WANTED: ELEPHANT ABUSER. $10K REWARD.

Following reports and video footage allegedly showing that Tai, the elephant featured in “Water For Elephants,” was abused while training for movies, outraged viewers and animal rights activists wanted justice. While the law may not be on their side for Tai, whose abuse was documented six years ago (now beyond the statute of limitations), the national non-profit Animal Legal Defense Fund (ALDF) is seeking justice for any elephant recently abused in California.

While certain acts are legal, the state of California has laws prohibiting specific types of animal cruelty. ALDF representative Lisa Franzetta directed The Huffington Post toward the specific illegal acts described in Cal. Pen. Code § 596.5:

It shall be a misdemeanor for any owner or manager of an elephant to engage in abusive behavior towards the elephant, which behavior shall include the discipline of the elephant by any of the following methods:

(a) Deprivation of food, water, or rest.
(b) Use of electricity.
(c) Physical punishment resulting in damage, scarring, or breakage of skin.
(d) Insertion of any instrument into any bodily orifice.
(e) Use of martingales.
(f) Use of block and tackle.

In keeping with this law, the ALDF is offering a $10,000 reward for information that leads to the arrest and conviction of a person who abused an elephant during the production of a film or television show.

At the same time, Animal Defenders International (ADI) filed a suit on Monday against Have Trunk Will Travel, claiming the organization "duped" the public into believing Tai was humanely treated during "Water for Elephants" training. According to the animal rights group, Tai is next expected to appear in "Zookeeper."

As ALDF Executive Director Stephen Wells said, “The glamour of the big screen and television productions belies the suffering of elephants forced to perform on Hollywood sets. Elephants are wild animals, not actors, and the barbaric techniques routinely used to force elephants to learn tricks can qualify as abuse under California law.”

This brings up a much larger underlying issue –- the use of wild animals as performers. Franzetta cites CGI and other advanced forms of technology as entertainment alternatives, and yet, “Countless animals are forced into unnatural captivity and deprived of the ability to engage in their most innate behaviors in pathetic roadside attractions, circuses, and other sad, exploitative industries—including the Hollywood film industry.”

The training team that allegedly abused Tai, Have Trunk Will Travel, issued a statement following the release of the video footage, saying that they stood by their training methods, and their company "does not condone using electrical devices to discipline and control elephants except in situations where elephant or human safety is at risk."

According to The Los Angeles Times, when the Ringling Bros. faced trial for the mistreatment of circus elephants, the defendants claimed that bull hooks were no more cruel than a dog's leash or a horse's bridle. A former Hollywood elephant trainer told The Chicago Tribune, "You cannot train an elephant without force or fear and have them perform consistently, all the time." The trainer later quit her job due to the mistreatment conducted during training.

Certain acts of abuse are illegal under California law, and perhaps these criminals may even be caught and put to justice. But what about animals undergoing forms of abuse not included under California law? And what about animals in states and countries that have no such law at all?

When people that know the truth bring thiese acts forward, there are many morons who refuse to believe that Elephants and all animals of the CIRCUS are extremley abused. I have heard it said that it is nothing more than PROPAGANDA when photo's are released of these innocent creatures beaten because they didn't do a trick the right way.The Humans that cover their eyes to the truth are animal abusers for buying the bloody tickets..also they are teaching their children that is Right to treat animals Wrong just so they can sit in the stands for an hour and giggle at a creature who's rights have been washed away for sheer pleasure of that worthless human!! Wake up humans these animals feel love and pain just as you do.They also cry and miss their families.We as humans have NO right to cage or chain anything for our selfish pleasures!!

Since in this country money talks. Every person in the United States should boycott every movie, circus or any other entertament that has animals that are being abused. If they start loosing big time from there pocket books things would change for the better for the amimals. The stories about the dogs and elephants really upset me alot. Years ago I watched on 60 minutes about how they treat chickens. I was in such shock to this day i really have a hard time eating chicken. You would not believe what the handlers were doing to these chickens. Throwing them up against the wall as hard as they could, throwing them into the air and watching them fall to the ground it was just horrible. Why is England so humane with there animals and the U.S isn't. Is it because we have people out for the buck not giving a dame? Each and ever creature has a purpuse on this earth. And I think some day everyone is going to pay for the loss of alot of these creatures because of the way man treats them. Start boycotting, that is where all the power is. It hits the big man pocket book. Carla

It seems so odd that anyone would need to beat or intimidate an animal as intelligent and social as an elephant to get it to cooperate. Patience, love and treats would surely do the same with an elephant who was interested in learning. That's the trick with dogs, cats, horses and birds- find one who WANTS to play with you, learn what its favorite treat is and then get to work. Short sessions with lots of positive reinforcement, lots of down time for the animal to rest and play either alone or with pals and then you have a happy, well-adjusted animal who is much more likely to happily cooperate with you. I just don't believe it's necessary to be cruel or mean to get results.

