Planned Parenthood Request To Block Indiana Anti-Abortion Law Rejected By Judge

INDIANAPOLIS — Indiana won a key victory in its fight to cut off public funding for Planned Parenthood on Wednesday when a federal judge refused to block a tough new abortion law, a move that could boost Republican Gov. Mitch Daniels' image among social conservatives as he considers running for president.

U.S. District Judge Tanya Walton Pratt denied Planned Parenthood of Indiana's request for a temporary restraining order despite arguments that the law jeopardizes health care for thousands of women on Medicaid. The American Civil Liberties Union said the decision makes Indiana the first state to cut off public funding to Planned Parenthood for general health services.

Planned Parenthood said it wants to keep funds flowing while it challenges the law signed Tuesday by Daniels. The judge's decision allows the cuts to take effect immediately.

"The decision is devastating," Becky Cockrum, president of Planned Parenthood of Indiana. "There's certainly a chance we will have to decide that we cannot see Medicaid patients unless they are able to somehow pay for their services themselves."

Pratt said the state has not had enough time to respond to Planned Parenthood's complaint and that the group did not show it would suffer irreparable harm without a temporary restraining order. A hearing was scheduled June 6 on Planned Parenthood's request for an injunction to permanently block the law, and Pratt said she will rule on the matter before July 1, when new abortion restrictions included in the law are set to take effect.

Ken Falk, an ACLU attorney representing Planned Parenthood, said the new law makes Indiana the first state to deny Medicaid funds for general health services such as breast exams and pap smears. He and Indiana Solicitor General Thomas Fisher, who represents the state in the case, said Missouri and Texas have blocked the organization from receiving Medicaid block grants for family planning.

Sue Swayze, legislative director for Indiana Right to Life, said she was thrilled with Pratt's ruling.

"This isn't about health care services," she said. "This is about abortion."

The funding cuts are part of a new law that also bans abortions after the 20th week of pregnancy unless there is a substantial threat to the woman's life or health.

The law could improve Daniels' status among social conservatives as he considers standing for president in 2012. Advocates are touting Indiana as the one of the most "pro-life states in the nation" and have praised Daniels for signing the law.

The measure wasn't part of Daniels' legislative agenda and he didn't advocate publicly for it. But he said he supported the abortion restrictions all along and that the move to defund Planned Parenthood hadn't changed his mind.

Indiana lawmakers intended to cut all public funding, but about $1.5 in Medicaid family planning block grants flows to Planned Parenthood through a separate organization, and Fisher conceded in court Tuesday that the law does not affect those funds. The total amount of funding at issue now is about $1.4 million.

Cockrum said Wednesday's ruling means that 9,300 Medicaid patients at Planned Parenthood's 28 locations will lose services from their preferred provider, and her organization must decide soon, perhaps within days, whether it will continue to serve Medicaid patients. She rejected opponents' claims that other providers can provide the same services.

"It's going to be a rare and fortunate circumstance for the disenfranchised Medicaid patient, if in fact they can find a health care center that is close. We've got some pretty steep gas prices these days," she said.

Planned Parenthood also said it will have to stop providing intervention services to partners of persons with sexually transmitted diseases in 22 counties.

But state Sen. Scott Schneider, a Republican from Indianapolis who sponsored the measure to defund Planned Parenthood, said other health providers offer the same general services.

"The case made by Planned Parenthood is nothing more than a false alarm and their claims that women will go without health services are false," Schneider said in a statement Wednesday. "Our new law will allow Planned Parenthood to continue to receive taxpayer funding if they simply stop performing abortions. The decision is now theirs to make."

Cockrum said that was not an option, even though abortions represent only 6 percent of the procedures Planned Parenthood provides per year. It operates abortion clinics in Indianapolis, Merrillville and Bloomington.

"Abortion is a constitutionally protected option for a woman, and some 10,000 or 11,000 women in the state of Indiana avail themselves of that because they determine that's the most right thing for them and for their families," she said. "It seems to me it makes sense for us to continue to offer those services."

