the report are the result of routine police practices, not the result of racists cops here and there." Please!!! It has everything to do with racist cops that are located state-wide!!

This all about connecting the dots. The criminal justice system in toto is an absolute joke. Lady justice certainly isn't blind, nor is she fair and balanced. If you're a pretty wealthy blond e.g. Paris Hilton you don't even get charged with cocaine possession. If you're Lindsay Lohan you get released from jail after a day when the sentence was much longer. This is outrageous but yet, people forget about this and next time a cop issue arises and you bring up the race issue people bristle at the notion.

Bottlom line: If you're white or wealthy you get all the privileges of our system "due process" etc. If you're latino or a black man you get the throw 'em jail and throw away the key treatment w/out any sense of irony.

This is why minorities NEED to VOTE! Complaining at home about inequality will not change things where they count. VOTE Nov. 2nds If it rains, if it's cold, if you have to walk..just do it!
