Jerome Ersland's Shooting Of Would-Be Robber Sparks Debate (VIDEO)

The case of a white Oklahoma merchant recently convicted of killing a black teenager attempting to rob his store has sparked a national debate.

To critics, 59-year-old pharmacist Jerome Ersland is a gun-toting vigilante who dealt out his own brand of murderous justice. To admirers, Ersland is a courageous and law-abiding hero whose actions were justified. The controversial case became even more volatile Thursday when a jury found Ersland guilty of first-degree murder for the 2009 slaying of 16-year-old Antwun Parker.

Since last week's verdict, supporters of Ersland have collected nearly 10,000 signatures on a petition calling for his release. Oklahoma State Sen. Ralph Shortey (R) also pledged his assistance.

"I'm gonna spend the rest of my career, however long it may be, trying to right this wrong," Shortey told ABC News.

The division is also evident online, within several social media websites. One group in support of Ersland recently popped up on Facebook. Titled "Jerome Ersland should not have been found guilty," the group has more than 3,000 members. Groups against Ersland's release, such as the Facebook group "Do Not Free Jerome Ersland," are also starting to gain momentum, The Daily Mail reported.

The controversy in the case stems from a May 19, 2009, incident in which Parker and another young man who was armed with a handgun burst into Reliable Discount Pharmacy in Oklahoma City. The men allegedly ordered two female employees working behind the counter to give them money and drugs. Instead, the two women ran to the back of the store.

The man with Parker then allegedly pointed his gun at Ersland. The pharmacist drew his own weapon, a small semiautomatic handgun he had in his pocket, and fired at Parker, who was unarmed, striking the youth in the head. Surveillance video from inside the store captured Parker's fall to the ground as Ersland chased his accomplice from the store.

When Ersland stepped back inside the store, he retrieved a Kel-Tec .380 from a nearby drawer and shot Parker five more times. The shooting occurred off camera, so Parker's posture at the time remains unclear.

On the night of the shooting, Ersland told detectives both Parker and the other teen were armed and said that both of them had fired at him.

"I feel that [people have] a right to defend themselves at their home or at their work. People deserve to be safe and not be afraid of people [who] want to take money when they don't work for it," Ersland said in a May 22, 2009, interview with The Oklahoman.

"That's what the Second Amendment and the state's concealed carry license are for," he continued.

During Ersland's trial, his lawyer, Irven Box, claimed the shooting was self-defense. He said Parker was still moving and was still a threat.

"He eliminated the armed robber," Box said in court.

Prosecutors, however, argued that Ersland acted beyond the limits of self-defense. A detective also testified that Parker was not armed during the robbery and said that Ersland's statement that he had been fired on by the teens was not supported by the evidence in the case.

"This defendant was absolutely not defending himself or anyone else," Assistant District Attorney Jennifer Chance told the jury.

The jury deliberated for more than four hours before it found Ersland guilty and recommended a sentence of life in prison for the former Air Force lieutenant colonel.

Ersland is scheduled for formal sentencing on July 11. If the judge follows the jury's recommendation, he will not be eligible for parole until he serves at least 38 years behind bars.

Fifteen-year-old Jevontai Ingram pleaded guilty January 10, 2010, to first-degree murder in the case where a pharmacist fatally shot a robber. Fifteen year old Jevontai is a criminal and should be tried as a adult and sentence forever! Mr. Ersland is a hero and America has another black eye for destroying a hero life for the action of a lowlife criminal;! Jevontai parents should also be put in prison….These are surly piss poor parent! To think a law abiding working innocent citizen…life is disrupted because of thug criminal activity! COPS have gotten away with murdering unarmed children!!!! Shame on all American that don’t feel the way I do!

The reason I am so into this case is because I am scared if I shot someone trying to defend myself or a loved one I could end up in jail... it is scary esp. since make my day law I thought addressed this issue, I mean what if I shot the person to many times too or grabbed another gun at my home and shot again...SCARY! What if they were dead but I didn't know. You don't know what a day will bring for sure, onw minute you are minding your own business and next thing you are a criminal in jail for life, for something you didn't even start....