Indiana's law also bans abortions after the 20th week of pregnancy unless there is a substantial threat to the woman's life or health. That's four weeks less than previously allowed. The abortion provisions are due to take effect July 1.

The new lw does not stop ny woman from getting an abortion. it stops tax dollars from paying for it. It is fact that 98% of the "services" planned parenthood provides are abortions-plain and simple. If monies are cut off from planned parenthood- they will be forced to either make the patients pay for it themselves or else close up shop. And please spare me the lame argument of rape or incest. Catch the rapist and make him pay or catch the incestuous relative and make him pay. It is not now or ever was the founding fathers intentions for government to tax citizens to pay for abortions. What all libs seem to be unaware of is that every single tax dollar was created by someone working for it- then the government confiscating it from the citizen and spending it in a manner the citizen never would have. Enough already!!!

That's a real cracker jack plan you've got there. Catch the rapist and make them pay for the abortion. That'll work perfectly since rapists always get caught so easily. It must be nice to not have to worry about paying for reproductive health. Also, I guess 98% of the times I went to Planned Parenthood for regular pelvic exams, counseling, pregnancy testing, and birth control, I was actually getting an abortion. I had no idea. Here I thought I had never gotten pregnant, thanks to the services provided to my by Planned Parenthood. Those scoundrels!

Yup-rapists do get caught.There is considerable legal precedent for rapists paying for health care costs of their victims and even paying child support. Maybe Eric Holder can start a branch of enforcement to go after rapists like he goes after those evil Arizona state politicians. As for your situation- you're looking at it thru typical lib eyes-it's all about you! Did you ever stop and think that perhaps for every time you went for a pelvic exam- 98 women went in for an abortion? pregnancy testing can be done thru the local drugstore by purchasing a test kit. If someone is pregnant- it's something between her, the father, family and god. Seems like a pretty good counseling safety net to me. And the gov't doesn't have to take my hard earned dollars from me to pay for it. Birth control is most often spelled C-O-N-D-O-M, which are cheap and readily available beyond the front door of planned parenthood. Of course- there's always abstinence......

Planned Parenthood uses 97% of there funds for healthcare services to help women with health related issues like breast cancer, NOT Abortion !!

The only women on Medicaid that would use PP are those who already have small children and are not working.This bill denies them access to contraception. If they are receiving TANF (cash) for any of those children then they will not be able to receive any additional money for the new child. And if they tried to work, the child care for that one infant would be more than $125 per week. That does not include the child care for the other children. So you are forcing a woman to remain on "Welfare" and have an infant that she does not have any money to support. Think about how much that lowers an already low standard of living. If these women are desperate enough then they will seek an abortion since they had no access to contraception. The Abortion would be a back alley, coat hanger routine that endangers the womens' lives. The Judge might not see a problem with the 6 month lapse between the Bill going into effect and the possible decision that it is not legal, but every woman who has gotten pregnant knows that 6 months is a LOOOONNGG time! So this bill to prevent non-existent funds to go to abortions is really going to increase Abortions, the back alley kind.

You're explaining this as if any Conservative would feel guilty. Don't you understand this is their desired outcome? You see, children are PUNISHMENT for having sex outside marriage. Women who do so must be forced to give birth, and care for babies. It serves them right for their immoral choices.

You can't "play God" with fetuses but let them take away life saving health programs and it's apparently "God sanctioned killing time" for the Repubs. Besides the Republicans' Gods of Wealth require a few poor,sick, unemployed and middle class Americans to be sacrificed as part of their required religious(political) ritual. And it makes them feel superior.

Finally, this issue is in the courts....on it's slow climb to SCOTUS.. What a waste of tax pyer money and time.

The Supremes will either support it or kick it back to the previous ruling.

When will the baggers realize that you simply cannot take away the civil rights of a particular group because yu don't like it...and you can't impede medical care for women and children because you don't like it...
