The city may not have the dirt it needs on Julie Bass's garden, so it's going after the farm animals instead.

Prosecutors in Oak Park, Mich., have dropped a misdemeanor charge against Bass, who until yesterday was staring down a July 26 court date and potential 93 days in jail for planting and refusing to remove a vegetable garden on her front lawn.

The Bass family vegetable garden generated a national media stir as the family battled city prosecutors who claimed that cabbages, peppers and tomatoes were not "suitable" for the front yard.

In the past weeks, the city threatened Bass with a warning, ticket and finally, the misdemeanor charge, none of which persuaded Bass to dig up the garden.

And while prosecutors have dropped the charges for now, Bass and local prosecutors haven't exactly turned over a new leaf.

According to Bass, Oak Park is pursuing charges that the Bass family dogs are not licensed with the city. Bass claims that the dogs were registered with the city less than a week after she received the ticket and that she has since presented the necessary documentation to prosecutors.

"This is our fault; we paid a late fee," she told The Huffington Post.

While Bass cautiously expects that the dog issue will be sorted out accordingly, she remains uneasy about the city's ability to revisit the gardening case, as it was dropped without prejudice.

"I don't know if I expect it but I'm afraid of it," she said. "Pretty much every step of the way Oak Park has done something counter to conventional judgment. Everything I expect them to do, they just do something completely different."

On Thursday, prosecutor Eugene Lumberg told The Detroit News that he plans to take a closer look at the issue.

"I want to look at it, I want to see the facts, I want to see where this vegetable garden is going and make a determination of whether or not to prosecute under the existing ordinance, write a new ordinance and (examine) the public welfare," Lumberg said.

Officials will be watching Bass as they decide whether to resurrect the issue.

"She may decide to grow a cornfield," Lumberg added. "If she plows up a compost heap, what are [we] going to do?"

Come next season, Bass knows she could be harvesting a whole new battle over her garden.

"We're not out of the woods."

Wow. I thought for sure she was growing pot or some sort of strange vegetable that could be deadly to animals if they ate it. But cabbages, peppers and tomatoes? WHAT a waste of tax money!! If I lived in Oak Park I would be protesting the city's decision to wast time, effort and money on such a stupid charge!!

The garden is obviously well tended. It probably doesn't give off any smell (from compost and such). It reduces her carbon footprint in her part of the world. It is healthier for her and her family. There is only one problem that I can see and that is just the fact that there isn't grass in the front yard. Personally I'd rather grass however if I didn't have anywhere else to put my garden you're damn right I'd put it in MY front yard!

What is really sad is this woman has posted pictures of her neighborhood. There's trash in neighbors yards and junk on the side of the road etc. Wtf is wrong with well-tended veggie garden?

This woman obviously made someone in "power" mad.....what a waste of money, time and energy....Leave this woman alone, Leave her garden alone and Leave her dogs alone.....

Oh the horror! Vegetables! It would be great if everyone on the block did the same thing, but with different varieties. Then, do a little swapping and everyone has inexpensive, healthy, food! But, that would be too easy.

If I were her, I would build a 4 foot white picket fence with dwarf fruit trees behind it. I would do some companion planting - roses, flowers, herbs to make it pretty. The fence and the trees would hide the gardens from view and the flowers would "hide" the veggies and attract beneficial insects. There is usually an easy to solution to things, but people like to fight!

I ran into the same problem in my hometown where the city was made up of a bunch of tightazzes just like hers.
My solution?
I planted flowers all around my front yard; everywhere I could squeeze one in; the city fathers in their infinate wisdom approved and told me "Now your being logical and a good citizen". The jokes on them!
The biggest majority of those "flowers" were colorfull vegetables mixed in with a few "companion flowers" that are benificial to veggies driving away bugs like nematodes that eat your veggies. I had a bumper crop of veggies and many of the "flowers" like Marigolds are eatable when tossed into soups and stews and salads; Potatoes with their big leaves and purple flowers were "delightfull" so say the city fathers; and they passed my tomatoes because of the beautiful red tomatoes. I also have a small tastefull compost bin right in the front yard; that when done properly has no odor whatsoever. When asked what my compost bin was, I truthfully told them it was extra soil filled with vitimins to make the flowers grow better and does wonders for the veggies. So once again the good guys (me) win over the tightazz knowitalls; who really dont know squat!
"A rose by any other name is still a rose"; and my "flower garden" is still my vegetable garden.
So much for the intelligence of the frustrated politicians AKA City Fathers.

Looks like the governmental officials in Oak Park have too little to keep them busy. Now they need to determine which plants are legal in a back yard but are illegal in a front yard! Isn't it wonderful to live in the land of the free and the home of the brave!

As long as there is no ordinance listing the species of plants allowed or not allowed to be grown in a front yard, they have no case against the Bass family.
The way they went after the dogs when they had to drop the charges for gardening stinks of harrassment and makes you wonder about who (and why) has a bone to pick with this family.

(And I wish for further victories against the local prosecutors, who, from their own statements, appear as complete jerks)

It appears the officials of Oak Park do not have enough to do in their fair community. A garden, a dog license, in the scheme of a safe and secure neighborhood, seem well, frivolous.
