Halle Berry Taking Nahla To New York; Aubry Drops Suit, Pursuing Paternity Action

UPDATE II: TMZ reports that Halle Berry was given permission by an LA judge to take Nahla to New York to film "New Years Eve," a project she initially dropped out of after the custody fight began. Gabriel Aubry indeed has dropped his custody suit, but will continue to pursue joint custody by filing a paternity action.

PREVIOUSLY:
The nasty custody battle between Halle Berry and Gabriel Aubry may have finally come to an end.

RadarOnline.com reports that Aubry has dropped his suit for custody and spousal support from ex-girlfriend Berry. He sued in December for partial custody of their daughter, Nahla, and since, a war of words between the two has turned uglier and uglier.

Berry dropped out of filming the movie "New Year's Eve" at the end of January, and soon accusations that Aubry sent abusive text messages and that Nahla was "terrified" of him were floated from her camp.

Then, rumors of an Aubry freakout when Nahla was referred to as racially black brought the feud into new, even nastier territory. Berry addressed the issue when she said that, citing slavery rules, Nahla, who is biracial, is in fact black.

Radar says that a source told them that, "Gabriel and Halle have spoken to each other and have committed to try and make things work, without the courts - Gabe's decision to drop his case is his way of showing Halle he's prepared to take a leap of faith and trust her once again."

Earlier in the day, TMZ reported that Berry was in a Los Angeles court with her lawyer, though why she was there was unclear.

Halle Berry, Lenny Kravits, Lisa Bonet, Obama, and many more are biracial yet considered by the country as black. Like it or not that is the way it is. As for the custody issue, why should she have to refuse work in order to keep her child. He shouold stop seeking "spousal support" since they were never married. Halle, girl, never "sleep down". LOL What is with people using their children as a paycheck.

California's laws make breaking up very difficult... However, if Halle Berry is the baby's custodial parent, why won't she sue him for child support.., He would have to get a job and do what parents do ... work and take care of their children.

I agree. For some reason she thought the grass was greener and this bum turns out to be her worse nightmare. For an able bodied man to go after a womans money is gutter low. She slept too far down the food chain. He's a looker, but everything that glimmers isn't always gold.

Unfortunately for their daughter, these two made bad choices in choosing her parents. Neither are on the same page. Having said that, I am surprised at the venom directed at Halle Berry and the judgement directed at Aubrey. None of us know what kind of parent either one might be. We seem to be willing to accept the worst or what we imagine to be the worst. The reporting is spotty: did he or did he not ask for child support. I have not seen the document nor has any of his defenders provided a link. Does he have independent income? No proof of that either.

Nonetheless, he is her father and she deserves to have him in her life.

As a mother, I would want my daughter with me and whether I have a nanny available or not is my business. The days when women were told that they had to be home with their children 24/7 or they were bad mothers are over. As for the child staying with him, it seems that her offer, if this is true, to pay for him to be in New York with the child so that the child could be with both parents was a reasonable compromise. Yet, she is being charged with being a control freak. Why should he have to go: because it is not about him, it is about their daughter.

so when my hubby made much more money he paid for everything...even during the time we were dating, he basically supported me,..
what money i did make, i could do whatever i want with it.
most women seem to expect this when the man is making much more money and no prob with that...
so Halle who is worth 50 mil i hear...Although Gabrial was working, obviously Halle making much more was paying...what was so wrong about that? obviously, halle thinks money more important than their love...it is idiotic to believe it is ok for a man to support a woman but not the other way around...
so pathetic!

first off Halle is not married to him and I doubt very seriously if she thinks money is most important she bank rolled a resturant for him, she bought him cars, and paid the bills, maybe Halle got tired of that, maybe she wanted a man in the end who wanted more out off life then posing in front of the camera, people change and grow, maybe Aubry just wasn't cutting it for her anymore , but from everything I've heard she's been nothing but generous!

You are so very right on all of your facts.What he has done now is re filed for paternity which will not be open to the public unlike the custody petition case, and he hoped it will lead to a ruling on visitation and support. So see he still after the same thing, but doing it away from the public. Plus this has more to do with Halle money and nothing to do about his daughter. If you think about it he could have had his name on her birth certificate when she was born as the father. Why now that she is going to be three in a few weeks? Because she was footing all of the bills etc., this is only one of the reasons they break up. And after she started dating Olivier she cut off his funds that he was getting to used of. Yes he is a model but we didn’t know able him until Halle. Model only makes money when they are working, and right now he isn’t.

Citing slavery rules? Really? This woman has gone absolutely wacky; the only way this makes sense is if Gabrielle owns slaves - but being less than 150 years old and Canadian (French-Canadian to boot) makes this seem rather unlikely. What's next? Is she going to start quoting the court decisions from the Jim Crow era on adoption that said that a family should not be allowed to adopt a child of different race?

Granted, having a freakout when your biracial daughter is referred to as black is equally as offensive. I think child services need to be called.

It's a ridiculous mentally. Nahla is biracial. Why is it so ridiculous that a white man wants his biracial daughter not be labelled as black. She is as much black as she is white. Well in fact she's even more white than she is black.

If Halle wanted to have a black child, she should have had children with a black man. It's not like over the years she hasn't had the opportunity.

Unless these are direct quotes from Halle Berry, you are getting all excited over media spin. I find it interesting that folks here are getting all in an uproar when the issue of race isn't working out so well for him. The truth is, every person of color and African descent and ancestors were brought from Africa as slave are, in fact, mixed as you folks call it and Halle is right about the ancient law of determining racial identification in this country. You all are also ignoring the fact that his suit was equally about money.