I just can't believe that people are supporting this guy. He committed murder plain and simple. Save the adrenalin factor bull, the he was protecting himself, etc because all of that went away after he shot the guy in the head with the 1st shot which rendered him incapacitated. How can anyone defend the fact that he walked right by the body on the floor got, another gun, came back and shot the guy 5, not 1 or 2 more times, but 5 more times!! If that wasn't intent and premeditation then those words need to be thrown out of the dictionary. Ersland went from a person protecting himself and his co-workers to becoming a stone cold murderer! There was no need for him to do what he did after the 1st shot and I hope the courts uphold his conviction regardless of how much pressure supporters place on them.

You can't be serious! Mr. Ersland was innocent he was at work! The criminals came into his work place to murder and rob.....They set the tone not Mr. Ersland. Had they came there to pruchase....Different story! But these thugs came there to do wrong! Did Mr. Ersland go too far?......I said hell no! I say if it was not for the actions of the thugs....They would be alive and Mr.Ersland ( my hero) would still be a law abiding citizen. But my judicial system said ...Lets make Mr. Ersland a criminal too! BS!!!!!!! I wonder where were you when Mr. Diallo was shot 41 times in NY....The cops where found not guilty for shooting a unarmed man 41 times.....Many into the dead body of the totally innocent unarmed man....They got away with the murder....But Mr. Ersland go to prison?????

The adrenalin factor is huge when armed thugs threaten with a gun (one is enough when one poses a gang threat). One such as the Oklahoma City pharmacist does not perceive the mission of an armed threat, only its life-threatening intensity and he responded on an instantaneous 'gut' level (temporary insanity). The people of Iraq without weapons of mass destruction, the people of Libya with Africa's only universal health care and education programs as well as both nations with a community council system of representation, feel the same threat from the USA, Canada and NATO's oil robberies, targeted assassination of leaders and regime change policies. Both Iraq and Libya broke the ultimate rule of imperial nation financial law as both had recently declared their intention and were in the process of transferring all oil sales from US currency to the Euro and African Dinar respectively. Whether it is the robbery of a pharmacy or a whole nation, we (all of us) need to understand we are carrying armed violence to a place where the whole community and the whole of humanity are being harmed. We are all guilty and we all owe reparations in this continuing social madness of 'exogenous' (Latin = 'other generated') theft which are staggering.

I find it ironic that so many people are upset over the verdict and sentence of this case. Even a police officer knows that when someone is down, you do not continue to fire at them, unless they are still a threat. No where on this video does it appear that Parker is still a threat. I'm sure that Ersland had to get training when he applied for his permit to carry. No where in that training do they teach you to go get another gun, and fire 5 more rounds at someone who is clearly shot and not moving. I wish everyone would read about Cory Maye who was sentenced to death for shooting a police officer. Police came and conducted an ill advised raid on his house(the wrong house) in the middle of the night. Cory Maye shot through the door at men he thought were breaking in to harm him and his daughter. I wonder if he would have gotten the same support from the many who are supporting and signing petitions for Ersland?

We are so messed up here in our country that we now find that the perp is the victim and the victim is the perp and prosecute him. If these monsters had not entered the store with weapons drawn they might very well be ok today,,,,,what a mess we are making for ourselves.

Something has to be done for this man. He did nothing wrong. His actions seem weird to people who never experienced combat.

I once saw a a former active duty Marine on his second Iraq tour serving as a TC on a PLS get out and walk around in circles while we were getting mortared. He had performed very well up to that point and didnt believe us when we told him what he did.

This guy was out of his mind and in survival mode. It isnt criminal to be human.

All Americans of every color need to help this guy. He needs a pardon or a retrial with a jury that has been under fire.

apparently, Jerome Erstland never eperienced combat either.

"A pharmacist charged with murder told police he had killed before, while overseas in the first Gulf War. But according to his military records, he was never there ...

Instead, Jerome Jay Ersland spent the war in 1991 as the pharmacy chief at the military hospital at Altus Air Force Base in southwestern Oklahoma, records show.

