Sarah Palin Trademark Status To Be Achieved By Former Alaska Governor

Sarah Palin Trademark Name

First Posted: 06/20/11 02:49 PM ET Updated: 08/20/11 06:12 AM ET

Sarah Palin will soon have her name trademarked, according to U.S. News & World Report.

An Alaska lawyer submitted applications to the United States Patent and Trademark Office last year to trademark the former governor's name, along with that of her daughter Bristol Palin.

For Sarah Palin's application, there are two classes of commercial service for which her name would be a registered trademark. One is for "information about political elections" and "providing a website featuring information about political issues." The second is for "educational and entertainment services ... providing motivational speaking services in the field of politics, culture, business and values."

The "Bristol Palin" application is for "educational and entertainment services, namely, providing motivational speaking services in the field of life choices."

Reuters reported earlier this year on a hiccup in Palin's trademark attempt. The former governor and her daughter had neglected to sign the forms submitted to the U.S. Patent and Trademark Office, temporarily delaying the process.

According to U.S. News & World Report, there have been no challenges made to Palin or her daughter's applications and the deadline to do so for each respective filing has passed. Sarah and Bristol Palin can reportedly expect to receive their trademarks within three months.

Can someone please explain to me what is the point of her trademarking her name? I don't get it. Does it mean that people can't use her name to sell tickets to an event that she is a part of, or does it mean that no one will be able to talk about her without her permission? What's the purpose?

"Reuters reported earlier this year on a hiccup in Palin's trademark attempt. The former governor and her daughter had neglected to sign the forms submitted to the U.S. Patent and Trademark Office, temporarily delaying the process." She doesn't understand the words "please sign here." What makes you think the word "smart" applies to any of the Palins?
11:33 PM on 06/21/2011
Yea, like you've never sent something out that you knew needed to be signed yet you forgot. Easy to do.

The moment the trademark becomes valid we can expect to see a number of lawsuits against media outlets and websites for the "illegal" use of her name. This is more than just an ego run amok - though it certainly is that - it is a move that better positions Palin to control the discourse about her.

In addition, anyone who has the bad fortune to also be named Sarah Palin will lose the right to use her own name for any public venture, no matter how big or small. The trademark system was designed as a form of consumer protection, creating a means for companies to defend against knock-offs and other fraudulent products. Here we have a case, though, of a thin-skinned egomaniac using the system to tell us all that there is only one true Sarah. Creepy and pathetic, really.

No, one person's opinion doesn't constitute evidence of anything but their opinion.

There is nothing illegal about using the name of a public figure. Unless of course, she considers herself a comodity or a product. Which she is but that is another topic altogether. This is an ego run amok with the loss of reality or any sense of reality. I doubt if she realizes that by her very actions she is setting precedent whereby someone *else* may claim "trademark infringement' against her for her speaking out. I would suggest to her to be very careful about this; it may backfire and when it does it will be at the most inopportune time and under the most inopportune circumstances.

No matter if she copyrights her name she will not have exclusive rights to that name. Claiming exclusiveness will only be held against her and make her meanness stand out. I don't know anyone who would vote for a character who takes someone else to court for innocently naming a child with that name.

Agreed, her actions or lack of thought are creepy and pathetic. Why am I not suprised??

Next the left will nominate David Letterman as their poster boy. They just love the name calling and nasty remarks as seen on this board.

And the Right will nominate who? Glenn Beck? Bill O'Reilly? Rush Limbaugh? I'm afraid the Left cannot keep up with the Right where nastiness and name-calling are concerned.
