White House, Pelosi Signal Support For Standalone DADT Repeal Bill

Just hours after the Senate failed to pass a defense authorization bill that included the repeal of the gay military ban known as "Don't Ask, Don't Tell," House Speaker Nancy Pelosi (D-Calif.) and the White House suggested there were other ways to get it through Congress.

Pointing to a standalone bill to repeal the ban, championed in the Senate by Joseph Lieberman (I-Conn.) and Susan Collins (R-Maine), Pelosi's Twitter account issued the following statement: "If new Lieberman & Collins #DADT bill passes Senate, an army of allies stands ready to pass standalone repeal in House."

White House spokesman Reid Cherlin, meanwhile, said in a statement, "The President is committed to working with Congress to achieve a repeal of 'Don't Ask, Don't Tell' this year. The White House is willing to explore all legislative options to reach this goal during the lame duck session."

Of course, President Barack Obama could simply issue an executive order rolling back the ban on openly gay servicemembers, but the White House has chosen to press its luck with what administration officials argue is a more permanent solution.

The numbers for repealing DADT are much more favorable in the House than the Senate, so it stands to reason that a standalone bill which could pass through the upper chamber would face few obstacles in the lower chamber, which has already passed a repeal this session.

Earlier Thursday afternoon, a Senate leadership aide confirmed Lieberman's proclamation that Senate Majority Leader Harry Reid (D-Nev.) would not only cosponsor a standalone repeal bill, he would get it floor time during the lame-duck session.

It remains to be seen if the 11th-hour gambit will work. But it certainly raises the question: Why didn't Democrats consider DADT repeal outside of the defense authorization to begin with?

The answer is a bit complex, but also illustrates just how far the DADT debate actually has moved in the past year. Back in January, Senate Armed Services Chairman Carl Levin (D-Mich.) was convinced that the defense authorization bill would be the lone vehicle for getting DADT repealed. It had been, after all, 48 years since Congress failed to pass an authorization.

House Democrats felt the same way. But while they dutifully passed their own version of repeal later in the spring, they were left waiting for the upper chamber to act. The Senate did not.

Support for repeal then became conditioned on the results of a Pentagon study as well as the procedural underpinnings of the defense authorization bill. The study, in the end, was favorable for repeal proponents. But the procedural process of the defense authorization remained a loophole for Republicans to kill the legislation.

Had DADT been considered alone, one Senate aide suggested, it might have had a better shot of passage on Thursday night. Republicans, of course, would still have argued that tax cuts and budget issues should be considered first. But their votes against repeal, as it stood alone, would have carried far more moral weight than their arguments against the process for considering defense authorization.

In the end, Senate Democrats may not have misplayed the hand they were dealt -- they just wound up playing a different game.

here's a FACT... all Obama needs to do is order his Attorney General to attack DADT in the courts. Let's face it, DADT is anti-american, not constitutional and is being struck down in the courts on those grounds. But Obama is a GOP collaborator folks... something some of us suspected he would be for quite a long time.

It is MUCH better to try the congress first. Laws that are put in place in Congress are better then those who go through all the court navigations. But, I am glad you remember that card. No one has to fight against the "constitutional" issue, only on other points - and that can be done.

All the flack Pelosi gets, she gets because she gets things done.

While Republicans are fine paying their Congressmen $200k+ a year to do nothing and put nothing new on the table, look at what Pelosi and House Democrats have achieved. This treaty, healthcare reform, DREAM Act, Wall Steet reform, repeal DADT...

You are correct, but I need to add to your comment. In the house, filibuster can't be used. And the Dems control the house until 2011. So, there is no problem with that. She and Reid have been talking about what to do. Reid was right not to allow the debate on the defense part to continue. We don't need those days on debate taking away from lame duck when you know it isn't going to happen.

A real President, who is for the people would not let GOP thugs hold hostage good legislation helpful to many people. However, Obama has shown he is with McConnell and the traitors and against the American people. So, I am not surprised he fails to deal with DADT in a conflicting way and just continues to have McConnell and the GOP goon squad lead the fight against the American people.

