SAN DIEGO -- A judge ruled Thursday that a San Diego pro-gay marriage group can continue canvassing outside of Target stores in California, but the group's volunteers must stay 30 feet away from store entrances and canvass at just one entrance at a time.

The Minnesota-based retail giant had sought an injunction barring the activists from every outlet in the state, alleging they harass customers by cornering them near store entrances to discuss gay marriage, solicit donations and collect signatures on petitions.

Rights advocates have warned that the legal battle between Target and Canvass For A Cause could further damage the retailer's already strained relations with the gay and lesbian community.

Canvass For A Cause director Tres Watson called Thursday's ruling a win for not only his organization, but also for free speech.

"I think this is a victory for every American that cherishes our fundamental values," he said.

Superior Court Judge Jeffrey Barton said some Target stores may fall under California's law that considers shopping centers to be public forums. Also, canvassing over the last year occurred mainly without incident and Target failed to demonstrate that customers were being harassed, he said.

"Target has not met its burden to show that its blanket policy to ban all solicitors at all stores in California is proper," he wrote.

The corporation has said at least eight Target stores in the San Diego area have received more than a dozen complaints daily since canvassers started working the locations in October 2010. The activists have refused to leave when asked politely and shown the company's policy prohibiting "expressive activity" on its property, Target said.

During a court hearing last month in San Diego, Barton asked Target's Los Angeles-based attorney David McDowell why the company didn't present testimony from customers who the company said had complained.

McDowell said the testimony could have been obtained, but he didn't think it was necessary since the complaints weren't the central issue. The case was about Target's right to enforce its rules on its land, he said.

"The question is Target's property right and its right to exclude," McDowell said.

Target Corp. said in a statement Thursday that the legal action was "to provide a distraction-free shopping environment for our guests."

"Target's long-standing policy is that we do not permit solicitation or petitioning at our stores regardless of the cause or issue being represented," the company said.

Barton warned the San Diego group to be respectful and to not block the flow of traffic. The restriction to canvass at just one entrance at a time was to ensure that customer access wasn't impeded, he said in the ruling.

Watson said the constraints wouldn't affect the group's work because volunteers don't follow people into stores or block store entrances.

Target was seen as an ally of the gay and lesbian community before it made a $150,000 donation to a business group backing Minnesota Republican candidate Tom Emmer, an opponent of gay marriage who lost last year's governor's race to Democrat Mark Dayton.

The company later apologized for the hurt feelings and tried to repair its image by creating a committee to help scrutinize its decisions on donations.

Target also negotiated a deal with Lady Gaga to sell a special edition of her upcoming album in a partnership Gaga said was tied to their "reform" – supporting the gay community and making up for past mistakes. The singer cancelled the deal a few weeks ago.

The reason why you can protest in a Target parking lot but not a Planned Parenthood parking lot is because Planned Parenthood sells a third of the abortions in this country, while Target just sells a third of this country's bad furnishings.

Eh, not quite the same thing. A home (and the property you own) is private land for private use, so you have the right to kick people off if you want. On the other hand, Target is a place of public accommodation, so they have to follow certain rules, like not discriminating based on race and not unreasonably restricting free speech.

I am glad Target lost, but as a business person, I don't want anybody to harass my customers.period. What rights do customers have to not have to wade through one group or another?

Customers have the right to know when a business makes decisions against the very people they "target" to there locations. Target wants the gay $ spent in their stores but does not want to believe in fredom of choice. What right does your consumer have....they have the right to drive away from your business if you are a known bigot. Cancas for a cause has the right to educatethem first so the field is level.

I am gay and would like to have the same legal rights as straight couples. I am also a consumer and when I go shopping at my local department store, I do not want someone asking me for my time or my money when I just went there to pick up school supplies for my daughters. That includes salvation army, girl scout cookies, etc. If Target doesn't allow ANY soliciting, then they should be allowed to make that decision for the comfort of the consumer.

I am a homosexual as well, nothing turns me off more than a store that asks for donations to its cause...like Whole Foods (Whole Paycheck)...and, my local Co-op, Walgreens for Salvation Army and on and on...thanks for reminding me to stop frequenting these places...I dislike this form ingratiating faux charitable corporate good deed doing all together...

Well, yeah. If the Westboro Baptist Church is allowed to protest at funerals, then there should be absolutely no doubt that anyone can canvass outside stores.

Target and business in general don't like it when those pesky people show up and bust their PR Fog machine...if they behaved responsibly and without supporting bi.gots in the first place this would not be necessary. Essentially Target is blaming the victims for what is a problem of Target's making

I regret a bit this decision : it was so agreable not to be yelled "Do you believe Jesus is the Saviour?!" or "Do you think gays have equal rights?!" each time you wanted to buy something!

I love Trader Joe's - they have signs out front that basically say, "Be Believe You Should Have a Hassle Free Shopping Experience at Trader Joe's. You Have Our Permission To Ignore A Canvasser and NOT Feel Guilty!"

why is he self absorbed? When I shop I avoid the "mine fields" girl scout cookies, petition signing, save the whales, voter registration and so on. I am not anti anything, but a lot of times my shopping time is limited and don't need the hassles. I like to digest things at home where I can delve into them deeper before making a decision. People need to stop take a deep breath and think of others more than them selves, peace

Your article fails to mention WHY Lady GaGa cancelled her agreement with the store - because they were NOT changing their anti-gay activities. Also fails to point out that only weeks after apologizing for it's anti-gay political donation - it made another.
There is good reason that gays are now NOT shopping at Target. They talk a good story, but act the opposite. They WILL learn that doesn't work well.
Bad publicity - especially when earned - hurts retail business. Period.

Seems like a good compromise decision, you can canvass just dont harass people and this should work out if all parties act like adults, however we shall see if Target gets this appealed up to the Supreme Corporate Court of the United States (SCCOTUS) then Target will win because afterall they are a corporation and have individual rights just like any other human being

No, it's not.

Target should have the ability to determine what happens on its property or the property it is leasing to operate its stores.

Shopping centres are not "public fora."   They are places of business.

This man has posted below that he hates California and this country and I am sure that much of it is that the courts are establishing the rights of groups of which he doesn't approve (which seems to be any that aren't white, right-wing, and possibly Christianist). Even when the ruling has been made, he keeps on yelling about it. He's also on many of the GLBT threads with his nonsense about GLBT people/

Target stores often have a sign out front about how they don't allow solicitation or petitioning on their premises. Right in front of that sign is often someone soliciting donations or asking for signatures - usually on some sort of christian agenda issue.

Wrong. If they fence it off, maybe. But since they invite the public in and essentially make their entrances and parking lots public places...this changes the situation greatly. Case law has shown this for many years. Ask any shopping mall operator about this.
