Human Embryonic Stem Cell Research Funding Can Go Ahead, Judge Rules

WASHINGTON — A lawsuit that had threatened to end the Obama administration's funding of embryonic stem cell research was thrown out Wednesday, allowing the U.S. to continue supporting a search for cures to deadly diseases over protests that the work relies on destroyed human embryos.

The lawsuit claimed that research funded by the National Institutes of Health violated the 1996 Dickey-Wicker law that prohibits taxpayer financing for work that harms an embryo. But the administration policy allows research on embryos that were culled long ago through private funding.

U.S. District Judge Royce Lamberth, chief of the federal court in Washington, last year said the lawsuit was likely to succeed and ordered a stop to the research while the case continued. But responding to a swift protest from the Obama administration, the U.S. Circuit Court of Appeals here quickly overturned Lamberth's injunction and said the case was likely to fail.

The attorneys who brought the suit said in a statement that they are weighing their options for appeal. They pointed out that Lamberth said in his ruling in favor of the administration that he is bound by the higher court's analysis.

"This Court, following the D.C. Circuit's reasoning and conclusions, must find that defendants reasonably interpreted the Dickey-Wicker Amendment to permit funding for human embryonic stem cell research because such research is not `research in which a human embryo or embryos are destroyed,' " Lamberth wrote.

Researchers hope one day to use embryonic stem cells in ways that cure spinal cord injuries, Parkinson's disease and other ailments. Opponents of the research object because the cells were obtained from destroyed human embryos. Though current research is using cells culled long ago, opponents also fear research success would spur destruction of new embryos. Proponents say the research cells come mostly from extra embryos discarded anyway by fertility clinics.

President George W. Bush also permitted stem cell research, but limited the availability of taxpayer funds to embryonic stem cell lines that were already in existence and "where the life and death decision has already been made." Obama's order removed that limitation, allowing projects that involve stem cells from already-destroyed embryos or embryos to be destroyed in the future. To qualify, parents who donate the original embryo must be told of other options, such as donating to another infertile woman.

The Obama administration's rules expanded the number of stem cell lines created with private money that federally funded scientists could research, up from the 21 that Bush had allowed, to 128 and counting.

Obama adviser Stephanie Cutter wrote on the White House blog that Lamberth's ruling is good news for patients suffering from diseases that could potentially be treated by stem cell research.

"For too long, patients and families have suffered from debilitating, incurable diseases and we know that stem cell research offers hope to millions of Americans across the country," she wrote. "President Obama is committed to supporting responsible stem cell research and today's ruling was another step in the right direction."

The lawsuit was filed in 2009 by two scientists who argued that Obama's expansion jeopardized their ability to win government funding for research using adult stem cells – ones that have already matured to create specific types of tissues – because it will mean extra competition.

The scientific community applauded the ruling, as did National Institutes of Health Director Francis Collins. "This ruling will help ensure this groundbreaking research can continue to move forward," Collins said in a statement.

The teeth were 'fully functional' and allowed mice to chew without any complications.
The researchers hope this is a step to help the development of new human organs grown from a patient's own cells.

They buried the lede. It has nothing to do with saving bundles of cells but to continue to limit competition. Bush loved nothing better than to privatize everything he could. The robber barons would be proud:

Should the U.S. have abandoned or restricted attempts towards developing passenger airlines?

In 2005, seven years after the first isolation of human embryonic stem cell research, there are those who would argue we should abandon this promising area of research in favor of adult stem cell research, which has been underway for forty plus years, because it is further down the line towards therapy development.
Just because adult stem cell science is older, doesn’t mean it’s better.

The truth is, both areas of research are worth pursuing, they both have scientific and medical potential we do not yet fully understand. Embryonic stem cells can teach us a great deal about how to reprogram adult stem cells. However, they are still different cells, and are not substitutable. The first liver transplant in 1963 taught us a great deal about how to perform the first heart transplant in 1967. But that doesn’t mean you can give someone a liver instead of a heart and hope that they recover.

Restricting embryonic stem cell research causes harm to all stem cell research and delays the scientific breakthroughs that could lead to treatment for disease.

Amen. Embryonic stem cells could turn out to be boon or a dud. We'll never know until the research is done and some NIH money starts flowing to get that early research going. Everything should be explored.

Actually, it was Bush who cancelled the competition. Obama re-opened it and these scientists filed their lawsuit to cancel it again...in opposition to Obama.

As a person living with cancer, this ruling is obviously very welcome indeed. But, long before it had such personal meaning to me (I am fine, by the way), I strongly supported this type of research and watched with horror as my country's politicians made decisions that did actual harm to our reputation as a leading nation in scientific research, not to mention actual harm to our citizens and their health care. I am pleased the administration took on this issue, and it is heartening to see them succeed. It is time to regain our standing among the world's most innovative and successful research and delivery scientists. This is a big and important win.

As a person with cancer, you should know that the research in adult stem cell therapies is what is yielding results and treatments. Therapies for leukemia are already being used. A family friend received an adult stem cell transplant two years ago and is in complete remission from CML. However, all the research done with embryonic stem cell implants resulted in serious complications, often cancer growth, and death of the subjects. I hope you receive an effective treatment and can live a long and happy life.

Because funding for embryonic stem cell research has not existed. And none of the therapies you've mentioned have yet been approved (ie, they have not been demonstrated safe and/or effective). The adult stem cell transplant (ie, bone marrow transplant) is hardly new and has nothing to do with broad stem cell therapies. Your family friend had to find a matching donor. Embryonic stem cells are highly unlikely to have the same type of donor rejection issues. They can become broad therapies.

That's just a flat out false statement. Show me one in a human in the US...ever. Just one. Good luck with that. You don't know the research, just the politics. Information comes from more than just agenda-driven websites.
