Lamar Smith Unveils Plan To Block Obama's Power On Deportations

WASHINGTON -- Rep. Lamar Smith is working to gather support for a bill that would block the Obama administration's ability to take executive action on deportations, even though the Texas Republican pushed previous administrations to use the same authority.

Smith is attempting to draw support for the Hinder the Administration's Legalization Temptation Act -- more commonly referred to as the HALT Act -- to stop the Obama administration from blocking deportation for families of U.S. citizens who are being sent to dangerous countries.

The bill is a political attempt to push back on Democrats, who are advocating for the president to end some deportations since major immigration reform remains nearly impossible. Although the HALT Act is unlikely to make it out of the House -- and would almost certainly be vetoed if it passed the Senate -- Smith is highlighting a controversial presidential power at the same time that Democrats urge Obama to use it, which may lead him to not assert his authority at all.

Democratic lawmakers have asked the president to use his executive power to stop certain people from being deported, such as families of U.S. service members and citizens, or young men and women attending college in the United States. Some have argued the government should redefine "extreme hardship," a classification used when determining whether a family member or spouse of an American citizen can remain in the United States, to allow families to remain together.

But Smith claims in a "Dear Colleague" letter that the White House is already using its discretion to avoid enforcing immigration law.

"[T]he Obama Administration has made clear that it plans not to use but to abuse these powers," the letter reads. "Because of the Obama Administration's record, it cannot be trusted with these powers."

Smith's bill would prevent administrative officials from granting work authorization on a discretionary basis or granting parole or issuing deferred action, except under narrow circumstances. It would also prevent Obama from canceling orders of deportation entirely and from waiving the three- and 10-year barriers to entry for men and women who have been caught illegally present in the United States.

While Smith is now looking to take away Obama's executive discretion, he has previously pushed for additional leeway in immigration enforcement. In 1999, he signed a letter to then-Attorney General Janet Reno urging her to help the family members of U.S. citizens avoid deportation.

The bipartisan letter was signed by Smith along with Reps. Barney Frank (D-Mass.) and Sheila Jackson Lee (D-Texas) and former Reps. Henry Hyde (R-Ill.), Bill McCollum (R-Fla.) and Martin Frost (D-Texas).

"We write to you because because some believe you have discretion to alleviate some of the hardships, and we wish to solicit your views as to why you've been unwilling to exercise such authority," the letter stated. "True hardship cases call for the exercise of such discretion."

In spite of his campaign against Obama's immigration enforcement, Smith is still supportive of the White House's discretion -- so long as it's another president is living there. The HALT Act provisions would not apply "to the next president whom the American people elect," the letter says.

Rep. Luis Gutierrez (D-Ill.), one of the main Democrats calling for administrative action on deportations, said the fact that Smith put a sunset on his bill shows that it is just an attempt to hurt Obama, not to make a real policy change.

"It's concerning to us that you want to take something away from only this president," he said, speaking for congressional Democrats. "If it's good public policy, it should be left in everyone's hands; if it's bad public policy, it should be abolished. He's agreeing that it's good public policy, or he would abolish it, but saying [Obama] would abuse it. It's just politics, politics, politics."

Reading Lamar's Letter, where he specifically says this Law would ONLY apply to THIS President but NOT Future President's -- Lamar has made it very clear and obvious that his only goal here is to make it appear as though THIS President is not a legitimately elected President.

Does anyone else have a problem with these pages loading real slow? I never had the problem when I was using AOL, but now that Huffington Post and AOL have joined, the pages seem to load extremely slow. Anyone know why?

I could only assume if the president didnt pander to the illegals we wouldnt have this bill in place. But doing things like suing AZ and calling a bill racist that you never read would give anyone a good reason to question Obamas stance.

Smith claims that "deferred action" or "parole" could "potentially legalize" people who are here illegally.

The Immigration and Nationality Act says otherwise. Of course, the Chairman of the House Judiciary Committee can't be bothered with stupid things like "the law."

The bad thing is they are using as a factor in determining deportation whether or not a illegal immigrant has been CONVICTED of a crime.

