Facebook creator Mark Zuckerberg scored a major victory on Monday, when a U.S. appeals court ruled that the Winklevoss twins could not appeal their previous settlement with Facebook over claims that Zuckerberg had stolen their idea for a similar site. But the victory may prove to be short-lived.

Another of Zuckerberg's former challengers, Paul Ceglia, has again reared his head.

Ceglia, a New York state businessman, has produced new evidence in his case against Facebook. Last year, Ceglia filed a lawsuit claiming that Zuckerberg had signed a contract in 2003 that awarded Ceglia $1,000 and a 50-percent stake in the fledgeling social network. In return, Ceglia said that he worked as a designer and developer on Zuckerberg's site, while Zuckerberg worked as a coder for Ceglia's StreetFax.com.

Facebook denied Ceglia's initial claims, and many wondered why Ceglia had waited seven years to come forward. In addition, Ceglia had been arrested in 2009 and charged with criminal fraud.

While Ceglia's allegations seemed far-fetched in 2010, Business Insider reports that he has refiled his case and has brought forward more than a dozen emails allegedly written by Zuckerberg in 2003 and 2004.

In one purported email from 2003, Zuckerberg bounces around ideas for renaming the site and suggests that a good way to monetize would be to charge alumni $29.95 a month. In another, he mentions a pair of Harvard classmates [presumably the Winklevoss twins] who have a similar website idea. As the launch of Zuckerberg's website is delayed into 2004, the email correspondences begin to break down. Ceglia reminds Zuckerberg that their contract entitles him to a larger percentage of Zuckerberg's company the longer the site is delayed.

In an alleged email dated February 2, 2004, Zuckerberg mentions his contract with Ceglia explicitly, writing,

Paul, I have a rather serious issue to discuss with you, according to our contract, I owe you over 30% more of the business in late penalties which would give you over 80% of the company. First I want to say that I think that is completely unfair because I did so much extra work for you on your site [StreetFax.com] that caused those delays in the first place and second I don't even think it is legal to charge such a huge penalty. [...] I'd ike to suggest that you drop the penalty completely and that we officially return to 50/50 ownership.

Ceglia agrees, according to later emails. Then, Zuckerberg backs out of the deal, writing to Ceglia that students have not shown much interest in the site and that he is considering ending the project.

If these emails are real, Ceglia stands to earn a huge payout from Facebook.

Facebook, on the other hand is flatly denying their authenticity. "This is a fraudulent lawsuit brought by a convicted felon, and we look forward to defending it in court," a Facebook lawyer told Bloomberg.

At the time Ceglia filed his first suit, Facebook was valued as high as $22 billion. Now, the site is believed to be worth over $50 billion.

Oh the problems of being a multi-billionaire. While billionaires gets their tax cut, the other 98% of this country struggles with $4.00 per gallon gas, and skyrocketing food prices.

Someday i will be rich and all of these problems will be behind me. That is why i keep voting republican.

Sure is good theater, i guess.

Not sure, how this got tied to this post. Yeah. It appears to be creeping. Your are right.

Let me ask you this. Pretend you are the President of the US and you are 100% against going to war in Libya and Admiral Mullins comes to you and says :

"The libyian military has formed ranks and pointed heavy artillery at Bengazi. We believe that Gaddafi will level the city and kill between 25,000 and 50k people. We have an aircraft carrier battle group in the Med and we could stop it. The cost would be about 50 million and we think we can do it without losing a single life."

A completely legitimate response is "we can't afford to get involved in another war" or we can't be the worlds police man."

To which A. Mullens replies, "okay, Mr. President, so we just let these people die tomorrow when Gaddafi orders the artillery to fire?"

A legitmate reply would be to say "But it wont end there, we will need to put troops on the ground, there is a very high likelihood that this mission will creep into a full war."

To which Mullins replies "okay, so we let those 50k people die tomorrow then?"

One more thing Ernest,

Based on the news today, regarding McCain. Had Obama not won the White House, i think we can all say, McCain would have put troops on the ground and engaged us in another war.

Just look at the comments that he made today.

To be fair, Obama still may put forces in the country, en masse. My hope is that he doesn't but I much prefer the measured, careful approach that Obama is doing to the passion for war that McCain would have brought to the office.

We would have a third front in the middle east right now if the GOP controlled the white house.

Except when you consider that he was only charged with fraud, not convicted (this remains a big difference in our system of justice, at least to some of us). And when you consider that a major law firm has vetted his evidence, and would be unlikely to risk their law licenses by submitting trumped up documents. I suppose it's not possible that Zuckerberg could have hood-winked Ceglia, I mean it's not like he's done that before with other collaborators ... oh, wait.

What I would like people to consider is this. If Facebook is free to use. How is it that Zuckerberg is worth almost 15 Billion dollars? Where does THAT MUCH money come from? Ok, the easy answer is advertising, but how many of us actually click on the ads? I have never clicked on a fb ad, and I'm certain there are many like me. The truth is, all of your information is used to target against you in ways that would utterly boggle your mind. Your actions, connections, like's, etc. are all used against you and your family and friends too. Why else would the security settings be so overtly difficult to navigate? It is the digital age's first real attempt at thought police, and you only need to look as far as people losing jobs, getting divorced, etc. based on things posted to their fb account. My money says FB is dead in the water after a mass exodus of subscribers within 12 months. Thank you for reading.

If Ceglia's claims are found to be true it would instantly end any new investment in Facebook as early and potential future investors scramble to figure out who will actually be running it, and who now owns it. The Winklevoss twins have already inadvertently disclosed their ownership which is 15% if they teamed up with Ceglia they could legally remove Zuckerberg from the company's operations. Facebook borrowed against future shares, more than 5 billion dollars in venture capital to date, turns roughly a billion a year and makes no profit. They have been luring away people from Google with massive share allotments equal to double the highest number of promised shares Google will offer employees. Some at FB have already become squeamish and are unloading the rights to their shares at 50-75 bucks each undervaluing the company by 50% of book. Facebook is garbage all the money is being made now and investors in any future ipo will lose everything.

There is NO way that this e-mail is real. Mark is a smart guy and he effectively scre wed over people who actually WORKED with him on the site. What makes one think that he would be so careless when dealing with this one man but smart and shrewd when dealing with everyone else? Makes no sense.

This lawsuit is extremely suspect: why not bring it sooner than seven years after the fact? Why not enter the emails and contract into evidence in the first case? He is a convicted fraudster and his new lawsuit is based on newly surfaced emails?!?!? The alarm bells are ringing.

Uh, random dude Buzzby. If you had read the documentation linked to the article, you'd see that Ceglia actually put up the original seed money to complete Facebook.

He paid $2000 for 50% of it.

Ceglia was there at the very beginning. Got that?

We should all get off facebook. We know now they sold us all out. The CIA, FBI, local law enforcement are USING Facebook to track down and arrest people. Even the IRS is in the act. If you post something on facebook about your wealth (whether true or not) expect the IRS to come after you. Facebook would and should be a social network for the people, but Zuckerberg the oppotunist not only sold out his friends but in fact sold us all out...our private information is not private and is delivered to every corporation in the world...so they can prey on us.

You are right for the wrong reason - we should all abandon FB because it is a useless waste of time AND because Zuck is compiling all kinds of info about us that he will certainly sell or misuse in the future.
That's what these guys do - they get us to give them information and then they sell or misuse it.

"The Social Network" is just a fictionalized version of how Facebook came to be. Aaron Sorkin noticed that Facebook was popular and that there was (is) a myriad of conflict and controversy attached to the Zuckerberg name. It was an open invitation for any Hollywood guru to make a film. And we (the Americans) bought it.
