Tammy Baldwin Asks Eric Holder To Investigate Wisconsin Supreme Court Election

WASHINGTON -- After the bombshell announcement that a Waukesha County clerk forgot to report thousands of votes in Wisconsin's Supreme Court election, Rep. Tammy Baldwin (D-Wis.) is asking U.S. Attorney General Eric Holder to involve the federal government in the ongoing investigation.

Last Tuesday's election, which pitted conservative incumbent David Prosser against progressive candidate JoAnne Kloppenburg, appeared to end with Kloppenburg winning by a razor-thin margin, with initial results showing her just a couple of hundred votes ahead. But on Thursday, Waukesha County Clerk Kathy Nickolaus held a dramatic press conference and admitted that she had forgotten to report the votes of the city of Brookfield. The adjusted total gave Prosser a 7,500-vote advantage.

On Friday evening, Baldwin sent a letter to Holder, saying that many of her constituents had expressed concern about the announcement. She requested that the Department of Justice's Public Integrity Section, which oversees the federal prosecution of election crimes, investigate the handling of Waukesha County's vote records.

"For our democracy to endure, we, the people, must have faith in its laws and system of justice, including faith that our elections for public office are fair and free from any manipulating or tampering," wrote Baldwin. "Following this week’s election for the Wisconsin Supreme Court, numerous constituents have contacted me expressing serious doubt that this election was a free and fair one. They fear, as I do, that political interests are manipulating the results."

A Justice Department spokesperson told The Huffington Post that they had received the letter and are reviewing the matter.

Prosser has not yet declared victory, telling WKOW 27 News that he will wait until a canvass of all vote totals and certification of votes are submitted. He also called the idea of a federal probe "preposterous."

But Baldwin and her constituents weren't alone in their concerns. Other groups immediately raised questions about Nickolaus' revelation. The Wisconsin Policy Research Institute's Christian Schneider, who broke the news in the National Review, pointed out that prior to the election, Nickolaus "was heavily criticized for her decision to keep the county results on an antiquated personal computer, rather than upgrade to a new data system being utilized statewide."

The Waukesha County Board also chastised the clerk after she brushed aside their recommendations for improving election security.

On the day of Nickolaus' press conference, the group Citizen Action of Wisconsin called for an immediate federal investigation and impoundment of all computer equipment, ballots, and other relevant evidence for fair vote count in Waukesha County.

In her letter to Holder, Baldwin cited many of the past controversies surrounding Nickolaus, as well as the fact that Prosser was essentially Nickolaus' boss while she was a data analyst and computer specialist for the Wisconsin Assembly Republican Caucus. Nickolaus worked for the caucus for 13 years. During some of that time, Prosser was either Speaker or Minority Leader.

On election night, Brookfield Patch reporters Joe Petrie and Lisa Sink reported that Prosser received 10,859 votes from city residents and Kloppenburg received 3,456 -- totals that exactly match what Nickolaus claimed she forgot to report when submitting totals for the county. HuffPost Pollster's Mark Blumenthal said it was perhaps "the most convincing evidence so far that human error explains the initial omission of Brookfield's results."

Many observers also pointed to the fact that Ramona Kitzinger, a Democratic member of the Waukesha County canvass board, stood with Nickolaus and attested that there was no foul play. But on Monday, Kitzinger herself raised questions, wondering why Nickolaus -- who said she discovered that she had not properly saved the Brookfield data on Wednesday -- didn't admit her error until Thursday.

"As I told Kathy when I was called into the room, I am 80 years old and I don't understand anything about computers," she wrote. "I don't know where the numbers Kathy was showing me ultimately came from, but they seemed to add up. I am still very, very confused about why the canvass was finalized before I was informed of the Brookfield error and it wasn't even until the press conference was happening that I learned it was this enormous mistake that could swing the whole election. I was never shown anything that would verify Kathy's statement about the missing vote, and with how events unfolded and people citing me as an authority on this now, I feel like I must speak up."

Yes, this DOJ under Holder seems to get a lot of letters asking them to investigate things, like the fraudulent foreclosures, the criminal acts by BP and other corporations and yet weeks, months, and years pass while the letters pile up in some dark abyss somewhere while Holder  Read More...

Hopefully Holder can get to Baldwin's investigation as soon as he's done with the New Black Panther Party case. Oh, and he might want to look into the voter fraud that put Stuart Smalley in the Senate. More votes cast than registered voters in some districts should pique the curiosity of even the Obama DOJ.

Ms. Baldwin can make all the noise she wants to, but the fact remains, the correct vote totals were published by the Brookfield Patch (Owned by Huffington) on election night. These were given to The Brookfield Patch, by the Brookfield City Manager, and the same totals that were given to Kathy Nickolaus, which by an honest mistake, were never transferred to the final totals! The numbers agree with the canvassed totals, and more importantly were published April 6, 2011, and updated by Huffington an hour or so later. There was no conspiracy "Witch Hunters"! Nice try, but Prosser still wins!

Oh, and that 80 year old woman who was sent to confirm that there was no funny business, is now lying under pressure from the Democratic Party! If she wasn't competent to do the job, she never should have been sent in the first place! Prosser still wins!

Why! There was nothing illegal done! Maybe you should be asking yourself why Tammy Baldwin wants to stick her nose into something that is legally a State matter! She should know that the Federal Government has no power to be involved unless it comes up on appeal to the US supreme Court! Even then the US Supreme Court would have to request the Federal Government to investigate it, before making a decision!

