Halle Berry In Custody Battle With Gabriel Aubry For Daughter Nahla, Quits 'New Year's Eve' Film

LOS ANGELES — Halle Berry has pulled out of a film job to prepare for a custody fight over her young daughter. A spokeswoman for the Oscar-winning actress says Berry backed out of a role in "New Year's Eve" that was scheduled to shoot in New York this week "due to pending custody litigation involving her daughter."

Publicist Meredith O'Sullivan did not say where or when the custody case would be heard.

Berry and her ex-boyfriend, Gabriel Aubry, have a daughter, Nahla, who will turn 3 in March.

Attempts to reach Aubry on Monday were unsuccessful.

I don't know the details, however, their should be joint custody. Halle shouldn't think that she is the only parent. That child should have equal time with dad. He's a good guy who want's to be a good father.

Not sure what level of a fight she is anticipating to pull out of a film. Considering, and I'm sure, she has an assist with their daughter on a day to day basis, no differently than when she has made films in the past. However, she will have to show proof that he is an unfit father. May be much harder to do.

Halle needs to grow up. This man is the father and he has rights and is entitled to see his child. Establishing paternaty is an important legal step and one she should welcome. Too bad counts have to settle such things. The child suffers.

Gabriel has totally indulged her previous demands and has been a gentleman throughout. He's French Canadian. The great majority of us- and Gabriel is from a good background (he's from Rosemere)- and men as much as women are excellent parents. Children in Qc are cherished and levelled with as intelligent beings. Halle doesn't come from as cushy a background nor has her emotional evolution through abusive relationships made her a superior parent to Gabriel. She should have stayed with him, for the stability he provided. Failing that, she shouldn't act like a control freak towards the one pillar of positive enforcement in her life. It's her loss if she does.

Apparently, she had issues with how much she made and how much he did, which was not negligeable. After being long dominated by men, she got a taste for domination now and she equates kindness with weakness.

I think there is something wrong with her. All that beauty hides a very insecure and dramatic woman. I dont get these celebrities at all. Its like they try on purpose to mentally scar their children by all this fighting and drama. Cant they just get along for the sake of their kids? They are already growing up in the spotlight, why make their lives even more strange and hard? Look at Ryan and Reece, Demi and Bruce...all have moved on, stayed civil and the kids seem normal.

This is a sad conclusion that I've come up with watching these celebs go through this childish mess which is really about spite and money.

Note to all actors/actresses: If you want kids but not the hassle of dealing with the dad/mother, use a donor bank or a surrogate. Then when the kid gets here, it is yours. You don't have to deal with this stuff.

Why can't people take a lesson from Bruce Willis and Demi Moore and just focus on the children's emotional well being and figure out how to get along.

It really shouldn't be that difficult. You were once in love, you created a beautiful child. Part in peace and co-parent in harmony.

Actually, they have shared custody up to this point. Now, the dad has filed for full custody and Halle is fighting back. Both kept their custody disputes out of the press until recently, and now they each accuse the other of neglecting the child and putting the child in danger because of the neglect when the other parent has physical custody.
This is something that will have to go to court and be proven with actual evidence, not rumors and accusations on the internet.

No actually, he hasn't filed for full custody, he filed for paternity petition which affords him recognition as Nahla's father. I could certainly understand if he wanted the courts to enforce his custodial rights. Just last year Halle wanted to take Nahla to a 3 month shoot to South Africa, meaning he would not have been able to see his daughter regularly during this period. He just wants to be able to prevent her from, for example, skipping off to France to live with Olivier.