Actually what he did was pretty good if he felt the Dems were not going to get their tax cut package through as it was. Sorry, but unless they have a good plan - it won't on it's own. Obama can take the heat, and the Dems can complain about it for all of us to see, but in the real world - we either face a stand off and get nothing through and everyone's taxes will go up, with no unemployment extension and other tax incentives, or you play the game. This is reality. Not happy either!!! But, unless they pull something out of their hats? President Obama will take the heat, no matter how much outrage there is - because someone had to push here. Not sure what else you would have him do. Go into congress and bitch at everyone? LOL Come on. 2011 is just around the corner. You know who will control the house then? GOP. For the next two years you will not see any help from that part of Congress - which is where all costs/tax/financial bills need to come through either in the beginning or when changes are made that has to be approved through the house first. Reconcilitation is another issue. You can only use that once a year, and if it affects more then one area financially - it has to go through committees as well. Now, as the President, what would you do?

show some cojones by using the powers that the American people and the Constitution have given him to lead our military and uphold the laws of this country

if our rethugblican hijacked congress decides to against the law of the land and the constitution the president needs to act:

order immediately the military to stop any gay related discharges

and immediately cease from interfering with the work of the federal courts

Any rich pro democracy democrat donor should start cutting funding to every democrat politician in the country, at the federal and local level, until they put pressure on President Obama to do his job.

POTUS has the powers as commander in chief to issue a stop-loss order halting any unconstitutional gay military discharges and unconstitutional removal of any gay troops.

POTUS should also immediately order the Justice Department to stop appealing federal court cases challengin­­g our justice system from doing its job against DADT

President Obama you should forget wasting your time with the Republican­s and you should order the Justice Department to stop appealing federal court cases challengin­g the constituti­onality of the law or use your powers as commander in chief to issue a stop-loss order halting military discharges and the removal of any gay troops.

The United States Congress and the White House are breaking the law by going against the US Constitution and against the will of the courts on DADT; so no more time to wait.

And no stupid irresponsible compromises either.

The problem with doing that is its not permanent and can be overturned- Congress needs to repeal this- No one wants to take a chance of the Conservatives in the Supreme Court- They are not breaking the law- The Congress can do what they are doing- We have been calling voters in the districts of the holdouts to get this done. Whats amazing is that the Repubs for the first time in 48 yrs would block the defense bill- no one say that coming- The Dems have not done that- These Repubs are so transparent- Where is the Log Cabin group and other conservative DADT activists- they should be protesting outside the offices of Republicans who said they supported a repeal, including Scott Brown (R-Mass.) and Lisa Murkowski (R-Alaska),who voted to filibuster the measure- The Log Cabin and others on talk shows said they had Republican votes- I heard them say up to ten- where are the votes they said they had. They were given 10 amendments to this bill- and 2 days of debate when this bill int he past has passed in one day- Holding this hostage for tax cuts when they are unrelated is a crime and where is the outrage - the protests the name calling of the Republicans-

I am surprised at all the comments on here backing to separate the bill from DADT and you guys are wrong. You are being duped from the right. They will then pass the defense bill to fund the military and they will no, will not pass DADT. They will not and have not allowed Obama any accomplishment. Not going to happen.

Unfortunately, Senator Munchkin from WV, after having aides clamor around and claim his vote not to end cloture was a "stunt" came forward later last evening to say he would not support any vote on repealing DADT "this year."

In other words, with a stand-alone vote looming, he decided his gig was up. Now he's elected to hide his cowardice behind the backs of gay and lesbian soldiers serving in the wars he claims to be the real reason he won't support repeal "at this time."

Oh, and he poked his middle finger Obama figuratively as well, for good measure.

Reid dropped the ball if he had waited a week this would have gotten thru the Senate. The votes are there. He backtracked, after the fact, and attempted to cover himself by saying that Snow was the only Republican he could communicate with. Apparently he didn't communicate w her very well as she said she was perplexed.

The problem w the stand alone vote is that time may run out. The House will flip and the Senate won;t see a bill in the 112th Congress.

Reid is a terrible Majority Leader.

He is trying to backload, after a disastrous election.

He is being disingenuous when he said that "hours were spent on the DADT bill." That may be so, but it does not matter if he held the vote too early.

A good Parliamentarian, which Reid is not, would have managed to hold off and get the repeal through.

He was not even out-manuevered!
He shot himself in the foot.

Snow, Collin and perhaps Lugar would have voted for DADT if Reid had agreed to let the DADT repeal take place after the Tax bill cmpromise. There were 4 Dems who voted against repeal and he should have had the acumen all the Dems in line b4 putting it to the vote.

For all of her flaws Pelosi at least can count b4 allowing a vote on the floor.
