Labor Fighting Quiet Anti-Unionization Measure In Congress While Eyes Remain On Wisconsin

WASHINGTON -- While labor activists continue to stage a high-stakes campaign against the budget bill from Wisconsin Gov. Scott Walker (R) that would strip collective bargaining rights from that state's public employees, union backers are feverishly working to derail what they describe as an equally troubling federal proposal with a clear route to passage.

In recent days, union officials have ramped up lobbying efforts to block or remove language in the Federal Aviation Administration reauthorization bill that would make it drastically harder for rail or aviation workers to unionize.

Sponsored by House Transportation Chairman John Mica (R-Fla.) -- a major recipient of campaign contributions from the airline industry, totaling more than $620,000 in his career -- the controversial provision states if an eligible voter fails to vote for union representation, he or she will be tallied as an active vote against representation.

Such a policy, which puts an extra burden on union organizers to round up all voters, rather than a simple majority, existed up until last July, when the federal National Mediation Board, which adjudicates labor-management disputes, ruled that absent votes ought not be counted against unionization. Labor officials hailed that decision as one of their signature victories last year, and the proposal to strip it away has sparked an equally emotional reaction.

"This was the one advancement that you had seen in organizing rights and here they have launched an all-out effort in the House to go after unions again," said Shane Larson, the legislative director for the Communications Workers of America. "Currently, this is the biggest issue federally right now in terms of organizing rights. There is nothing else that is on the table."

Critics of expanded union rights appreciate the decision's significance, too. The NMB's July ruling was quickly followed by attempts to undo it, including a Congressional Review Act proposed by Sen. Johnny Isakson (R-Ga.) that would have called for a formal evaluation of the decision.

Isakson's review effort fell short, but Mica's provision, introduced through normal legislative order, seems much harder to disrupt.

The provision was passed by voice vote during markup at the House Transportation Committee on Feb. 16. Rep. Jerry Costello (D-Ill.) offered an amendment shortly thereafter to strip it from the final language, later telling The Huffington Post that he saw it as a clear effort "on the part of Republican leadership in the House to bust unions," but his amendment fell one vote shy of passage. The Transportation portion of the FAA reauthorization bill, with Mica's language included, ultimately passed out of committee, 34 to 25.

Two additional House committees -- Science and Ways and Means -- have input in the final legislative language, but according to House officials, neither has jurisdictional authority to revise Mica's provision.

"Once this comes to the floor," said one of those officials, "it will pass."

With that in mind, union operatives have turned their sights to the Senate, where a different version of the FAA reauthorization bill passed in mid-February. Sens. Jay Rockeller (D-W.V.) and Tom Harkin (D-Iowa) are being petitioned especially heavily to strip Mica's provision when the two congressional chambers meet to merge their respective bills.

An aide to Rockefeller, who chairs the Senate Committee on Commerce, Science and Transportation, said he supports the new NMB rule, and that position "has not and will not change." Harkin, who chairs the Appropriations Subcommittee on Labor, Health and Human Services, told labor leaders to "rest assured" that he would "vigorously oppose any effort to include these dangerous provisions in the FAA Reauthorization Act conference report."

Costello, the Illinois congressman, predicted that the measure would not pass the Senate. "And if it does," he added, "I would doubt the White House would sign the bill with the provision in it. I think it's a showstopper."

Such public resolve, however, is somewhat at odds with blunt political calculations. While Harkin and others may be insisting that Mica's provision be exorcised from the bill, in private, aides question whether the appetite is there to hold the line.

"Now that it is in the bill and it is going to conference, the dynamics have changed," acknowledged one top Democratic Senate aide. "Senator Harkin would of course vehemently say it shouldn't be in there. But the question is, will people vote down the entire bill over it?"

While last year's rule change was a cherished breakthrough for the labor community, the practical impact has not been as widely felt as anticipated, Democratic aides noted. One aide opposed to Mica's provision said unions have actually had a lower success rate since the NMB's ruling, winning only nine of 17 elections. "The new rule, in and of itself, will not cause an avalanche of unionism," the aide added, in an effort to downplay conservative critiques.