I don't even need to go into the whole issue of them just being here is illegal or that virtually all of them also commit several other crimes including fraud, ID theft, tax crimes, falsifying government forms, etc

Anyone who has spent any time in the judicial area of our country knows that millions of people are out there who have been allowed to plead down on crimes to have the record expunged. Millions more are lucky and avoid conviction due to loopholes or technicalities. Millions more haven't been caught. Millions more have had the government decide not to prosecute due to other reasons (with illegals it is mainly the cost of trial for minor crimes like car theft, burglary, etc is so high why not just let ICE remove them?).

Just like the luckily failed dream act which let known gang members stay, let illegals with lots of arrests stay, they could have two criminal convictions and still stay.

That is why we can't trust the politicians to do the right thing. That is why all discretion needs to end.

The morral to the story is that there should be no factors to determaning deportation!! whats the matter with these polaticians today dont they hear the vioces of the american people!!!!!!the key word is ILLEAGAL and the last i herd that mean a crime has been commited and that anybody assisting in a crime is punishable by law so why are we not convicting these people to including polaticians

The UNITED STATES has BORDERS like any other country we need to inforce our borders and uphold and follow the LAW its time to throw out any politicians that doesnt seem to reconnize the proboblems that ILLEAGALS in our country are causing and even more of the spending of our tax dollars why are these politicians so worried about illeagals rights instead of listening to the citizens NEEDS of this country! Politicians are voted into office by AMERICAN CITIZENS not ILLEAGALS so why are we paying for there education with our tax dollars health care with tax dollars and what ever else they have figured out how to manipulate

This administration has made it a matter of POLICY to refuse to deport non violent illegal aliens, most recently seen in the memo from John Morton to ICE. Recently, an illegal alien who would have been eligible for the Dream Act, had it passed, was given a stay of deportation the day before she and her mother were to return to India with tickets they had bought themselves. The woman's MOTHER, who is NOT Dream Act eligible, was also given a stay. They are typical of the more than 34,000 illegal aliens who have been ordered deported and who have had those orders second-guessed by the Obama Administration.

Yeah, and that's the kind of "immigration reform" we can do without. Actually, we don't need any stinking so-called "immigration reform." What we need to do is secure our borders and enforce the written immigration laws already on the books. Attrition through enforcement works, however, we're not getting enough enforcement to give it a chance.

From Politifact: "Data for the first half of the 2011 fiscal year (which began at the end of September) suggests that trend is continuing, with about 52 percent of the deportations involving convicted criminals."

If there is a "policy to refuse to deport non violent illegal aliens," then it appears that the policy is not being followed. How else would you account for the 48% of deportations that do not involve convicted criminals?

The fact is that deportations are up under the current administration. The HALT Act ignores this because it is simply another attempt by a Republican to limit President Obama's power. What was it that McConnell said? "The single most important thing we want to achieve is for President Obama to be a one-term president." That's the Republican party. Jobs? Economy? Peace? Justice? Nope.

Time to wake-up, billc. ICE is routinely letting more illegal go free than they are deporting. We're constantly hearing about local law enforcement agencies being told by ICE to let apprehended illegals go free. Well, not to worry, under the new policy there will be even more illegals set free on a routine basis. Just think, the next illegal that is set free may be the very one that fails to stop at the next stop sign you or your family is legally proceeding through.

Maybe because this President is the one abusing discretion. If others in the future do, then let the Congress at that time deal with the situation. We see what happens when we get "permanent" fixes to current problems. The 14th amendment comes to mind. Intended for freed slaves after the Civil War and NOT illegal aliens (an unknown concept at the time), we're stuck with the claim that it gives citizenship to even the children of illegal aliens when they're born here.

During the Congressional Floor Discussions around the 14th Amendment there was GREAT concern that people from "C H I N A" that were not in this country legally would have anchor babies -- the 14th Passed in sp/te of those concerns.

LETTER:

Pay close attention to Lamar's Sentence that is directly AFTER point number 7, "The Bill will restore these powers to the next president whom the American people elect"

See, what Lamar is saying is, HE wants to TAKE Presidential powers away from THIS President but NOT FUTURE Presidents.

I don't know how ANYONE could agree with that.
