Three Boulder County youths are suing the State of Colorado for polluting the atmosphere, contributing to global warming and climate change.

10-year-old Xiuhtezcatl Martinez, 11-year-old Haiden Inskeep and 18-year-old Cecelia Kluding-Rodriguez are joined by WildEarth Guardians, an environmental activist and protection organization of which Martinez is a member, to sue the state as a concerted effort to establish the “atmosphere as a public trust resource” and for damages due to health issues that have surface for the three youths due to a failure to protect the natural environment, according the lawsuit filed by their attorneys.

Roske-Martinez says that part of the reason she is so vested in environmental causes is that she had friends who lost their homes in the Fourmile Canyon Fire, the most destructive fire in Colorado history. However it was really The 11th Hour, the documentary written by Leonardo DiCaprio, that made her such an advocate.

"I started speaking at events since I was six," Roske-Martinez told HuffPost. "We're doing this because our futures in jeopardy and they're not doing a thing. We are in trouble, we're in a global crisis. We've got species disappearing, deadzones in the oceans...so we're telling them to shape up."

“This is something new – no climate litigation in the past has ever gone back to the first principal that the government must protect the public trust,” said Ashley Wilmes, an attorney for the Plaintiffs. “The large body of litigation brought under environmental statutes is too narrow for the crisis at hand. Science, not politics, defines the fiduciary obligation that trustees must fulfill – it’s the most common sense, fundamental legal footing for the protection of our planet.”

The Boulder County youths along with WildEarth Guardians are suing the State of Colorado, Governor John Hickenlooper as well as three state government environmental agencies including, the Department of Public Health, Air Quality Control Commission and Department of Natural Resource claiming that these institutions “have a fiduciary duty to protect the atmosphere from the effects of climate change and to hold this vital natural resource in 'trust' for present and future generations of Colorado citizens,” as stated in the complaint filed.

The Colorado lawsuit is part of a national campaign of lawsuits organized by Oregon non-profit Our Children’s Trust, a youth focused environmental protection and advocacy group, that has already filed similar suits in California, Montana, New Mexico and Washington as well as the United States government.

“The public trust law in our country and around the world says that common resources like water and air are held in trust by the government for the people and for future generations,” said Julia Olson, Our Children's Trust executive director. “Lawyers around the nation are providing legal assistance to young people to help them protect their future, since the government has abdicated that responsibility.”

Each Boulder County youth sues for different reasons. Martinez and Inskeep are described in the filed complaint as boys who have enjoyed the local outdoors near their Boulder County homes, but the streams he used to play in have dried up, the forests near Brainard Lake are now impacted by pine beetles, impairing his ability to continue to enjoy the natural environment around them.

Kluding-Rodriguez is described as having asthma which is aggravated by the climate change, air pollution, more ozone and increased wildfires in the area. The complaint states, “A hotter climate also means earlier blooms in spring and a longer season for fall allergens such as ragweed and mugwort, which means more plants and more pollen, which can exacerbate asthma and respiratory diseases.”

From Boulder County complaint:

The State Defendants, by their inactions and their actions of causing, approving and allowing too many greenhouse gas emissions into Earth’s atmosphere, have breached their public trust duties, resulting in climate change impacts in Colorado, including shorter and warmer winters, a shortened ski season, more wildfires, pine beetle infestations, droughts, and impacts to our water resources. The State Defendants have acknowledged the impacts of climate change, but have failed to take sufficient action to protect the atmosphere and have breached their duties as trustees. The State’s ongoing breach of the duty to preserve and protect the atmosphere for present and future beneficiaries, which has not been abated or properly mitigated, will continue to adversely and irreparably injure the Plaintiffs unless the relief requested here is granted.

According to The Daily Camera, a gathering of thousands of area youth is planned for noon on Saturday, May 14, in Denver. The march will begin at Cuernavaca Park and proceed to Civic Center Park and will include speakers about environmental protection, music and entertainment. The march is one of dozens taking place all over the nation in support of environmental activism and protection.

Martinez is quoted in the The Daily Camera, stating:

Right now, our governments are not protecting our planet; they are just destroying it. I want to make sure my planet is habitable for future generations so we won't be stuck with this mess. I think it's great that there are lots of other kids in their own state trying to fight for their future, but we need everyone to take action -- not just the kids.

I think this is marvelous. To all of you uppity about what these kids are doing, please share with us exactly one thing you have done to address climate change.

I'm 57. I see our generation as failing our young people completely, and if we are unwilling to take up the biggest problem mankind has ever faced and address it, somebody has to pick up the ball. And not only has my generation not picked up that ball, but we have this insane attitude that views on science should be determined by political party. The rest of the world believes in science. The rest of the world is not aware that there's any climate change "debate."

