John Edwards Indicted: Charged With Conspiracy, Campaign Finance Violations By Federal Grand Jury (VIDEO)

RALEIGH, North Carolina (AP) -- A federal grand jury indicted two-time presidential candidate John Edwards on Friday over $925,000 spent to keep his mistress and their baby in hiding during the peak of his 2008 campaign for the White House.

The case of USA v. Johnny Reid Edwards contains six counts, including conspiracy, four counts of illegal campaign contributions and one count of false statements.


The indictment said the payments were a scheme to protect Edwards' White House ambitions. "A centerpiece of Edwards' candidacy was his public image as a devoted family man," the indictment said.

"Edwards knew that public revelation of the affair and the pregnancy would destroy his candidacy by, among other things, undermining Edwards' presentation of himself as a family man and by forcing his campaign to divert personnel and resources away from other campaign activities to respond to criticism and media scrutiny regarding the affair and pregnancy," the indictment added.

The indictment and an arrest warrant were filed in Greensboro, N.C., which is in the district where his campaign was headquartered.

Negotiations between Edwards' attorneys and federal prosecutors to settle on a charge to which Edwards was willing to plead guilty continued through Thursday, but proved fruitless, according to people with knowledge of the negotiations. Prosecutors had insisted on a plea to a felony, which would endanger his ability to keep his license to practice law.


An Edwards spokeswoman said she wasn't aware of the filing and declined immediate comment.

The indictment is the culmination of a federal investigation that lasted more than two years and scoured through virtually every corner of Edwards' political career. That included his political action committees, a nonprofit and a so-called 527 independent political group. It even examined whether he did anything improper during his time in the U.S. Senate, which ended seven years ago.

But the centerpiece of the investigation has long been the hundreds of thousands of dollars privately provided by two wealthy Edwards supporters - his former campaign finance chairman Fred Baron and Rachel "Bunny" Mellon, the 100-year-old widow of banking heir Paul Mellon. That money eventually went to keep mistress Rielle Hunter and her out-of-wedlock baby in hiding in 2007 and 2008, during the apex of the Democratic nomination campaign.

The indictment refers to $725,000 in payments made by Mellon and another $200,000 made by Baron. It said the money was used to pay for Hunter's living and medical expenses and for chartered airfare, luxury hotels and rental for a house in Santa Barbara, Calif., to keep her hidden from the public.

It accused Edwards of lying when he told the media he never knew about any payments.

Former campaign staffer Andrew Young, who initially claimed paternity of Hunter's child, has said Edwards was aware of the private financial support that helped keep the mistress satisfied and secluded. Prosecutors believe the private gifts should have been considered campaign contributions since they aided his candidacy.

The case opens a new front in how the federal government oversees the flow of money around political campaigns. An attorney for Edwards said last week that the government's case was "novel and untested" and argued that the government's theory was wrong on both the facts and the law.

With one of Edwards' former campaign rivals now sitting in the White House, the case includes a measure of political intrigue. Greg Craig, who was previously White House counsel for President Barack Obama, emerged as a leading figure on Edwards' legal team just as Obama's Justice Department was reviewing the case that prosecutors in North Carolina had prepared.

Meanwhile, North Carolina's two senators had asked to let Republican-appointed U.S. attorney George Holding stay on the job until he had finished the Edwards probe.

Edwards and Hunter began their relationship in 2006, just as the 2004 Democratic vice presidential nominee was plotting a second run for the White House. She was hired to shoot behind-the-scenes video footage of the prospective candidate. Edwards' political action committee and a nonprofit affiliated with him both paid Hunter's video-production firm about $100,000 for the work.

Edwards initially denied having an affair with Hunter but eventually admitted to it in the summer of 2008. He then denied being the father of her child before finally confessing last year. His wife, Elizabeth, died of cancer in December.

Young has said that Edwards agreed in 2007 to solicit money directly from Mellon. And the long-time Edwards aide, now estranged from his former boss, has said he received hundreds of thousands of dollars in checks from Mellon - some hidden in boxes of chocolate.

Mellon and Edwards are still friendly despite the glare of the federal investigation. They had lunch together at her Virginia estate last week even as the indictment appeared imminent.

Baron's support was even more direct. The wealthy trial lawyer said in 2008 that he helped Young and Hunter move across the country to protect them from media scrutiny. Baron, who died a few months later, said Edwards wasn't aware of the aid, but Young has said that Edwards did know.

Young, Hunter and Baron's wife were among many Edwards aides and supporters who were called to testify before a federal grand jury or have been interviewed by investigators.

