The Wisconsin Collective Bargaining Fight: Behind The Scenes

WASHINGTON -- On the morning of March 10, representatives of the 28 agencies within the Wisconsin government convened a conference call to assess the damage done the evening before, when the Senate rammed through anti-public worker legislation with all 14 Democratic lawmakers self-exiled in Illinois.

The officials had one overriding fear -- that a widespread strike would paralyze the state. Agency after agency reported that morale was "poor," "low," "glum" or in "shock" and that employees planned to show up dressed in all black in protest. But most importantly, they were showing up. Republican Gov. Scott Walker, at least for now, had won.

"This morning, the Human Resources Directors reported that attendance is normal and employee morale is poor," summed up the Wisconsin Office of State Employment Relations, according to Department of Administration documents provided to The Huffington Post in compliance with an open-records request.

"DOC [Department of Corrections] and DHS [Department of Health Services] reported a rumor that tomorrow is 'Black Friday', during which employees will wear all black. There are rumors that there will be an after hours protest at the School for the Deaf, and that Teaching Assistants and Graduate Assistants may be planning a walkout this week. Some students from Madison high schools have left school in order to demonstrate at the Capitol," emailed Jessica O'Donnell, the executive assistant in the Office of State Employment Relations on March 10.

"[N]ormal attendance. Mood is glum," read the update from the Office of Credit Unions -- a sentiment that seemed widespread across the Wisconsin state government that day.

Public workers had ample reason to be glum. After all, they had spent weeks protesting a bill that would strip away most of their collective bargaining rights. On March 9, shortly before 6:30 p.m. CST, Republicans in the state Senate surprised the nation by passing a measure containing the anti-union provision. Just one Republican voted against it.

Word started to trickle out within the government after the Senate convened a special session at 4:03 p.m.

"The Senate is coming in tonight to pass the non-fiscal items in the bill and the Assembly is tentatively scheduled for 10:00 tomorrow. The Capitol Police are aware," wrote DOA Executive Assistant Jodi Jensen in an email at 4:23 p.m. CST to Edward Wall, administrator for the Wisconsin Department of Justice's Division of Criminal Investigation.

"Can you call my cell below?" responded Wall within minutes.

What made the event so bold was that Senate Democrats had been out of the state for nearly a month to deny their GOP colleagues the quorum needed to pass budget bills. The collective bargaining provision was contained in a wider fiscal measure. By isolating the labor language alone, Republicans didn't need votes from Democrats.

While labor unions quickly condemned what the legislature had done, officials told The Huffington Post at the time that a general strike -- a large-scale strike by all workers in particular industries -- was not in the works.

Fears of a general strike had been as poorly founded as concern about violence -- but that didn't stop the Walker administration from calling out the SWAT team to prepare for the aftermath.

At 8:19 p.m., Wall emailed DCI staff, alerting SWAT team members of their duties for the next day.

"All DCI agents are being called to duty tomorrow. Unless out of state on approved leave, ALL agents are to report to WSIC [Wisconsin Statewide Information Center] by 8am. SWAT team members are to report to WSIC by 7am and will be detailed to HQ to secure the building and other high priority areas," wrote Wall, adding, "As you have probably heard, the situation is very tense. Over 4,000 have breached the Capitol doors and climbed through the windows. The crowds outside are also growing rapidly. Protesters were blocking the entrances to HQ and the parking garage."

But even in the days leading up to the vote, the Walker administration was on the alert for internal disruptions.

On March 8, for example, Arthur Zoellner, the director of continuity of government in DOA emailed out a "daily situation report" to various government officials about attendance, operational ability, informational picketing and job actions at 16 state agencies. That day, there was picketing at DOA, DOC and the Department of Revenue. All agencies reported normal attendance.

The pre-passage monitoring extended to Twitter. On March 9, University of Wisconsin-Madison Police Chief Susan Riesling sent an email to Wisconsin officials, including DOA head Mike Huebsch, about an analysis of the four main Twitter "accounts," which seem to be references to the hashtags #protest, #wisconsin, #wiunion, and #strike.

"So what does this mean? It means we have identified all of the main twitter accounts used by folks engaged in legal protest activities involving our Capitol and the Capitol Park," she wrote. "It also shows what [Department of Natural Resources Chief Conservation Warden] Randy Stark and I talked about in our meetings -- which is the minute we (law enforcement) does something it is shared quickly with lots of others via twitter."

