NRC Head Withheld Information Related To Radioactive Dump: Report

(AP) WASHINGTON — While he apparently broke no laws, the head of the Nuclear Regulatory Commission withheld and manipulated information to make the case for shutting down the proposed radioactive waste dump at Yucca Mountain in Nevada, according to an internal investigation.

The inquiry requested by Republicans on the House Energy and Commerce Committee says that NRC Chairman Gregory Jaczko was "not forthcoming" to other commissioners when he decided to shut down in October the technical review of the Energy Department's application for the underground nuclear dump.

Jaczko called the shutdown of Yucca a complicated issue and said the report's findings "reaffirm that my actions have been and remain consistent with established law, guidance and my authorities as chairman."

All NRC chairmen must make "difficult and sometimes controversial decisions," he said.

Republicans and many Democrats outside Nevada favor creation of single storage site for nuclear waste, but the Yucca Mountain project is fiercely opposed by Nevada lawmakers, including Senate Majority Leader Harry Reid, who has vowed to do everything in his power to kill it. President Barack Obama opposed the Yucca Mountain site in the 2008 campaign and has moved consistently to kill it since taking office in 2009.

Jaczko, who has chaired the NRC since May 2009, worked as a science adviser to Reid before joining the NRC in 2005.

The license for the Yucca Mountain, which has been in development for nearly 30 years and cost more than $15 billion so far, has been in limbo since last June, when a licensing board independent of Jaczko and the rest of the commission rejected the Obama administration's request to withdraw the project application. Jaczko has yet to schedule a final vote from the five-member commission on the matter.

In the meantime, the report says, Jaczko first told his staff to proceed with the review but in October changed course and instructed them to halt work on the project.

The 46-page report by NRC Inspector General Hubert Bell also delves into Jaczko's management style, saying he often lost his temper and badgered staff members who disagreed with his positions. A number of those interviewed said Jaczko would threaten to withhold foreign travel or to contact the Obama administration as means of gaining support on issues.

Jaczko knew his decision to shut down the technical review of Yucca Mountain, which would be used by the board to evaluate the license, "would be controversial and viewed as a policy decision for full commission consideration," the report says. "Therefore ... he strategically provided three of the four commissioners with varying amounts of information about his intention."

Lawmakers from both parties have criticized Jaczko for what they say is an overly secretive style and accuse him of acting unilaterally on the commission's behalf. They cite several examples, including Jaczko' s declaration in March that Japan's nuclear crisis constituted an emergency in the United States.

Their sharpest criticism is reserved for his handling of the divisive plan to shut down Yucca Mountain, about 100 miles northwest of Las Vegas.

The NRC is considering a request by the Energy Department to shut down the proposed waste site and has begun initial steps to implement the shutdown. Even so, Jaczko has said the five-member commission has not cast a final vote on the issue and has no timeframe to make a decision.

Three NRC commissioners told Congress last month that they have cast what they consider substantive votes on the matter.

That apparent contradiction mystified and enraged members of Congress, who said they cannot get a straight answer from the NRC on Yucca.

"The level of non-information is frustrating," said Rep. Lee Terry, R-Neb. "I'm very disturbed."

Rep. Joe Barton, R-Texas, accused Jaczko of "playing some kind of foot-dragging game" and intentionally delaying a decision on Yucca Mountain.

Before becoming NRC chairman, Jaczko was a member of Reid's staff. But he denied that the Nevada Democrat or anyone else influenced his decisions on Yucca Mountain.

"It was in no way a political action or intended to reference any other political figure or direction from any other political figure," he told the House Energy and Commerce Committee at a hearing last month.

In an unusual move, Jaczko sought to get ahead of the inspector general's report, which has not been released to the public, with a statement late Wednesday. He said the investigation reaffirmed that his actions have been consistent with the law and his authority as chairman.

But he acknowledged to the IG that he at times lost his temper and used "forceful" management techniques.

In an interview Thursday with the AP, Jaczko defended his tenure his as chairman and his sometimes hard-charging style, which he said comes from a deep-seated belief in the agency' mission to ensure safety of the nation's 104 commercial nuclear reactors.

"I believe passionately and strongly about nuclear safety, and I take that responsibility very seriously," he said.

Nuclear power is a no longer a rational choice for producing electricity. One reason of many:  there is NO safe way to store spent nuclear fuel. That, by the way, is why all of us would do everything possible to prevent a Yucca-type storage facility from being built anywhere near where we live. The US govt and NRC started a propaganda campaign in March to try to fool the American public into thinking that the ocean will DILUTE the radiation to an acceptable, safe level.

They even fooled Robin Robert's into starting the propaganda campaign on her morning show.

After that, the propaganda was planted in print and interview media.

I think the HP may have fooled you too with the headline, and perhaps you are suffering TL;DR before posting. Or maybe you're a keyword driven bot poster who's made it through the filter!

In any case, "Dump" is referring specifically to Yucca mountain, though the headline appears (to me at least) to try to represent it as some kind of previously unknown "dumping" event, or perhaps to raise thoughts of Fukushima as you mentioned with your comment. Maybe the headline writers don't like using the word "repository" anymore because it sounds too benign for their purposes, or perhaps because it makes people think "suppository," and I can see where that might compromise the gravity of the message they're trying to portray.

