South Dakota Governor Likely To Sign Strict Abortion Bill

PIERRE, S.D. -- South Dakota's governor said Thursday that he'll likely sign off on new abortion guidelines that would be some of the strictest in the country, requiring women to wait 72 hours before they could go through with the procedure and to submit to counseling about why they shouldn't.

Gov. Dennis Daugaard, a Republican who opposes abortion rights, said he hasn't made a final decision on the legislation, but that he's "inclined to sign it at this stage."

About half the states, including South Dakota, make women wait 24 hours before going through with an abortion. But the 72-hour wait would be the longest in the nation, according to the Guttmacher Institute, a research group that supports abortion rights.

Under the new guidelines, a woman would have to undergo counseling at one of several state-approved "pregnancy help centers," all of which seek to persuade women not to have abortions. No other state has such a requirement, according to the American Civil Liberties Union of South Dakota. And only a doctor who has met personally with a woman and determined she's seeking an abortion voluntarily could schedule the procedures.

Daugaard said he believes women should receive more time and counseling before having an abortion.

"I think these decisions are certainly very important decisions. A decision of this significance warrants that," the governor said.

Opponents of the bill contend it is overly intrusive and would place an undue burden on abortion seekers, violating their rights by interfering with their access to medical care. The new guidelines would almost surely be challenged in court.

The state's Legislative Research Council has estimated it would cost $1.75 million to $4 million to defend the bill.

Asked about the potential cost of a lawsuit, Daugaard said Thursday that he considered any spending on a lawsuit to be a "one-time expense," rather than ongoing expenses that he's sought to cut. Daugaard has proposed a 10 percent cut to most state agencies to help close an estimated $127 million spending gap.

Advocates on both sides are lobbying Daugaard on the bill.

Leslee Unruh, the president and founder of Alpha Center, a Sioux Falls pregnancy help center, said Wednesday she's spoken to Daugaard about her support the measure.

"I feel that the governor is going to read the bill on its merits," Unruh said. "The governor's got a big job."

The American Civil Liberties Union's South Dakota chapter, which has sued the state several times before over different laws, and other groups denounced the bill. "The South Dakota legislature should be ashamed of this demeaning and destructive law," state director Robert Doody said in a statement.

The counseling bill comes after a separate proposal to make killing in the defense of an unborn child a "justifiable homicide" drew the attention of national groups. Many groups said the bill would endanger abortion providers. The state House eventually rejected that measure.

The lawsuit is a one time expense. What about the counseling? Are these expenses allowed in this guys budget? How about the counseling for abortion. Is this provided for? "pregnancy help centers," all of which seek to persuade women not to have abortions. Will the indoctrination of the Re-Publicans ever stop?

Please, won't somebody file a lawsuit on behalf of South Dakota's and this whole country's women!

This law is sick.

If anybody has seen the documentary "12th and Delaware," you'd understand what those "Pregnancy Counseling Centers" are all about. Those places offer no financial support for prenatal care or birthing the child in a hospital.

Interesting how the Republicans want government out of people's lives until certain issues arise. They want government to force women to give birth, in some cases even if the life of the mother is in danger or the pregnancy is the result of rape or incest. I'd much rather have them mandate health care or many other things.

It's a mystery why my previous comment on this topic is still "pending", but I'll re-state -

I think the majority of Americans are somewhere in the middle on these issues. These potential laws bring up salient comparisons.... Is it reasonable to chill-out for 72 hours before aborting a pregnancy? Well it's considered reasonable to chill-out before buying a gun...so...why not an abortion? Is it reasonable to favor promoting adoption over abortion? There are a lot of people waiting to adopt out there...ok....BUT is it reasonable to protect the health of the mother, or to avoid incest pregnancies? Of course it is. If you are pro-self-defense regarding gun control, then allow a mother to defend her body or life..... ....and a waiting period is reasonable.

Politicians hate that grey middle ground... but many statistics show that the majority of Americans love the grey middle on many issues. Let's uphold the long held American tradition of compromise.

The vast majority of politicians legislating or attempting to legislate abortion restrictions are males. Perhaps a better way to shape legislation is to conduct larger, better, national polls on such topics... Imagine a thorough multi-million-citizen poll regarding abortion law...asking citizens to rank a comprehensive list of solutions in order of preference. Now...imagine all the citizens polled are exclusively women over 18...... potentially fascinating results

What is going on with these [expletive] Republicans? They go from issue to bloody issue....and won't be happy until every US citizens thinks just the way they do. Bust the Unions, questions Obama's birthplace, keep the rich rich, now it's this misogynistic mission to have women do their bidding with regard to abortion. It's beyond my imagination to think that any woman "wants" an abortion. It's not about what women "want". It's about what's best for the woman, her family and any addition to that family. It's about her circumstances, her financial situation, her support systems or lack thereof...it's about how the pregancy occurred..it's about the health of the woman. What it isn't about is some legislator dictating that she be "counseled" against having an abortion. The unmitigated gall of these Republican men [and women] taking it upon themselves to determine what is right for women. And further that women aren't capable of making a decision like this, that they have made it without consultation with family, health care providers and other personal supports. Because that's what legislation like this says. Isn't it about time at this point in our history that politicians stop making laws that reflect their own personal [and usually religious] views rather than what is the will of the people?? What the hell ever happened to separation of Church and State?
