State-Level Assaults On Abortion Rights (PHOTOS)

Abortion

WASHINGTON -- Republicans took charge of 25 state legislatures and 29 governors' offices in the 2010 elections, promising to focus on the sputtering economy and unemployment crisis. In the first legislative session of 2011, however, GOP lawmakers introduced an unprecedented number of bills restricting abortion rights for women.

As The Huffington Post has previously reported, more than 900 bills concerning reproductive health were brought forward before the end of March. By contrast, according to NARAL Pro-Choice America, only 175 anti-choice bills were moving through the states at the same time a year ago.

"We're getting hammered on so many fronts," said Elizabeth Nash, a policy expert for the Guttmacher Institute, a reproductive health research organization. "Every day is another nail in the coffin for Roe [v. Wade]."

Republicans have tried to tie the abortion and family planning discussion to money matters, arguing that taxpayers should not be forced to fund abortions. But the Hyde Amendment, which was adopted nearly four decades ago, already blocks all federal funding from being used for abortions, except in the case of incest or rape.

A number of major legislative trends have emerged so far in 2011, including gestational limits on abortions, bans on insurance coverage for abortions, mandatory ultrasound bills, and attempts to defund Planned Parenthood, America's largest family planning services provider.

These bills are moving rapidly in the states, and they severely limit women's access to and ability to pay for abortions. So far this year, three states—North Carolina, Indiana and Kansas—have defunded Planned Parenthood. Thirteen states have blocked abortion coverage in their public health care exchanges to be set up as a part of the Affordable Care Act. Iowa advanced the nation's first 18-week abortion ban in early June, and five other states have passed or are considering laws banning abortions after 20 weeks.

While a number of legislatures have been quietly chipping away at Roe v. Wade—the 1973 Supreme Court decision that forces states to keep abortion legal in the first trimester of pregnancy—some are taking a more direct hit at the legal precedent. State lawmakers introduced 22 so-called "personhood" bills this year that would legally define one's status as a “person” or “human being” as beginning from the moment of conception, which could outlaw abortions altogether.

“The pro-life movement has gone beyond just hopin’ that we can save a few babies, hopin’ that maybe if we pass a regulation or restriction that we can save a few babies,” Cal Zastrow, cofounder of Personhood USA, told HuffPost in an interview. “One of our primary goals is not to overturn Roe v. Wade—it's to get states to ignore Roe v. Wade and do what’s right, which is to protect children.”

Mississippi will allow voters to decide on the next general election ballot whether to add an amendment to their state’s constitution defining a “person” at the moment of conception, and Louisiana and Alabama have advanced similar legislation that would outlaw all abortions. The American Civil Liberties Union and Planned Parenthood are preparing to challenge these laws in court.

“We say bring it on--we’re the ones picking the fight,” said Zastrow. “We’re prepared for the court fights, including the U.S. Supreme Court."

The intense focus on restricting abortion access and cutting funds to family planning so far in 2011 is causing progressive lawmakers and even some conservatives to question how state legislatures have strayed so far from their campaign promises to focus on job creation.

"I came up here to help put food on the table," said state Sen. Evelyn Lynn, a Florida Republican, during Floor debates on a mandatory ultrasound bill in May. "I came up here to get people jobs. I came up here to protect people from the kinds of safety issues that fire and police take care of. I came up here to protect education."

"I will vote 'no' on every abortion bill," she added. "It is the wrong thing for us to be discussing."

The Huffington Post has put together a slideshow highlighting the 10 types of legislation states are using to restrict access to abortion and family planning:

Mandatory Ultrasounds
1 of 10
Texas and Arizona have both recently enacted mandatory ultrasound bills, which require women seeking abortions to undergo a sonogram at least 24 hours before the procedure unless she lives more than 100 miles from an abortion provider. Doctors must also describe the fetus in detail to the woman, including the size of its limbs and organs, and play sounds of the fetal heartbeat.

Twenty-eight mandatory ultrasound bills have been introduced in 14 states so far this year: Ala., Ark., Ariz., Conn., Fla., Ind., Ky., Mich., Mont., N.C., Ohio, R.I., Texas and Va. The Center for Reproductive Rights is challenging the Texas bill in court.

"We filed a challenge today because this bill is incredibly intrusive; it hijacks the doctor-patient relationship," said BeBe Anderson, senior counsel for CRR. "You expect your doctor to act in your best interest, but this bill turns the ethics around as physicians are forced to feed images, sounds and information that the state has decided a woman needs to know."

That's not all they are doing. They are also using laws originally designed to protect pregnant women from abusive men to prosecute the women themselves. Very creative prosecution. Check this out:

If life begins at conception, does this mean the government will analyze every woman's menstrual blood to ensure that no spontaneous abortions have occurred? Because, if life begins at conception, any zygote that doesn't attach to the uterus would be proof of involuntary manslaughter. How many women would go to prison because of a group of cells that was the by-product of sexual intercourse wasn't a viable form of life?

