Children's Families Fined $500 For Operating Illegal Lemonade Stand

Even for kids selling lemonade near the US Open golf tournament in Maryland, it's hard to make a buck these days.

Many residents living nearby the Congressional Country Club in Bethesda, Maryland have found a number of ways to earn a little extra income from the annually descending throng of fans. But this year, two families, the Marriotts and Augustines, have been fined $500 by the local county because their children were "operating a lemonade stand without a permit," according to a Thursday report by local news network 9News Now.

When asked to justify the fine, a county official noted the size of the operation. "Kids selling lemonade making five, ten dollars is a little different than making hundreds," he said. Meanwhile, those who paid the county nearly $300 were selling individual parking spots on their lawns for up to $60.

To the parents of the children, it doesn't seem fair. "The message to kids is: there's no American dream," Carrie Marriott, mother of some of the children, told 9News Now.

Update: Montgomery county has subsequently waived the $500 fine and allowed the lemonade stand to reopen in a location outside the "main strip."

OK, none of the kids with the lemonade stands would be able to go to the county offices and get a license for selling ANYTHING. Why would the county issue them a permit? They're KIDS.

This is stupid and silly. What license are you protecting that has to do with USGA and US Open trademarks? The kids weren't usurping USGA/US Open trademarks on lemonade/sales. They were selling refreshments to people walking (sometimes 2 miles) to the entrance of Congressional Country Club. No tee-shirt/hat/memorabilia trademarks are infringed with lemonade sales.

similar situation took place at a weekly arts in the neighborhood event in Portland last year, but I gotta say: the mother in this case trucked her child and the lemonade stand 25 miles to set up what you'ld expect was a neighbor kids domain!
I had to side with the county against the mom and her enterprising mobile business!
kid next door? O K! Bussed in ? Not so much!

Someone may have said this, but judging by the few comments I read people are under the impression that these were some random kids sitting in front of their house in some tucked away neighborhood selling home-made lemonade. These kids were reselling bottled lemonade, waters, Cokes for 3 dollars near a sporting event. If they were in front of Camden yards or something it would have been completely shut down, no questions asked. You only need look to their last names(augustine and marriot) and the area to know why it went any further than a single warning. Just my opinion for what its worth

In defense of the county, if they allowed the kids to sell their lemonade then they would have to allow someone to sell ham sandwiches or someone to sell just about anything else on just about any street corner. These small stands cause traffic problems, people stopping on the side of the road where parking isn't designed into the street and then get out of their cars. This is a recipe for disaster and when it does happen, the injured party can and will sue the city or county for allowing an unsafe condition to exist.

This will explain everything if you sit back and think about it for a moment..Today we buy bottled water and pay for water to come into our homes..The gov. supplies water and makes us pay for it and yet many people are afraid to drink it..

The fact that this issue escalated past the first 2 adults is beyond ridiculous. Kids/ Lemonade Stand. End of dilemma. Maybe they should test the water seeing how so many grown ups FAILED the adult test.

kids on my local course sell lemonde all the time. And it aint freak'n @2.00 a glass either. These little rats are gouging people. Good for the city! this isn't kids selling lemonade it's a going concern.

It doesn't matter who the money goes to. DHHS needs to use resources to come in and make sure the lemonade complies with all government regulations.

How much do you pay for a glass of Soda at ANY fast food place? $1.35 to $2.15 per glass..

$2.00 for the convenience is nothing...How much do they charge for a Coke in a Pro baseball Park...last time I was in Fenway, it was $3.50 for a medium...