Why is it so difficult to understand that mistakes do happen? Not just in Wisconsin, but in every state. This time it just happened to be a large amount of votes Remember also that the vote count given was not a certified count. The Canvas to certify the result is where the error was discovered! That's why they conduct the canvas in the first place. Better yet how would you like to have been responsible for the tally in an election where the voter turnout was 3/4 million more (twice) than what was expected, and been there since 7AM and the polls didn't close for 12 hours? People get tired and tired people make mistakes. Had it been the certified total that was in question, you would have had an argument there, but the certified total was correct! The Brookfield Patch reported the correct totals on election night, and the Huffington Post updated them the same night. The votes had already been counted, so any argument about them is totally useless!

You might have had a point, except for the fact that the proof that the Brookfield count was reported in The BrookField Patch on election night, and matches the official vote tally, after the automatic canvas!

There are cases that the federal Government can investigate an election, but they have to have clear evidence of fraud first. They wouldn't do it in this case because clear proof exists to show that these were the actual vote counts! The Brookfield Patch news report proves it! You could never get the Feds involved over an Unofficial vote count in the first place. Now had it happened after the canvas to certify the vote was complete, that would be cause for an investigation. I can't bring myself to call the person who made the mistake incompetent though. Having to deal with a turnout twice the normal voter turnout and not making any mistakes in a roughly 14 hour period, would be ridiculous to even consider. It just goes to show that people are human. I have no axe to grind either way as I don't vote for any particular party, I vote for the individual who I feel is best qualified for the job. We have both Good and Bad in all the Parties. A very good example of that is the aforementioned Joe Miller, and the issues he raised over not respecting voter intent, because the law was specific. He well knew that the Alaska law as written was unconstitutional, yet he went ahead and cost the taxpayers of Alaska Millions of dollars, and lied to the people as well. Now, Miller couldn't get elected Dog Catcher anywhere because he no longer has any credibility!

Regardless of how all of this ends up, the fact remains that 19 counties that Walker carried are now over in the "blue" column. They can't take THOSE numbers away. Repubs are going to have major trouble going forward in this state.... and the more Walker & Co. keep up the bullying, the more they will lose in the end. And don't forget those recalls this summer. Fun times ahead! Got to get some new signs made for the rallies coming up.

You're right, KGN, can't take those numbers away. They'll return to their roots though, so don't worry. They'll be back in the red column when taxes are lowered, fiscal sanity returns and the public servants stop trying to steal the public's money.

Waukesha County judge charged with disorderly conduct

Waukesha County Circuit Judge Linda Van De Water is no stranger to controversy.

As a prosecutor, she botched a case against a man charged with beating a tavern owner to death. She then got in trouble for repeatedly bringing her dog to work during her first term as judge. She was also deemed "offensive and discourteous" by a prosecutor during a suspected drunken driving incident in Oconomowoc.

By adding up numbers from each ward as reported by local poll workers, the Government Accountability Board (which is run entirely by people appointed by a Democratic Governor) can arrive at a vote total for Waukesha County independently of Kathy Nickolaus.

You can't fabricate votes when they have been already been counted and reported on election night, and the reported figures match exactly the numbers that were not posted to the Tally sheet, and are the same figures the Brookfield City Manager gave to Kathy Nickolaus, and to The Brookfield Patch!

Why is it that some people completely ignore the facts? Arianna Huffington (who owns The Brookfield patch) would have had someone's head on a platter if what you are saying was true. There is no crime in accidentally misreporting an unofficial Count. That's why it is an unofficial count until the Canvas of all the precincts is complete, and the votes certified!

Governor Scott Walker in trouble again in Wisconsin. Seems he excepted money back in 05 From Gardner, than had to give it back an turn around a Gardner had given him money again. Gardner is not rail road. He's Construction of some sort that worked on road with state contract. While walker turned down the Fed. money for Rail Road, he was involved with NON-union contractors on road construction. Now there is a dig going on to see who alse funded him that benefited from Walker Governor possition. Seems Walker may be looking at Ethic Violations after all. Even if he is sent to the Hill as they claim he has been, Issa will only pat him on the back an give him a full pass! I would like to bet all u $10.00 that Issa congradulates him for turning Wisconsin around, an nothing alse!

GAB Director Kevin Kennedy says the agency's investigation of spring election procedures in Waukesha County remains ongoing, but that the final canvass numbers in the city of Brookfield match the initial tallies from poll workers on Election Night.

"We don't see, at this point, any criminal activity, but we certainly see practices that need to be changed to bolster public confidence," Kennedy said.

GAB staff is now the process of matching those numbers for all Waukesha County wards after Brookfield ballots were mistakenly left out of Election Night returns from the county clerk. The numbers tentatively turned a razor-thin lead for Supreme Court candidate JoAnne Kloppenburg into a margin of more than 7,000 votes in favor of incumbent Justice David Prosser.

Kennedy also said GAB staff is reviewing Election Night practices in the county, saying he hopes to give the public and the press greater access to the county's results and break them down by voting precinct so that the 24 voting wards in Brookfield wouldn't be overlooked in future elections.

Kennedy also said the Milwaukee County canvass likely won't be done until Wednesday.

It is pretty much game over now. Prosser is victorious unless something strange happens in Milwaukee county.
