The new technologies are making enforcement of copyright difficult and arbitrary because so much of the abuse goes on beyond the reach of local law enforcement. For example, I'm a photographer. If someone abuses my copyright for an image (or TONS of images), I can go to an US court to enforce copyright here. I mght be able to enforce an enfringement in England, France, or Spain. But what are my chances of getting damages or preventing further abuse of someone in Russia or, worse, Estonia?

In the future, if an artist wants to profit from his works, he may have to produce one-offs for particular clients in much the same way that a painter does a portrait on commission.

Photography and music for the masses? We may just have to throw in the towel on reproduction and find a different way to earn money. For musicians, they can concentrate on making money on live performances, using their recordings as merely a form of promotion. Photographers? I think we may be screwed, unless we can make money running workshops and so forth for people whose only hope of income is to operate workshops of their own. A rather small audience.