Actually, I'm pretty sure it's just because "Radioactive Dump" gets more clicks than "Yucca Mountain" these days. It is interesting that the headline, with the unwritten but unsubtle subtext that radiation/nuclear and everything and everyone associated with it is a dangerous, puppy kicking, liar liar with their pants on fire (though the fire is played down by the media, of course), while the tone of the article is actually fairly neutral (though it does have a subtler undertone of anti-nuclear sentiments, implying that you can't trust the agency because of the discontent running amok through the ranks).

Right! But you have to be careful with metaphors because they can be misleading, often intentionally, by those with an agenda. Though I do think the desk one is accurate, you probably wouldn't want to approach that desk unless the material was safely contained in the dry cask storage.

Crazy leaps of logic can be easily glossed over with a clever metaphor or anecdote by those with an internet education on the matter, so I tend to cast a critical eye on most of them. Some metaphors about nuclear waste are pretty ridiculous, and while there's no question comparisons can be made with total or potential energies that are mathematically sound, some start mixing up explosive energy and thermal energy and generally neglect to consider the time over which the energy is released.

One of the most quoted comparisons is a chunk of congressional testimony from the 70s or thereabouts where a professor (of chemistry or physics or something), through a series of conversions, compares the (heat) energy in atom bombs, TNT, and nuclear waste in terms of kilo calories. It would be just as informative and equally meaningless if I chose to compare kilo-calories in nuclear waste with that in a pile of avocados, bananas, or cords of wood. The same is sometimes done with radiation levels, while often failing to mention that you must somehow come in contact with the source before it's going to do you any harm (which is the tricky part with dry storage).

While shutting down plants in Germany has been the politically correct view per the Green Party, here in the USA the Greens only amount to a fringe political group. Thus as long as Greens are not taken seriously or credible here in the USA, the chance for a Germany-type phaseout is not likely. Furthermore, the USA is too far into the other aspects of nuclear (weapons and post-Cold War security of fissile material).

While the rest of the world might look at Fukushima as a rallying cry against all things nuclear, the practical realities of Cold War surplus material in strategic countries makes phasing out nuclear power impractical.

Several on this forum have suggested the alternate approach - find that nuclear technology that is favorable to commercial enterprises, and that which is not, and remove the latter.

It will be 20-30 years before renewables can provide the baseload. Germany has a tough road ahead and will have to rely on more coal - dirty at that.

So on climate change issues, and new nuclear designs, yes I am still in favor of nuclear technology.

Entertaining a total phaseout even in the light of Fukushima is not responsible. The National Academy of Science will publish their findings of any link to cancer and nuclear power. That should silence all but the most extreme and ardent antinuclear voices.

Very well written. Unfortunately, this is a site that is more about passion than facts. Just look at the pictures that accompany every nuclear reactor article... It's always of stack towers with steam coming out... trying to give the illusion of radiation being released in the air.

No, my friend, you are talking to people who never heard of or would ever believe in the threshold theory of radiation damage.

qui est ce "we," rabbit? If you mean commercial nuclear, they are going to have to get busy since fossil fuels have quite a leg up on them already in the area of killing large numbers of people.
But as this article is about nuclear waste, the only permanent solution seems to be more nuclear, as that is the only process by which high-level waste can be converted to low-level waste that doesn't involve magic.

The NRC is a sick joke, falsely offering the promise of “regulation” to millions, when their only mission is making “regulation” & continued profits safe for the nuclear industry at unacceptable costs/risks to the public; the NRC when faced with any new statistic or facts showing vulnerability or danger of nuclear plants, will change the threshold of regulation in favor of the industry; their de facto employers. Here in the Hudson Valley the aged/leaking Indian Point plant is up for license renewal for a further 20 years, only the NRC doesn’t require inclusion of numerous critical issues in their re-license “decision-making” process; a rubber-stamp for the industry; they have never denied a re-licensing for any nuclear plant & use pro-industry statistics in this hypocritical “decision-making” sham; profits over people. From the ridiculous & absurd 10 mile “evacuation” plan, even though the NRC & US gov recommended 50 mile evac zone for Fukushima, several active seismic faults, hundreds of safety “exemptions”, including fire, the highest NY thyroid cancer rates in neighboring counties, leaks into ground water & Hudson River, millions of fish killed, extremely dangerous & deadly “spent”-fuel pools, to the arguable destruction of our entire American economy if an “accident” or natural event should occur & cause a release of radiation they can’t hide affecting NYC; all are deemed irrelevant by the contemptible Lap-Dog NRC; they are a disgrace & should be prosecuted for their industry collusion, blatant deceptions & lies. Also as 97 percent of nuclear fuel is recyclable It wouldn't stay buried for long anyway.

The elimination of a Japanese style (Trillion Dollar) Disaster from happening in Germany is smart, we sure do not need on here!

By the way our reactor in Missouri was almost flooded out just last week and we are very lucky that some terrorist did not take advantage of that situation to attack the dykes which would have been a soft target!

Any day Nature or man can make Nuclear a disaster,

Tepco is releasing video of various locations inside the plant, and is changing the location descriptio­ns. For example, in the first released video inside Unit 4, we can clearly see a ruptured fuel pool. One entire side of the fuel pool is blown out right down to the top of the fuel racks, and the tops of the fuel racks are dry. The tops of the fuel racks are covered with tons of debris, and the refueling bridge is laying on top of the fuel racks:

This video was released a few weeks later and shows a fuel pool covered with several feet of clear water and minimal debris. It is identified as the Unit 4 spent fuel pool, but clearly, it is not. This video is another fuel pool on the site that has been labeled as Unit 4 by Tepco.