The numbers can cut both ways. When pressed about Democratic criticism of the congressman's provision, Mica spokesman Justin Harclerode said that reverting back to the old ways wouldn't be all that drastic. "The aviation industry was already heavily unionized before the rule change," he said.

Yet it's hard not to see the broader symbolism in this under-the-radar legislative fight. Republicans are fully invested in rolling back both the incremental gains and the longstanding rights that unions enjoy. And while the primary theater has recently been at the state level, labor officials and allied lawmakers are bracing themselves for similar high-stakes showdowns in Washington.

"I expect this is only the beginning," Harkin said. "I think we'll see a lot of amendments this year -- probably on every bill we consider -- that will chip away at the basic rights and protections that help middle class working families get by. Like Governor Walker, advocates will describe these amendments as budget savers or pro-growth, but make no mistake, those are not their real goals. The real goal is to weaken the voice of American workers, and continue to push the same, trickle-down economic theory that has led us to unprecedented levels of inequality and instability."

Unions Cause Unemployment. It's time for them to go. Unions prevent employers paying Asian level wages. They insist on safe workplaces. They demand that employers pay overtime, provide benefits and grant time off. None of these things can be tolerated by the modern American corporation. As long as unions continue to prevent full ownership, and all the rights and privileges it implies, of employees by their employers, the employers will not return to the U.S., and they will continue to leave. A business owner owns the business, and by extension, the employee. They should have the right to treat an employee in the same way a farmer treats his mule. Unions interfere with that, so they must be eliminated. No one would tolerate the right of mules to collectively bargain. Besides "collective" sounds too much like a communist concept, so it cannot be good. A poster here pointed out that Adolf himself was in favor of unions. That alone proves unions (and puppies) are bad, bad, bad!!!

Pay attention to what's happening now and make sure it is not forgotten in 2012! Progressives must never sit out an election again. No matter how disappointing and depressing it might be, it is important to vote, even if the only motivation is to keep out the lesser of two evils, especially when the "lesser of two evils" is TRULY evil!

AMERICANS seem to have forgotten how unions have improved the working conditions, wages and benefits for all of us. Weekends, vacations, minimum wage, worker safety, health benefits, pensions, all are because of the negotiating power of unions. Too many believe the the propaganda of the gop, tea-baggers and corporate America that unions are responsible for the economic decline of America, but you only need to look across our southern border, to Mexico, to see what our working conditions and pay and lives would be like if it weren't for unions in this country. Most of the gop and the tea-baggers wouldn't mind turning America into a Third World country for the benefit of their corporate masters. This proposed law brings us just a step closer to meeting that goal.

Yeah, but all those things are now written into law or have become customary, so unions are no longer needed. The business community couldn't possibly change their policies to eliminate benefits, weekends or vacations. They would never try to influence politicians to repeal laws that require workplace safety or minimum wages. They have our best interests at heart and would never do such a thing. Besides, unions make it hard for corporations to give out properly sized bonuses and pay packages to their management. Good, desperate, docile labor is easy to find. Good management requires 7 figure compensation. Unions cause unemployment and spoil workers, giving them the idea that they deserve leisure and to be "middle class". People in the U.S. even think their kids are too good for manual labor and deserve education. This just breeds an entitlement mentality and the next thing you know, they expect to live in your neighborhood.

Would you prefer 30-40% unemployment or a 12K median wage? That's 48K for a family of 4 and plenty to live on. Corporations provide that choice. If we in the U.S. demand a return of the anachronistic "middle class", where a one earner family was the norm, as existed between 1940-1980, then businesses can simply relocate to Asia, where people are grateful for a chance to work and aren't so spoiled.

Besides, are there no poorhouses? Are there no orphanages?

Hypocrisy, contradictions in budget cuts
Republican talk of "shared sacrifice" to solve economic concerns at the state and federal levels is a myth. The Texas and U.S. House budget cuts are directed at the poor.

Reasoning is simple, the poor don't vote and corporations who fund Republican candidates, want tax cuts.

