Milton Mathis, Convicted Killer, Executed In Texas Despite Evidence Of Retardation

A man convicted of slaying two people and critically injuring a third in a drug house shooting was executed on Tuesday evening by Texas officials, despite evidence that he suffered from mental retardation.

Milton Mathis, 32, was sentenced to death in 1999, three years before the U.S. Supreme Court ruled that execution of the mentally retarded violated the Constitution's prohibition on cruel and unusual punishment.

Intelligence tests, including one given by the Texas Department of Corrections in 2000, measured Mathis's IQ in the low 60s, well below the threshold for mild mental retardation as recognized by almost all states.

In 2005, however, a Texas court rejected his claims of mental impairment, siding with prosecutors who characterized Mathis as a "street smart" criminal whose behavior indicated near-normal intelligence. Federal and state courts declined to overturn the verdict, clearing the way for his execution by lethal injection at the Texas Department of Criminal Justice in Hunstville. A last-ditch petition by Mathis's attorneys requesting a stay of execution and a review of his case was rejected without comment by the Supreme Court late Tuesday afternoon.

Mathis was pronounced dead at 6:53 p.m.

"The system has failed me," he said in a final statement, according to prison officials.

A spokeswoman for Texas Governor Rick Perry, a Republican who is weighing a run for the presidency, said the governor could not offer clemency or a reprieve in the case without a positive recommendation from the Texas Board of Pardons and Paroles, which voted on Monday to reject a reprieve for Mr. Mathis. Members of the board are appointed by the governor.

In 2001, Gov. Perry vetoed a bill passed by the Texas legislature banning the execution of the mentally retarded, saying that the state's judicial system already contained adequate protections for such defendants. Supporters of the bill disagreed, pointing to evidence indicating that at least a half-dozen prisoners with mental deficiencies had been executed since 1990.

Since taking office in December 2000, Gov. Perry has overseen more than 230 executions, more than any other U.S governor in modern history. Mathis was the 6th inmate put to death in Texas this year, and the 23rd in the nation.

In an editorial last week in the Dallas Morning News, former Texas governor Mark White (D) called on Perry to authorize a temporary reprieve for Mathis to examine his claims of mental retardation.

"Mathis has suffered from obvious mental disabilities since childhood," wrote White. "He failed the first, fifth and eight grades and dropped out of high school in ninth grade."

"The governor of Texas is authorized by law to take action to prevent precisely this sort of injustice," he wrote.

Fred Felcman, an assistant district attorney for Fort Bend County who led the prosecution of Mathis, disputed White's claims, saying Mathis's mental deficits were not severe enough to disqualify him from the death penalty.

"We don't execute people who are mentally retarded," Felcman said. "The guy is street smart."

Felcman attended the execution in Huntsville at the request of Melanie Almaguer, he said, who was paralyzed from the chest down at age 15 after being shot in the face by Mathis.

Steven Rocket Rosen, who defended Mathis in his original trial, said there was "no excuse" for the actions of his client. But he said Mathis's mental problems were severe and had been aggravated by heavy drug use from a young age.

According to court records, Mathis began smoking PCP and marijuana soaked in formaldehyde, known as "fry," as early as age 12.

"The guy is off, way off," Rosen said. "He's retarded. They should have offered life in this case and got on with it."

I can't help but to pay strong attention to the sentence "Mathis began smoking PCP and marijuana soaked in formaldehyde......as early as age 12."

So, those who caused their own mental retardation should also be covered under these provisions?

His low IQ is explained in this article as not being of natural causes, but by his own doing.

Smoking weed laced in embalming fluid will certainly result in some serious brain cell damage. Pair that with a weak education? And you've got yourself a defense??

This is an unfortunate political story. Perry couldn't offer reprieve/clemency unless he received a positive recommendation from the Texas Board of Prison Terms whose members he happened to appoint. He's the governor, he could do what he wanted. It was political. The Texas Department of Corrections tested him and his scores were in the low 60's. From the article, it appears as if the was other supporting information regarding his low IQ. Perry vetoes a bill prohibiting execution of mentally retarded individuals as he claims there are other "safeguards" even though others with mental retardation have been executed. Curious that the US Supreme Court didn't intervene. To me, this story is more about Rick Perry, less about the individual who was executed.