I knew Edwards was a RAT the very first time I saw him, (what can I say, he simply looks dishonest to me), and my estimation of him went down from there the more I learned about him. And THEN ... along came idiot lurch Kerry picking him for VP!

One of the biggest issues I see with the Edwards situation or (insert right wing politician here) is conservative righteousness and liberal elitism.

It seems when someone on the right wing, especially a far right christian does something wrong, its simply forgivable because they are such a good person that simply messed up. Its not that it isn't forgivable, its that politicians are not to be above the law. The other issue is that there is ALWAYS some sort of justification for the offensive activity and then to top it off, right wingers will claim how liberal democrats doing things that are 10 times worse!

Now, to dicuss liberal elitism. In these cases, the democrat is unfairly being put on trail and only for the reason that "so and so is liberal". The arguement is had it been a republican, no charges would be filed. Again, liberal elistism has a problem with taking blame and accepting personal responsibility so often the response is that "they are not guilty" or "their crime has nothing to do with their duties" or "so and so republican is a bigger crook yet they want to take down the liberal that supposedly a rights champion and cares about the middle/working class".

The DOUBLE STANDARD is one sided. When I used to post on fox forums, I seen very similiar comments: slight wording changes and put Ds in places of the Rs. Conservative righeousness and Liberal Elistism are just subgenres of the same affliction!

Anyone can run for President and with money and a bit of good luck
The thoughtful questions of the voters he might evade and duck
But somehow, someway through the ages through the seekers' parade
We have somehow by hook or by crook seen through the charades
Some of our Presidents have not been the best
And some in office we tried and failed to arrest
But by and large the Oval Office seems to shape and mold
The weak become strong, the cautious daring and bold
But here thank God we never had the chance
Our candidate fled to a fantasy romance
Never made the ticket, never deceived our vote
Never got near to the Presidential plane or boat
A moral felon with a wife in a early grave
Now a charge criminal felon with little legacy left to save
The little brains always think it will never happen to me
Just like don't tax me but the person there behind the tree.
Prison time may not ever so deter
Politicians are never completely honest or pure
But John Edwards betrayed the public trust
Send him away until locks and bars begin to rust.

This is hard to believe. Melanie Sloan commented 'The prosecution is ludicrous in believing that this case could prosecute John Edwards and win.' The evidence is overwhelming, but having been washed over and spilled the evidence is still there. The gall to run for President of the United States, while breaking numerous immoral laws and lying about every fabric of his life, John Edwards deserves to receive the full prosecution of the law. John Edwards intended to pass laws that society must abide by, while he deceptively breaks nearly every law in the campaign law book. Letting John Edwards off the hook will send a message that allows other candidates to break ethics laws, moral laws, and finance laws. The prosecution has a choice, which is determined by how this case is to be prosecuted. The prosecution should not just drop the case on the grounds of an unlikely outcome. Try harder.

I don't know if he is guilty or not and I don't care.

There is a long list of people in banks and government that should be prosecuted and he is not in the first 200.

This is ridiculous....I live in his neck of the woods...He is no worse than any other politician, or attorney! They are diverting attention away from the REAL political criminals who should be charged with war crimes! So be it!!!

Hasn't his family suffered enough? His wife is dead, his reputation tattered...this prosecution seems cruel. The truth about his character emerged and the people made a better choice for leadership. Why can't he be left to redeem himself with his children, especially for the sake of the innocent little girl who did nothing wrong? The whole Edwards story is a sad saga....we are too invasive in the lives of public figures. WOULD jEFFERSON OR rOOSEVELT BE ELECTABLE TODAY?

As a former Edwards supporter let me state clearly and unequivocally..... NO! That is not the issue here. If he took campaign funds - specifically donated for the purpose of running a campaign for President - and used those funds "illegally" to cover up his sordid personal life and affair - he deserves to be prosecuted and, if found guilty, spend time in prison. If it is proved he did this, he committed fraud and should suffer the consequences of his actions. If you disagree with that concept, then you should also seek to get Bernie Maddoff out of jail - for fraud is fraud and right is right.

And, just as I support his prosecution, I supported the prosecution of Nixon for his illegal use of campaign funds and would support the prosecution of Bush (the lessor), Cheney, Rumsfeld, Rice (et al) for their illegal acts and subversion of our Constitution and international treaties.

In this country, no person should stand above the law. And when we allow law breakers to flaunt their activities based upon who they are or their positions within society - we diminish the laws, ourselves and our country.
