PHOENIX — Federal prosecutors on Friday announced new charges against the suspect in the attempted assassination of Rep. Gabrielle Giffords, accusing him of killing six people and wounding 13 others who were exercising the fundamental American "right to meet freely, openly and peaceably with their member of Congress."

A federal grand jury returned the 49-count indictment Thursday, charging Jared Lee Loughner in the deaths stemming from a Jan. 8 shooting at a political event held by Giffords outside a grocery store.

"This indictment is comprehensive and is solid, and covers all the murdered and injured victims," U.S. Attorney Dennis Burke said. "There are no distinctions at all between the victims. These victims were exercising one of the most precious and fundamental rights of American citizens."

The indictment charged Loughner in the murders of U.S. District Judge John Roll and Giffords aide Gabe Zimmerman, and with causing the deaths of four others who were not federal employees, including a 9-year-old girl.

Loughner also was charged with causing the death of a participant at a federally provided activity; injuring a participant at a federally provided activity; and using a gun in a crime of violence.

Loughner had pleaded not guilty to earlier federal charges of trying to assassinate Giffords and kill two of her aides.

His attorney, Judy Clarke, didn't return a call and e-mail left at her office Friday.

Federal prosecutors haven't yet said whether they will seek the death penalty against Loughner. But legal experts believe it's a virtual certainty.

Burke said because Loughner is eligible for the death penalty if convicted on some of the charges, the U.S. Attorney's Office is pursuing "a deliberate and thorough process" in prosecuting the case.

Loughner will likely face state charges in the attack as well, but will be tried first in federal court before any prosecution begins on state charges. Federal and county prosecutors said federal law requires state prosecutions to be suspended while a federal case is pending.

Loughner is scheduled for a court hearing in Tucson on Wednesday, when he will be arraigned on the new charges.

A day after the shootings, prosecutors filed a complaint in court charging Loughner with trying to assassinate Giffords, attempting to kill two of her aides, and killing Roll and Zimmerman. Those charges were later replaced by federal indictments that mirrored the same charges.

In many criminal cases, prosecutors will often file charges themselves without a grand jury indictment, but will later replace those charges with an indictment.

It was not known why the charges against Loughner weren't contained in one indictment.

This is where our judicial system gets a little murky. We know he killed one person and attempted to kill others.
For me one change is quite enough, premeditated murder.
Let’s have a swift trial and a swift ending to this horrible mess. This is where the lawyers step in and make their ongoing vacation money.

I just regret that he went after someone GOOD........he would have been a hero in Wisconsin. I am not condoning what he did....it was horrible & tragic.....but if he ABSOLUTELY HAD TO DO IT, Scott Walker and his pals would have been a much better choice!

Before you get offended, ask yourself: "Are we mourning Saddam Hussein?.........Hitler?...........
Stalin?............." I rest my case!

I am not really convinced this story even happened all I see is a few photos. I would not get all worked up over this. Let's see how this plays out. I want to see the real proof of this"crime" So far we only see a video clip of supposed paramedics, yellow tape, police car, a man's picture, and the rest are words. I am leery of this whole "event"... I never trust the news any more.

i find this prosecution to be as despicable and disgusting as the actions that the young man allegedly did. if HE were a SHE, the entire world would be asking what we can do for this obviously completely profoundly mentally ill and deranged young woman, yet HE was punitively treated by all who encountered him as he obviously descended further and further into madness; not one offered a helping hand, except by a young male friend. instead they all recoiled from him, spoke to the police about him; even officials whose responsibility it is to assess one's mental health (those who served him papers from pima college are guilty of seeing a MALE and treating him harshly, as though there were no other factors besides some anger issue, as opposed to the clear profound paranoid schizophrenia that he fluoridly suffers from. so, its ok for andrea yates to plan then consciously drown her babies, 5 in all, one by one, and yet she walks the streets a free women (even as her husband was repeatedly blamed for HER actions), but for this and so many young MEN, death is the answer for profound mental illness over which they have no control, and, in this case, for which jason NEVER got any help at all, including, from news stories, his own family. this is a sick and vengeful society against boys and men of all ages, while women can kill anyone and be walking the streets weeks//months later.

I was wondering if he was going be found incompetent to stand trial.  I don't think there is a woman/man double standard.  I think the drivers of the outrage are Gabby Giffords and Christina Taylor-Green.

I saw a doctored picture on another website, where half the face was Beck's and half was Loughner's. Someone must have gotten cold feet and taken it down, because I didn't see it there again. Really, the similarity was amazing. It's the eyes, I think...that same faraway, in another world, look.