Woman gets pregnant. She told her BF she was on birth control but was not. Her plan is to trap him into marrying her. He does not want the baby. She insists on having it, and she insists he will be legally responsible for support. Totally unfair.

Perhaps he should have used a condom and taken control of his own reproduction. He could also have undergone a vasectomy.

What he can't do, is be pregnant. That's why he doesn't get to force a women to either have an abortion or have a baby.

Unfair is when he is not smart enough to "wrap his rascal". You must protect yourself. Trust me when I tell you that if he had, this would not happen.

if a fetus is killed during another crime, the suspect can be charged with murder. what is different with abortion. it is at least euthinasia. what mekes a fetus a different being id different cases. simply the mothers wish to not have a child. maybe we should advance to the point that if your children already born displease you, you can also kill them.
08:34 AM on 06/20/2011
If you're raped violently will you want to give birth to that child? What if the pregnancy threatens your life? What if you aren't mentally or financially capable to raise a child? The most important thing to consider is that child's quality of life if it is born. Could you guarantee that under those circumstances?

The world is not black and white. Circumstances can occur outside your limited imagination.
08:45 AM on 06/20/2011
True- people that cant afford kids or use it as birth control are the ones who bother me- That is a joke
07:11 PM on 06/24/2011
Nuetronstar21->Lets be real, it has been proven that over 90% of abortions are for causal reasons reported by the clinics themselves, now lets get to the remaining small percentage, it is not the babies fault on how it was conceived, if your friend had a baby conceived from rape would you hate the friend or the baby, the baby is innocent, Now for the cannot afford or cannot handle it, if a woman is so selfish she cannot place the baby first plenty of people to adopt.

Killing a fetus in another crime = somebody else imposing their will upon a woman
First trimester abortion = woman controlling her own body

See the difference?

I'll never have an abortion. Why should I care if it's legal or not?
08:28 AM on 06/20/2011
lol what if you have a complication that means the either you or the baby dies? Abortion or not?

Try thinking beyond your own goldfish bowl.

Yes, Neutornstart21. And what if there is a complication that mean the mom or the baby and mom has other children at home. What decision then? Leave the children that are alive without a mom because abortion would be wrong????

So if this mandatory sonogram thing passes, and a woman says she will not participate what then? Are they going to strap her down , arrest her, make her wear a scarlet letter....
10:25 AM on 06/20/2011
No, they are going to rape her with an instrument so she can undergo a legal medical procedure.

Most of these "pro-life" groups are very vocal about outlawing abortion, but you don't hear a peep from them on how to prevent abortion / unwanted pregnancies in the first place. The only way to significantly reduce abortions is to provide easy access to contraceptives, the morning-after pill, and through thoughtful education of those starting to get sexually active.

No, I'm not. But what I hear in the media is that the most vocal anti-abortion groups are only preaching abstinence as a solution, and that they are adamantly opposed to organizations such a Planned Parenthood, who are active in providing education and contraception.

Another thing, can all "pro-life" groups out there please confirm their unequivocal opposition to the death penalty. You can't call yourself pro-life if you are really pro-death.

One last thing: to all "pro-lifers", have you had the conversation with your children that in case they become parents at a much too young age, that you yourself will adopt their child to raise as your own, to prevent an abortion? My son (13) knows that this is how an unwanted pregnancy that he conceived may end.

So all these groups that oppose contraception, will you say it's wrong for them to call themselves "pro-life?" If the laws were written to satisfy them, abortion would be unsafe, illegal, and frequent.

ArjenBoatsma-> The real answer is for parents raise there children with morals, parent should teach sex is between Husband and wife only, the answers get our country back to being moral, if someone chooses to be immoral they should have to face consequences.

Well I know someone who was raised as you suggest, God, church, morals, sex education, wait until marriage. Yep, the young girl got pregnant she could not abort it was a sin and murder in their church's eyes, she married the boy, against her will, had more kids, they were taught by the Catholic church the rhythm method is the only birth control they were allowed to use, hence, 3 more kids and no they are divorced. Yeah, your child is always going to live by your rules and what you teach. Get real!!

I hope to get a job as an arm-band wearing government worker to go around and check on every pregnant women in the USA.

By my estimate, we will need a small army of door knockers, supported by a large army of bureaucrats. Not to mention the NEW court system we will need to put into place to handle the sudden influx of new felons, and prisons, don't forget about prisons. There is lots of money to be made here people, lets get busy...........I hope we call it the "Dept. of Womb Security"

Love all the GOPER GOVS telling everyone how bad the government is and how the GOV shouldn't be involved in our lives, except if your a female, then they will crawl inside your insides and plant a flag their. The GOP love to say "Life is Precious", yet they just passed a bill to gut 800 million from the program to feed poor pregnant women and children, now there's an oxymoron if I ever saw one. So it's precious if they say so, and if your poor and pregnant, not so much!
