Rubashkin Appeals Conviction And Sentence On Kosher Case

(RNS) Convicted businessman Sholom Rubashkin, former executive of the now-defunct Agriprocessors kosher meat plant, has filed an appeal in hopes of a new trial, or at least a reduced sentence.

Rubashkin, 51, was found guilty in November 2009 on 86 counts of fraud related to his management of Agriprocessors, once the nation's largest producer of kosher meat, in Postville, Iowa.

He has been ordered to pay more than $26 million in restitution and has begun serving his 27-year sentence at a federal prison in Otisville, N.Y., where attorneys say the ultra-Orthodox Jewish businessman has access to kosher food, prayer books and ritual items, but lacks the
necessary minyan -- a quorum of 10 Jewish men -- for certain prayers.

In a brief filed Monday with the U.S. Court of Appeals in St. Louis, Mo., Rubashkin's attorneys argued that their client was treated far more harshly than other white-collar criminals, and that presiding Judge Linda Reade should have recused herself due to her involvement in the
planning of the May 2008 immigration raid of the Postville plant.

Rubashkin's supporters also point out he is a first-time offender with 10 children, including an autistic teenager, and deeply committed to his religious community.

"When viewed in the context of other federal sentences imposed on defendants who have committed similar offenses, it is clear that there is an enormous disparity between the sentence imposed on Sholom Rubashkin and sentences of other nonviolent white-collar offenders who did much greater harm to the public," the brief states, calling the 27-year sentence "procedurally flawed and substantively unreasonable."

The 2008 raid, the largest immigration enforcement action in U.S. history, revealed nearly 400 undocumented workers, including minors, working at the plant. But federal prosecutors opted not to pursue the labor charges after the decisive fraud conviction, citing the time and expense of conducting another trial and detaining the workers as potential witnesses.

The government's response to the appeal is due Jan. 25.

ACLU Slams Rubashkin Case

Washington Legal Foundation (WLF), American Civil Liberties Union (ACLU) and the National Association of Criminal Defense Lawyers (NACDL) reinforced the appeal by Sholom Rubashkin's appellate team.

I say just go with what the Bible says a proper punishment should be for an offense like this...I assume stoning. God wills it!

He was a person in a position of trust, that along with the standard white collar crimes, fraud deceit, etc, is why he is getting this sentence and deservedly so. Now if could only get something more on the former Cardinal Joseph Ratzinger we could then move on to Benny Hinn and the rest of those TV scam artists. But this is a good start.

Tom DeLay gets 3 years for corrupting the US legislature, whereas this guy gets 27 years as a result of employing illegal immigrants whose discovery led to the closure of the factory, and the claimed loss of $27m of creditors money?

The $27m seems to be based on the value of a loan obtained due to false accounting. But the factory wasn't burned down in the immigration raid, and any old kosher butcher could
take over the factory as a going concern. It seems the penalty is a bit stiff, although with three-strikes life imprisonment flying around for `grand theft pizza', it's not disproportionate.

He was convicted and sentenced for repeatedly defrauding banks out of millions of dollars. He wasn't prosecuted for the children and illegals he had working in his slaughterhouse or the animal cruelty that happened there. This is a poorly written article with a dearth of facts.

there was a month long state trial for these allegations, and guess what? is was found.... innocent.

Of course, the illegal immigrants in his employ probably had kids back in Mexico that they were sending checks to. I guess it's only important for religious dudes with long beards to be with their kids? This is a failure of our secular government to ensure the rights of workers. We need a living wage law and to cut these loopholes that allow rabbis and other crooks in the agribusiness industry to exploit the labor of other human beings.

Seems to me that Mr. Rubashkin's sentence is too harsh, there are far more violent criminals who get lighter sentences.