The Marines have an expression: " Kill them All. Let God sort them out" If he had the mental presence to kill two people and wound a third, then he has the mental capacity to answer for his crime with his life. Keeping him alive would have been pointless. He wasn't going to be rehabilitated, he was going to spend the rest of his natural life in a 8 X10 cell, locked up 23 hours a day. The system stumbles and bumbles, but they got this one right.

Since you believe in a god enough to let he/she be the final judge, who are you to say how or when anyone should be killed? (Just so you know there are people out there that pay taxes that have no religious affiliation and do not appreciate their money going to the murder of any human being.) Why not let them die a natural death and if there is judgment to meet afterwards so be it. This is what the military does to people. It turns you into blood thirsty psychopaths. Take your hatred that you tuck inside of your religion elsewhere, you're sickening.

I can't help wondering if people with diminished mental capacity---whether you want to call them retarded, a little slow, not very bright, etc---will soon get a free pass from being held accountable for ANY crime or wrongful action. Will we soon have a society where only intelligent, educated people are bound by laws while mentally challenged or uneducated people are free to do whatever they please? If you think I'm going overboard, think about the fact that Milton Mathis was a lifelong criminal. Lifelong. These murders were NOT the first time he broke the law. People with diminished mental capacity should not be put to death especially with an IQ well below 60 because you are in essence killing a child in an adult's body. If that person has uncontrollable anti social behavior, then that person needs to be punished, but like a child, not killed as an adult. Locking him up in a psychiatric facility is preferred, but, at the very least, a criminal facility that can prevent him from harming others and himself. What I want to know is where was our community, our social service agencies, our police force and religious leaders when this very disabled (and yes he was very disabled) was allowed to function with such destructive behavior? Why wasn't there intervention early on that might have save this man and his victims? Looking at this case through a black and white lens ignores what's really going here.

So, you would give these people a free pass to maim, murder, and terrorize the rest of us, and then duck behind the 'retard card'? Either lock them away forever, or give them the dirt nap. There has to be a balance between compassion and the welfare of general public. This is the easiest way to do it, especially when dealing with a lifelong criminals who like to game the system. You take a life, yours no longer belongs to you. Like it or not, there are people out there who would be well served by putting a bullet in their skull.

Such nonsense.

A hearing was held on his alleged mental retardation in 2005. Obviously, he did not prove his case. His pre 18 yearold IQ was 79, well above even mild retardation.

It is unconstitutional to execute the mentally retarded. That is a legal issue, pre trial, at trial and on appeal.

To state the obvious, had there been proof of mental retardation, there would have been no execution.

The reality is that the majority of the tests showed he wasn’t mentally retarded and the one test that did, was after he was arrested and subject to the death penalty and it was in his best interest to fail the test.

The overwhelming evidence, in his life, his schooling, his work history, his testimony at trial, etc., established that he was not mentally retarded.

This is an issue that has been debated repeatedly by the Supreme court. In Penry v. Lynaugh (1989) the court ruled that executing the mentally retarded was not a violation of the 8th amendment, but in Atkins v. Virginia (2002) the court effectively reversed their ruling. The court determined that based on psychological and neurological evidence, as well as (in part) the general worldwide consensus regarding executing the mentally retarded, executing the mentally retarded does constitute cruel and unusual punishment. Not surprising that the three dissenting judges in Atkins were the notoriously most conservative. Unfortunately, it is left to the trier of fact to determine whether the evidence of mental retardation is convincing enough, leaving room for ideology and politics to creep in the back door.

From all of your posts on this one particular story, I'm getting the feeling that this affects you on a personal level. If you take a look at all the stories on this website you will see that the majority of them revolve around the subject on certain levels that might not, in your opinion, flow with the main subject. Luckily, others can form their own opinions without having to get approval from you first. Public forums are based on public opinion, whether they are politically motivated or not, thankfully we have the right to give them. Chill out a little and form your own opinions without slamming others about theirs. It's going to be ok, really.

In my eyes he was clearly able to repeat what he was told and honestly, any 5 yr old can do that. Did you ever hear the one where the defendants attorney or one who is on his side tells him an explination as to why he is going to be executed and then the defendant repeats what he was told and believes because he was told this by someone he trustsince they were fighting for him? Wow, Could that even be?

Oh, Republicans. They say they want to stop wasting tax money on criminals, but would rather spend several dozen million dollars to get them to the electric chair rather than the few million it takes to keep them for life.
