Apple was accused of of letting applications on the iPhone and iPad transmit personal information to advertisers without consent, in two separate lawsuits.

The first suit was filed by Jonathan Lalo on December 23 in federal court in San Jose, California. He is seeking class-action, or group status for his complaint. The lawsuit claims that the transmission of personal information is a violation of federal computer fraud and privacy laws.

iPhones and iPads are equipped with Unique Device Identifiers (UDID), 40-digit-long strings of letters and numbers which distinguish one device from another, and cannot be blocked or removed by users. The suit claims that these UDIDs are used to let advertisers track what apps users download, how long the programs are used, and how often.

Bloomberg reports the suit also claims that "some apps are also selling additional information to ad networks, including users' location, age, gender, income, ethnicity, sexual orientation and political views."

Lalo names applications like Pandora, Paper Toss, the Weather Channel and Dictionary.com, as defendants alongside Apple.

A separate class action suit accusing Apple of the same privacy violation, also centered around the UDID, was filed on the same day by Dustin Freeman, and three others. The suit called Apple's actions an "intrusive tracking scheme," and pointed out that Apple regularly rejects 20 percent of apps who try to enter their store. The complaint classifies Apple's failure to keep these apps from the store, and their failure to realize that these apps were breaching user's privacy, as "aiding and abetting" the guilty apps.

These lawsuits come soon after a Wall Street Journal report on concerns over app privacy.

That article, like the lawsuits, characterizes UDIDs as the major source for privacy concerns. The UDID was the most widely shared detail among the apps they tested, leading one expert to call it a "supercookie."

In October, Apple released a series of review guidelines for their app store which included the following: "Apps cannot transmit data about a user without obtaining the user's prior permission and providing the user with access to information about how and where the data will be used."

If UDID data sharing is happening, it would seem to violate this principle. But Apple isn't the only company that should be worried.

"We are also looking at Google's Android platform and a lawsuit against them has not been ruled out," one of Freeman's lawyers told Reuters.

Smartphone users seem to be upset about the tracking of their personal data, but maybe we should be thinking of the poor people who have to process and analyze all this data. It can't be fun for them to see everything people are doing. Talk about gross! http://bit.ly/fh3uWm

Good for them. Privacy is dead, and nothing can or ever will bring it back, but at least it is good to know that some plan to go down fighting.

I don't use apple product. I don't like their obtrusiveness. I.E. My son gets an IPOD, installs software on my PC and with great regularity and apple update will come up right in the middle of online gaming, minimize my game to ask if I would like yet ANOTHER update. Why daily updates Apple, can't you get your stuff together? Oh and usually my avatar is quite dead by the time I get back tho the screnn I WANT. However the interesting point of thies piece is the supercookie. I marvle at the possiblities. What would your personal supercookie consist of? Gotta have choclolate chips and perhaps nuts....mmmmmm supercookie.

I don't think there's any information on my iPad that would give away my income, ethnicity, sexual orientation or political views, let alone any apps that I would stupidly input that information. If I feel an app is asking what I believe to be an inappropriate amount of personal information, I delete it. I don't throw all my personal information out into the wind, then sue years down the line when I regret it. It's not Apple's fault you didn't use common sense when you had the chance.

Agreed- everyone seems to want the convenience but not pay the price. Don't post naked pics on your facebook account and then wonder why your job interview that went so well never ended in an offer. With that said though- my understanding is that they can trace things like your web browsing and deduce the other stuff- i.e. if you come to HP regularly, the might assume (with a few more pieces of info) that you are a liberal...you would not have to offer up that info to the app.

Sure, but web browsing can be tracked from any computer or smart phone. If someone is that paranoid, maybe they shouldn't download apps from GayBlackLiberalThirtysomethingMillionaireMen.com. It's a little opportunist that they go after Apple for something that has been going on since the beginning of the internet.

Sad thing is, most of the folks involved in the lawsuit probably share the same information on their Facebook account and don't think twice about it. People have too much unrealistic expectation that data they're transmitting onto internet connected socially geared devices is secure. Additionally, the UDID is just like the VIN number on your car...there's nothing "personally indentifiable" about the UDID itself unless you work at the cell phone company and have access to the account records anyway.

There is a big difference between Apple distributing the UDID information and the info that hackers are able to obtain using viruses or spyware. Plus it is a fairly simple process to keep your computer clear of tracking software, the core of this suit is that Apple has made it impossible to turn of UDID tracking.

I've never received a penny from tons of action lawsuits notices I've received regarding devices and services. The say, you don't have to do anything unless you don't wish to be part of the action lawsuit, but that's the last thing you hear from those layers. I wonder where the money goes?

I filled out a form regarding a class action against the music industry for price fixing once years ago. About a year and a half later I got a check in the mail for just over $11. I had long since forgotten about it. I never even cashed the check.

People who complain about class action lawsuits don't understand class action lawsuits. They are a very powerful way to punish businesses that perpetuate small injuries to large numbers of plaintiffs. It isn't about you. You could have opted out of the class action and sued individually. You chose not to. Stop whining about something you know so little about.
