New York City Smoking Ban In Parks, Beaches, Plazas Starts Monday

New York's smoking ban in public parks, beaches and pedestrian plazas goes into effect this Monday and it's doubtful the city's smokers will give the ban much credence.

From The New York Post:

"This is bullshit," said Boerum Hill resident Addy Fox. "Should we outlaw cabs, buses and everything else that emits exhaust and fills our lungs with crap? There are plenty of things that do that."

Other smokers said that the city shouldn’t force them to quit, especially in public outdoor places.

"In a small park, you always have the choice to walk away from a smoker," said Downtown resident Josh Black.

The ban was passed by City Council and signed by Mayor Bloomberg back in February, in an attempt to curb the effect of second-hand smoke and to further prevent people from smoking, which the Mayor's office claims kills 7,500 New Yorkers a year.

The ban immediately drew criticism from smokers and the NYPD alike, both of whom expressed concern over enforcement and the violation of individual rights.

Audrey Silk, a former New York City police officer and smoking rights advocate, told Gothamist of the ban, "You can't enforce it. As a police officer I am telling you right now it is unenforceable from the NYPD's point. This is feel-good legislation so they can say "I've done this." They can't do anything else! They can't balance the budget. But this they can say, because it is a popular idea—by virtue of 70% of the population not smoking makes it popular."

Even Bloomberg himself admitted police won't enforce the law. From The New York Daily News:

"The police will not be enforcing this. That's not going to be their job," Bloomberg told a caller to his WOR-AM radio show. "This is going to be enforced by public pressure."

The Mayor said cops already don't enforce the law against smoking in playgrounds, and they're too busy fighting crooks and terrorists to start cracking down on park smokers, too.

"On the beaches there's some Parks Department people" to make New Yorkers comply with the new law, Bloomberg said. "But mainly it's just everybody's going to turn to you and say, 'Hey, you shouldn't be smoking.' And you know, most people listen to that."

Smoking will not be banned in the city's state parks -- so smokers can still enjoy a puff in places like Brooklyn Bridge Park and East River State Park.

Since taking office in 2002, Bloomberg, a former smoker, has overseen the ban of smoking from city bars and restaurants and raised the taxes on cigarettes so that a pack in New York City can cost as much as $14.

Look, I had to grow up with 2 smokers. I used to HATE having to wait at a restaraunt after a meal while they had a last cup of coffee and cigarette. I hated thouse and my clothes and hair stinking. I APPLAUDED when most restaraunts went smoke free. I am 100% for banning indoor smoking. But what I do disagree about is the following. Bars being smoke free. While I enjoy it, going to a bar is a personal choice and the OWNER should have a say on whether or not it is non-smoking. And this new ban on outdoors smoking is rediculous.Yes, smokers need to stop but smoking bans were meant to "protect" us non-smokers from second hand smoke. I cant imagine that is a problem at a park, especially in a city covered in smog. Not all of that smog is created by smokers. This is just typical big brother. you give them an inch, they will try to take the whole highway! If they wanted to be helpful, crack down on litterers. Especially for cigarette butts. Its disgusting...And by the way, it IS addicting but it IS also a choice. If you really want to help them quit making smoking cessation affordable. I have several friends who dont believe in its effectiveness and thus dont want to spend hundreds on help.....

Yayyy, we're a police state!!

Take away more of my freedoms Big Brother! Keep telling me what I can and cannot do in a public park that my tax dollars go to maintaining, I LOVE a nanny state!

After all, that's the job of government in the end, regulating our lifestyle and our personal decision, right?

Smoking is not a personal decision, it's an addiction. Why should non-smokers, who are the majority in this country, have to adjust our behavior to allow nicotine addicts to indulge in their addiction. If smoking were only a personal decision, a smoker could decide to not smoke in public. But the average smoker HAS to lit up 20 times a day to keep the nicotine level in their body constant, just to feel normal. When they don't smoke, they go through withdrawals and don't feel normal.
Last year I had major microvascular surgery (10 hours, a bilateral mastectomy with a DIEP flap reconstruction for a breast cancer recurrence) and was told to stay away from 2nd hand smoke because it could damage the fragile recreated blood vessels from my surgery. Feeling like a slug after surgery, I didn't have the energy to take my dog for his daily 45 minute walk, so we went to the dog park. Within a few minutes someone else walked in, sat next to me and lit up. My city doesn't ban smoking in it's parks, so I didn't have the right to ask them to not smoke. I didn't have a choice but to leave.
Why should someone's addiction over ride my use of a public facility?
Why should smokers be allowed to role model their addiction in parks where children are allowed? or be allowed to trash our environment with their butts (#1 trash item on California's Beach's)?

This will be a minority opinion, but the worst thing about cigarette smokers is in the blind suicidal rush, they throw inorganic filters on the ground.  Try only selling filter-less cigarettes in NYC.  It will make the ground nicer for organic creatures.

I find it odd that smokers haven't done anything about the ban on alcohol on beaches and in parks. They're the first to tell you that a) smoking and drinking go hand in hand, and b) both cigarettes and alcohol are both perfectly legal products.

What is really sad is that a smoker can't spend a few hours on the beach or in a park without having to build back up his or her blood nicotine levels by lighting up.

By the way, does Audrey Silk still have that female high school softball player center-part feathered hairdo?

A new NYC revenue stream. This may also result in more arrests for Disorderly Conduct/Resisting Arrest/Obstructing Governmental Administration when an officer attempts to ticket a smoker and the smoker flips on the officer. Enjoy the ever encroaching nanny state summer.

Not everyone is going to succumb to public pressure. Even in this Bloombergified/sissified New York of today, law or no law, I'm sure many requests to stop smoking will be met with a curse and being told to get lost. I'm curious how this is going to play out in real life.
