Tea Party, Labor Spend Big In Wisconsin High Court Race

MILWAUKEE (AP) -- Pro-labor organizations and one of the country's largest tea party groups are pouring money into Tuesday's Wisconsin Supreme Court election in an effort to turn the normally sleepy race into a referendum on the national fight over labor rights.

The attention from conservative and liberal groups has energized voters and set the election on pace to be the most expensive high court race in Wisconsin's history. Sarah Palin even weighed in via Twitter on Friday, throwing her support behind the incumbent conservative justice.

The candidates, Justice David Prosser and Assistant Attorney General JoAnne Kloppenburg, say the race is about their qualifications. But the unusual level of interest has put the union issue front and center and shows passions remain inflamed over Republican Gov. Scott Walker's collective bargaining law, which sparked weeks of angry protests at the Capitol and made Wisconsin the center of the ideological debate over union rights.

Four conservative groups, including the Tea Party Express, have combined to spend $1.2 million so far on pro-Prosser ads, according to a media-tracking group. A liberal heavyweight had spent $993,000, as of Thursday. And spending on both sides was expected to hit a furious pace in the campaign's final days.

The seven-member court is officially nonpartisan. But Prosser is seen as part of a conservative four-justice majority, while a win by Kloppenburg would tilt the court's ideological balance to the left.

That could make a difference if a current challenge to Walker's law eventually makes its way to the state Supreme Court. The law is on hold after a judge ruled Friday that a temporary restraining order blocking it would remain in place for at least two months.

Regardless of who wins, the governor says he won't interpret the results as an endorsement or indictment of his policies. Walker said voters who have a position on certain legislation should vote for lawmakers who support their views and use the Supreme Court race to choose who's more qualified to interpret the Constitution.

But the electorate, along with lawmakers, is certain to find deeper meaning in the outcome, said Charles Franklin, a professor of political science at the University of Wisconsin-Madison.

"If the Democrats win it sends a strong message to the Republican lawmakers about how aroused the Democratic constituency is," he said. "Conversely, if Prosser is re-elected it's a huge win for the Republicans. It shows they can weather the current controversy. It should actually strengthen their resolve."

Wisconsin has a recent history of costly Supreme Court races, with outside groups spending a record $3.4 million in 2008, according to the Brennan Center for Justice, a New York University program that tracks media spending on judicial races. After a quiet race in 2009, spending this year reached about $2.2 million by Thursday, and a frenzied burst of last-minute ads had spending on pace to top $3.5 million.

One conservative group, the California-based Tea Party Express, is aiming to spend up to $200,000 on an ad that paints Kloppenburg as unqualified for a judgeship and a puppet of union bosses. The group says its Wisconsin members asked it to get involved after labor unions went on the offensive against Prosser.

On the other side is the liberal Greater Wisconsin Committee. The group has spent nearly $1 million since Thursday, including on a TV ad that calls Prosser a Walker clone who would be a rubber stamp for the governor's policies.

Brian Nemoir, Prosser's campaign director, said Kloppenburg is trying to deflect the focus from a race between a 12-year judicial conservative with a strong record and a political and judicial unknown.

"We believe the race has been hijacked" by Kloppenburg and her allies, Nemoir said. "We should get back to what's important."

Kloppenburg's campaign countered that it was Prosser who first played up his associations with Walker. Campaign manager Melissa Mulliken noted that Prosser's campaign issued a statement in December saying Prosser would serve as a complement to Walker and conservatives, a statement that Prosser has since disavowed.

"I see JoAnne's message of independence and impartiality resonating with voters around state," Mulliken said.

What happens in Tuesday's election also could provide a blueprint for how judicial races play out in other states. For example, the Tea Party Express said it's monitoring other states that are trying to limit collective bargaining rights and is prepared to get involved in those races in the future.

"We haven't made a move in other states yet, but we've got our eye on them," spokesman Levi Russell said. "We think Wisconsin's going to be real symbolic."

Attention Wisconsin Voters:

Whatever you do, VOTE.  It matters.

However, much time you may think it takes out of your day ...look what happens when you stay at home. Look at all the time you have to spend then, protesting to simply remind elected officials of their humanity. Nip it in the bud by keeping these kinds of people out of positions of responsibility.

If there's a recount, I think Kloppenburg will come out with even more votes than she has now. I think Wisconsin has had more than enough of anything and anyone even remotely connected to Scott "I thought I was king" Walker.

Don't you just love the fact they spent all that money and it went right down the drain? Millions gone from their coffers...and they're not going to get a thing for all that money! Life is so wonderful sometimes!

Yes. And here is my rant.....
The lawsuit before SCOTUS has Wal-Mart trying to get it thrown out on grounds that it is a class action suit. This is exactly for what class action suits were created....many plaintiffs on the same grounds against the same defendant.
Who hasn't felt a sadness as the WalMart greeter, an elderly and often infirmed woman that is made to stand during her shift on concrete, you encounter at the entrance. The elderly greeter is not there out of the generosity of WalMart. The person is a psychological deterrent to shoplifters.
It has been 88 years since Alice Paul wrote the original Equal Rights Amendment and it has been 39 years since the ERA was submitted for ratification. 7 states made no attempt to ratify the ERA: Georgia, Alabama, Mississippi, Arkansas, Utah, Arizona and North Carolina. Not progressive states. There were other states that ratified it and then rescinded.
At a time when 9 out of 10 new jobs are being filled by men (US Dept of Labor 2010) why are women still second class citizens.
Why are women, who were finally almost past the unwed pregnancy stigma of having to say their daughter is "staying with her aunt for awhile", still cowering to men that insist on knowing the private details of what was once between a dignified professional of medicine with a private privilege and their patient?
Women will be registered in the next draft so give us our rights.

The turnout by us (Waukesha County near Milwaukee) seemed very high for an off election like this. It seemed nearly as much as the last year's Governor's election.

from the deep woods northern wisconsin: our township has 140 registered voters, by 4pm way over spring 20% turnout, more like 40-50%. I was number one at 7:01am for JoAnne Kloppenburg!! Go to the polls and VOTE citizens of Wisconsin.

This is from the Wednesday, April 6th edition of The Dunn County News ( Our carrier delivers a day early). The Senator has a history of avoiding her constituents.

"Koch's Americans for Prosperity Aims at Kloppenburg, Strikes GOP Attorney General?"

Compare criticisms in the AFP mailer with contemporaneous facts:

“Kloppenburg prosecuted an Appleton-area economic developer. The business was forced to pay a $150,000 fine which ultimately bankrupted the job-creating project.”

A February 27, 2009 press release Attorney General Van Hollen proudly stated that the developers were fined for filling wetlands without a permit and taking steps to damage wetlands. According to the release, “Runoff pollution is the major source of polluted waters in Wisconsin. "Wisconsin law requires that developers and contractors properly manage construction sites to protect state waters," Attorney General Van Hollen is quoted as saying. "The Department of Justice will continue to work with the DNR to ensure that Wisconsin's natural resources are protected through compliance with the law."

“Kloppenburg argued in court against raising water levels of wetlands along the Rock Koshkonong Lake District. The lack of water level has caused property values to drop, killing tourism and jobs in Rock County.”

Here too, Attorney General Van Hollen is the named attorney for the DNR, and Kloppenburg argued on behalf of the DOJ to protect the area wetlands and preserve fish and bird habitats."

Just returned from casting a vote for Kloppenburg. When I arrived there was a pickup in the parking lot with anti union, anti teacher signs on it. The kicker? Fanciest looking truck in the lot with custom paint and an eagle mural in the rear window. Darn those wealthy teachers and their compact cars.