We are not the owners of this planet, and we are even less the owners of the atmosphere. We are its temporary stewards, and that sure as hell means we need to leave SOMETHING for future generations. Something they can live with, that is.

We should be ashamed these kids felt compelled to take this action.

"Global Warming" is just tree-hugger propaganda aimed at making our cities more livable, our air quality healthier and global weather patterns more stable. If these kids have their way, we could create a better planet for nothing!

I find it amazing that any one posting here would balk at what these kids are doing. Get a grip...for once...finally for once since the 60's our kids are smarter than the adults when it comes to earth things. Too many of you lazy pukes want to keep on wanting when these kids are wise enough to look at the future and ask, 'what do we get?'...and right now...that answer is...'the crap we left you'. We think we are so damn smart (with our techno ways)..and all we do is destroy all that is around us for a buck. Adults so often wipe away a childs thoughts as being a childs thought but they sometimes have way more widom than we adults. They 'see' what we fail to see. I say commend these kids...just like the one who started the 'iMATTER' group to sue the feds. They may have their video games, but they are not all stupid....only the adults are who think we can keep on screwing with the earth and not pay a price. In the Native community, we are aware that we must consider the question of..'how is what I am doing today going to affect the next seven generations'...the dominant society only think of 'what can I get for me today...and screw the future generations'. These kids deserve respect

You know what, I agree with you. I was pretty politically inclined as a child, and I never seemed to understand why no one ever took me seriously (despite that I had a better grasp on our political system then most of the adults around me). I'm a college graduate working on a master's and I find that adults STILL don't take even young adults seriously when it comes to political issues. Your point about considering the next seven generations by what you do today is brilliant. The now is important, but where that now takes us is even more important.

Global warming fanatics target kids simply because they are gullible and lack the education and political knowledge to figure out for themselves that this is the greatest scam in world history. They also happen to have a lot of free time on their hands so they are easily brainwashed into causes that they know nothing about and cannot fully understand. Its very sick and a great illustration of why the whole scam is falling apart - the adults aren't buying this scam anymore so their last chance is to target the kids. Sick, sick, sick...

On the other hand, kids have a higher capacity to learn and digest information. They say you peak sometime in your 20's... and I tend to believe that judging by how some older people deny this stuff, despite best evidence to the contrary.

Older folks will have a tendency to just believe what they've been fed their whole life, that our energy sources are good and no problem exists. Not to mention they have a lot more vested interest in keeping the status quo than children do.

So yea... you may want to ask yourself who's really been brainwashed?

oh, how i love boulder.... three square miles surrounded by reality... i miss the flatirons & boulder creek, crunchy folks, bike lanes & sidewalks everywhere, natural food markets & great restaurants, educated people, Buddhist & chill vibe, incredible weather....and why have i not moved back there yet??? niwot's curse!

It's so sad when parents tell their children they are intelligent, when they really aren't.

I was standing in line at a department store last week and I witnessed a girl who couldn't have been more than 8 years old lecturing her father about buying a newspaper because it's bad for the environment.

He started to explain to her that she was the child, he was the parent and that newsprint was quite degradable when his wife started to praise their daughter.

So much for a unified front.

I was about to blow a gasket and instead I looked at the father and said, "did you know that newspaper is made from 89% recycled paper?".

He looked at me with a renewed sense of hope said, "No, I did not".

Then he looked at his daughter and started to explain to her how great newspapers were because they contain lots of information and are recyclable.

The idiot mom glared at me, so I smiled at her and wished her a nice day.

But, if somebody butted into a conversation I was having with a child, whether to take my side or not, I would find it a bit alarming. Unless you are an eighty year old woman or something.

I don't know why. Kids are hammered with green propaganda from the time they enter the public school system until the time they leave it.

You're easily alarmed then. I took my son to McDonald's last Saturday and at a light on the way I saw an black man having car trouble, so I asked him if he needed help. He said maybe, so I turned around after the light turned green and came back to help. He saw I had my son with me and said he did not want to expose him to the gas fumes, as he needed a lift to get some more fuel. I told him it would be fine for the brief time he would be in my car, but he still graciously declined.

See unlike you I'm not scared of people until they give me a reason to be and I always try to help out people in need.

I recently moved to Boulder County from the Northeast. I think the state does a better job caring — or seeming to care — about the environment than where I used to live. In fact, the National Center for Atmospheric Research that tracks and studies global climate change is based in Boulder. They have free exhibits geared toward kids that are pretty neat. The pine beetles are no fun, but they traveled here from elsewhere, and the state is trying to mitigate their spread. I get that this effort is to make a point — as it was organized by the Oregon group to have similar lawsuits filed in multiple states — but I think there are states that are worse offenders. I don't understand the logic of going after states that already do have the environment on their radar. Maybe states that do actually already try to protect the environment are more likely to let the suit advance.