The government last week released to The Oklahoman eight pages about Ersland’s military service, first in the Army and then in the Air Force. Reporters also reviewed other records about Ersland’s military service.

Prosecutors doubted Ersland’s accounts about his Gulf War service, and they subpoenaed his military papers from the government to check his statements. Prosecutors received a thick envelope of Ersland’s military papers Thursday.

"They verify exactly what we assumed about ... his comments about his military record,” Oklahoma County District Attorney David Prater said.

The video footage was released on youtube and yes they did run in and just start shooting. This man is sitting in prison because the prosecutor lied!

This guy did what he had to do to survive.Self defense should never be a crime. They need a castle doctrine to combat dishonest prosecutors. He wanted to score points with the local population by imprisoning someone for wanting to live through a violent crime being commited against him. DISGUSTING!

His heart was beating at 4 billion beats per second, his mind was trying to catch up with what happened around him, he relied on instinct and past training. That jury was educated by video games and movies, he should have had a few of his own peers who knew better.

The initial claims by the prosecutor were that he could have stood there real calm while the bullets whizzed by and aimed for a leg. Now he says they never fired at all? What a dishonest jerk! No gun found at the crime scene? Oh how rare, a cop sees a throwaway and picks it up.

The jury had the chance to see the same video as you and I did so even if the prosecutor lied, which I doubt he'd be so stupid as to lie about something that is right on the video, the jurors made up there minds that Ersland was in the wrong. Regardless of any of that, the 5 additional shots were totally indefensible and that's what did him in and should keep him in prison if not for life, but for a lot of years.

He was involved in a firefight, if he gets killed while failing to observe proper combat tactics its on him. There is no such thing as a time out to fix your tactical gear when the bullets start flying.

He died in combat, nobody murdered him, nobody should be in prison.

Recently, (OK) State State Senator Ralph Shortey went on record as saying he would have shot Antwun "Speedy" Parker more times than Ersland did, he also said he considered Ersland a hero, and wished he could kiss him. He further stated under the new Jerome Ersland Act it wouldn't matter if the store owner shot the would-be robber 2 times or 50 times as long as they perceived the robber to still be a threat the shooting would be justified. After watching the video, I feel as though this is possibly a man who always wanted to kill someone.

The first head shot, fine. I'll even overlook the fact that the kid he killed was unarmed.

But once the (unarmed) threat was neutralized, any further acts of violence displays a thirst for blood.

Huh? He was in survival mode. Your brain does very strange things when under this much stress. Life isnt a video game. You arent thinking in these cases, your mind does things you will never understand. He was in a real firefight, something you never experienced. You are like his jurors, they all play online shooter games between war movies and they are all real good at it so they judge him based on their video game experience.

The prosecutor in this case had originally admitted he was under fire. The video gamer claim made by him was that the defendant could have stood there calm and carefully aimed for a leg shot while under fire! He later claimed that the defendant was the only one who was armed and that the criminal was a victim of racism. The tape proved otherwise but the jury was just as video game experienced as the prosecutor.

There is a beast in all of us. You civilians pretend it isnt there and that you are all special but you are all very wrong. You have no idea what that caged beast in you is capable of. You arent qualified to judge the accused in this case because you have never experienced someone trying to kill you for real.

This man is guilty of having human instincts, NOT A CRIME!

Thank you, thank you, thank you!! I said it a plenty of times before that he had already made up his mind long before this happened that if he were ever robbed that he was going to kill the person who robbed him. He can sit in front of cameras and all that speaking like he's so humble and Forest Gump-ish, but this guy wasn't going to settle for anything less than killing this person!

The person here who's really guilty, is the mother. I see that she's acting like a victim in all of this, but it's because of her horrible parenting skills (or total lack thereof) that her son ended up in this situation to begin with. His mother should be horrified that she failed so utterly as a parent, that her son ended up robbing a convenience store. Not only should the clerk go to jail for obviously firing 5 more shots than necessary, but the mother should also go to jail for being an epic failure to her son.