Felicia, You seem to advocate 'exotics in entertainment' .... if training is accomplished by "soft" methods. Granted, that's the preferred training method of any living creature ... maybe domestic animals, but not exotics.

Even if the training can be accomplished, what is natural to that animal is replaced with steel bars, whips, heavy chains, and bullhooks. Big cats such as tigers and lions are kept in long narrow cages when not performing. Elephants are chained in place.... one step forward, one step backward.... until showtime.

PLUS, there's the transport issues when the circus moves - how frequent that is! Imagine a July afternoon in the midwest, an elephant stands chained in place in a train's closed box car. A tiger is contained in a steel-bar cage in a closed transport trailer. The cage isn't tall enough for the tiger to stand up, stretch, or turn around.

The life of a majestic animal such as an elephant or tiger is far too high a price to pay for two hours of entertainment. It is highly inappropriate for exotics to appear in an entertainment venue.... AND...these animals will never see or feel anything close to natural in their entire circus career.

Only a few lucky animals are rescued and given the opportunity to live a near-natural life in a sanctuary.

So, Felicia, do you still approve of 'soft' training methods of exotics for the circus?

yup let's shoot 'em. knee cap 'em then electrocute 'em and then hang 'em and burn 'em.. after all they are only those wretched horrible humans..I guess empathy can only go so far certainly not as far as to actual human beings. I often wonder what some of the posters would have done in Rome.. feel sorry for the gladiators.. or just say oh well they are HUMANS.. who needs 'em

They should extend the reward to abuse committed against animals in circuses.

The public also has the right to know that the Cole Bros Circus has a history of violations when it comes to the treatment of their animals.

Just recently, evidence was captured on video tape of John Walker, one of the elephant handlers, beating Viola one of their elephants with a bullhook. The USDA has been notified and calls have been made for Viola and the other elephants in Cole's possession to be confiscated and sent to sanctuaries.

Circus life might be wonderful for the human performers, but it is a life sentence of torture for wild animals, especially elephants who suffer terrible physical and psychological health problems due to their restricted lifestyle, not to mention the abuses endured by many inexperienced handlers.

England just passed a ban on wild animals in circuses, recognizing the terrible life these poor animals have to endure. One can only hope that people here in the US will also wake up and see that supporting this kind of entertainment is neither ethical or humane.

There is no reason for any animal to ever be abused. Sadly this goes on everyday and often times unnoticed. Hopefully with education the unnecessary mistreatment of animals will stop.

As awful as this seems, there is probably more of it going on than you think...all in the name of making movies. Then again...this abuse is not as HORRIFIC as what's going on right this minute and every day in the world's slaughter factories. You don't want to KNOW what animal abuse is at these places...because as a race we consume meat...and don't THINK or want to SEE how it is created in those nicely packaged trays at your local store that you buy every week...without any response to how it arrived there for you to consume. I'm not saying not to eat meat...but if everyone got as concerned about animal abuse in these factories...as they do about CUTE animal abuse...then maybe farm animals would not suffer before they give up their lives for US...just a thought.

This stuff really makes my blood boil! I wish these people had the same treatment used on them, so MAYBE they would realize what pain feels like. I have boycotted all circuses for years and I beg you to do the same. Animals have no place in entertainment, especially wild animals. So called trainers have no clue about how to treat them, abuse is rampant. You know why? Because they are so much bigger than a human, and the human is scared silly of the animal. So what happens? Abuse, in every form, to horrible degrees, to rotten to imagine...but it goes on. Look how bad people can be to their own pets. As bad as this sounds, I like hearing about the incidents where the animal attacks and wins, You know it was deserved.

The abuse of any animal is wrong and the perpetrator a danger to society. Animal abusers move on to abuse people. You can dress the actions up as necessary to train an elephant but you are still abusing an elephant. I hope all the rationalizing abusers are quickly arrested, tried, convicted and sentenced as quickly as possible to serve as a deterrent to those looking to profit off the abuse of an animal.

I never watched the video's, I couldn't do it. The way some people treat animals and almost always for money is absolutely disgusting. I try to keep my faith in humanity, but it gets pretty tough these days. I hope there is balance and that one day these mean spirited expletives get what they've been dishing out. Unfortunately, all to often people who can't feed themselves never mind the animals take it out on the animals and I have noted most are dead or never able to return to being themselves and no fine will ever bring justice to the animal. It is sick, a shame and tears at my heart. We need to stop supporting these animal shows and I wish animal rights groups had more money invest for at the very least...... proper euthanasia for animals no one will take or care for. Stop supporting these large, faceless corporations with deep pockets, teams of lawyers and trump on the table. They don't care about the animals and they could care less about you.....it's your money they want and nothing more. Disgusting, I have no idea how some folks live with themselves?