Secondly, Republican Tea Partiers put personal and religious ideology ahead of what's best for all Americans.

Contradictorily, Republicans voted the richest 2 percent more tax dollars and want to cut tax dollars paid middle class families in government.

Thirdly, the reality behind Republican "union busting" in Wisconsin is not the State budget. Public employees have agreed to cuts in health and pension benefits Gov. Walker (R) wanted to balance the budget.

Hypocritically, Speaker Boehner (R) Ohio, pushed cuts to food supplements for poor children and pregnant women

This hypocrisy permeates Texas Republicans planning devastating cuts to children's education and medical care for seniors and the disabled while keeping his "enterprise" and movie production funds. (Fact: 70 percent of Medicaid funds are spent on seniors/nursing homes and the disabled. 100,000 school employees estimated for firing.)

Cutting funding, raising class size and eliminating Community Colleges while claiming our schools are failing, is contradictory and hypocritical.

Hopefully the middle class will discover working families can't live on ideology and will oust those who legislate against them, the 98 percent who are having a hard time.

so this was the Republican mandate..destroy the unions and the party that opposes them. Gaining total control fo the country for their corporate buddies while the the 90% of this country that is not part of the wealthy flounders with cuts to any outlet that would better their lives? Education, health care, regulations that would protect them from credit care rape....and tha sad thing is, the idiots in the middle calss would vote for them again and AGAIN FOR THEIR GUNS AND FOR THEIR WHITENESS. What do these corporations care? It's all about money, power and the freedom to do whatever they want to us and our environment. All they need is a base of operations and a labor pool. They don't need us for either of those. Write a letter to your local, State and Federal authorities demanding campaign finance reform, an end to Citizens United and an end to corporate tax loop-holes, off-shoring subsidies and destructive environmental practices. If enough of us demand it we can make a difference! Toe the line and bring back sanity and justice to the United States of America! Demand an end to our war-mongering empire and dependence on oil! Demand we take the global lead in new, cleaner technologies that build up the US manufacturing base one again! Demand worker's rights! Defend women's, LGBLT, Constitutional and Minority rights! Step up for the middle class! Defend education! Defend Social Security! Make the rich and corporations pay just a bit more (5% would probably do it) and quit making the rest of us bear the burden! Demand universal health care so small businesses don't have to get suffocated under health insurance costs. There's a reason why Michigan vehicle manufacturing went across the lake to Ontario, Canada. Health care costs are NOT an issue for businesses OR people in Canada. Or a ton of other countries! There are MANY successful international models to investigate. We've stopped innovating, thinking, caring and leading!

ff. Sweden, Germany and Holland all manage to compete globally and take care of all their citizens. Automation and tech make it possible. Now what we need to to take our Republic back from the multinational corporations. Stop voting for these conservatives, these Reagan Democrats and start voting for the liberals and true progressives: Kucinich, Dean, Grayson and most of the Progressive Caucus. Rank and file conservatives you need to wake up and realize your "conservative" leaders are not Ik conservatives, but Tory conservatives.

Sure, but we have the "American Dream" and they don't.
Sure, they have a higher standard of living, better physical and mental health. Yeah, they have fewer societal ills, violence, crime and homelessness.
O.K., they have better educations, income and retirement security.
But, our taxes are lower.
An average Joe here has a 100X better chance of becoming another Bill Gates or Warren Buffet or that Facebook zillionaire than he would in any of those Socialistic countries.
Don't destroy the American dream just so the average Joe Lunchbucket can live and work and retire in dignity and security. It takes away his incentive to become the next David Koch.
It's like that Congresswoman said, "hunger is a great motivator". Just think what would result if we had a couple hundred millions of hungry, motivated workers.

Wisconsin is offering big incentives for businesses to move there. "Wisconsin is open for business" is the cry. When relocating, one of the biggest questions is always the quality of the schools. When tea baggers act on fox talking points, the first people they hurt are those all around them. By the way, as a union member, I assure you that many union people are Republicans. The storm is coming.