She added that they had joined some of these Twitter "accounts" to view the tweets and keep up to date.

"This is perfectly legal for us to do," she assured the email recipients.

On the day Governor Scott Walker signed the state budget, members of Milwaukee County's largest union were voting on a new contract. AFSCME's goal is to have a deal in place before a new law eliminating most collective bargaining goes into effect on Wednesday.

The union voted 89% in favor of the county's proposed contract. Just about a third of its members showed up to vote for the sole purpose of keeping their collective bargaining rights.

So, let's review. After months of hysterics, national headlines, Walker bashing, and hyperbole from the union bosses, ONE THIRD of the union membership shows up to vote? The union knows they are in BIG, BIG trouble with their membership. The shackles are being thrown off.

What I find most commendable about this account is the civility of Wisconsin residents in the face of fascist (and that is not a I word I use lightly) political tactics by Governor Scott Walker and his think-alikes whose pent-up anti-union and anti-democratic vengeance led to mass protests this past winter .

As well, the restrained and responsible approach by law-enforcement made a huge difference turning what could have been an awful blood-bath into a shared celebration of democracy. Hats off to Madison Police Chief Mahoney, who refused to buy-into the Governor Walker, goon mentality, when he pulled his men from the Capitol saying, "We're not going to be a palace guard."

As tensions rose with with threats of intervention using the National Guard by Walker, off-duty police officers slept with protesters in the Capitol Rotunda to keep everyone safe. Pretty gutsy move if you ask me by those sworn to serve and protect..

Compare Madison, WI to Toronto's ghastly mass arrests and violence during the G20 summit, and there are a lot of lessons authorities everywhere can learn from the Madison experience. Civility counts.

Where do all these "conservatives" come from? Most of them claim to be "capitalists" and are for business. If they're going to thrive as a business how are they going to do it by breaking the middle class? How does any business survive without customers? Unless you believe that the top 2% can and will purchase all your supplies and services.

I have to disagree. Those pension were part of a contract in leu of wage increases. But just like the conservatives to not honor a contract. It's not the public servants fault that the state invested badly and lost their fannys in the 2008 depression.

The point is your dems are pushing for it but no word on huffpo. Did huffpo wait for WI to pass the law before blasting these so called anti middle class people. No they didnt! I know how govt works. Worse I know how huff po works. If they were fair or cared to even the playingfield they would be equally blasting these lawmakers in mass. What I said was the house passed it can you read? The house passed which took 81 dems voting yes. Why hasnt huff po called them out. Whether the bill passes or not you know where those 81 dems stand right. Oh no you wouldnt because no one on the left even mentions it.

As long as American workers refuse, for whatever reason, to vote for themselves, travesties such as Walker and Kasich will continue to destroy them. The first question every voter should ask him/herself should be, "Can I financially afford to vote Republican?" Unless you are multi-millionaire, the answer MUST be "No!"

Officials at Georgia-Pacific said the company is laying off 158 workers at its Day Street plant because out-of-date equipment at the facility is being replaced with newer, more-efficient equipment. The company said much of the new, papermaking equipment will be automated. [...] Malach tells FOX 11 that the layoffs are not because of a drop in demand. In fact, Malach said demand is high for the bath tissue and napkins manufactured at the plant.

I have no first hand experience with tea-baggers, I got into it with a birther once, who started up in the video store, I cam close to putting this clown through a wall. I'm not a Starbucks drinking liberal, I used to be a right of center Republican, but the last 10 years or so the GOP has gone to far to the right for my tastes, to dixiecrat. I hated dixiecrats like George Wallace when I was in HS, I couldn’t stand LBJ because of the Vietnam War, why should I like dixiecrats posing as Republicans any better. If a tea-bagger invades my space, he will be evicted faster than you can say tea.

Doesn't this midget brain Walker understand that SWAT teams are public employees, as are all law enforcement agencies as are all members of the National Guard and the military. He relies on public employees to protect him even while taking away their right to collective bargaining. What a thoughtless idiot.

Last time I checked, these are the tactics of petulant, power-crazed, third world juntas and dictators, not the practices of elected officials in the U.S. All because a pasty-faced, balding, cross-eyed dweeb got drubbed in local Milwaukee politics and now finds himself in "power."

Every effort to tip the scales back toward rational thought, including the legislature recalls, is worthy and absolutely necessary, as long as it's non-violent. And not only in WI.
