Tampa General Hospital Files $9.2M Claim Against Deceased Woman's Estate (VIDEO)

TAMPA, Florida (AP) - Tampa General Hospital has filed a $9.2 million claim against the estate of a woman who died after spending five years in the hospital, according to Hillsborough County court documents.

In court documents, that's how much the hospital says it is owed for the care of Tameka Jaqway Campbell. She died at age 29 two years ago of progressive demyelinating neuropathy, which occurs when the immune cells attack the body's nerves.

It's unclear whether the $9.2 million in hospital charges is a record. Health News Florida checked with the American Hospital Association, the Health Care Financial Management Association, and numerous others. No one knew anyone who keeps track.

"That would have to be the biggest bill I've heard of," said Alan Levine, a division president at the Naples-based hospital chain Health Management Associates.

"I've seen more than $1 million," he said. "But not 9 million."

Fort Myers hospital consultant Peter Young said, "A bill that large may well be in a league of its own and a Guinness Book of records bill!"

Could be. An online search at the Guinness Book of World Records offers no category for "largest hospital bill."

A spokeswoman for Guinness World Records said the organization will have to do a search to see if there's a related category for such an item.

Meanwhile, consultant Young said, without knowing any details, that the case is unusual. Hospital officials must believe there are resources against which a claim can be made, he said.

There aren't, said Campbell's mother Holly Bennett.

"If they think they're getting money from me they're crazy," she said. "Who's ever even heard of a bill that high?"

Bennett thinks the lawsuit is punitive, to prevent her from filing a wrongful-death lawsuit against the hospital.

"They're trying to make me go away," she said. "They're trying to cover up for the mistreatment of my daughter."

Bennett has a YouTube channel with videos that accuse the hospital of not feeding Campbell and of giving her too much morphine. The combination caused Campbell to drop to 37 pounds, Bennett says.

The videos show a young woman, presumably Tameka, lying in a hospital bed hooked up to tubes, including what appears to be a feeding tube.

Tampa General spokesman John Dunn said he can't comment on patient cases.

The hospital never sent an actual bill for its charges, Bennett said. Instead it filed the list of charges on its claim against the estate.

Guardianship records at the Hillsborough County Courthouse show that the court removed Bennett as her daughter's health care surrogate and appointed a professional guardian. It's unclear from the documents why Bennett was removed.

The attorney representing Tampa General said he could not comment. Bennett does not have an attorney.

But if she acquires one and pushes forward with a wrongful death suit, the parties will either haggle and settle out-of-court or a jury and judgment would decide how much money goes to the mother, the estate or the hospital, said South Florida attorney John Kelner.

Barry Dubinsky, a medical malpractice attorney in Coral Springs, said hospitals frequently file claims against the estate of a patient who has died and has unpaid bills.

"Technically, you have to file in case the estate gets funded, then you've got your hand in the pot," he said of Tampa General. "It's business, it's all business. The hospital is just trying to get their money."

I hope that this mess is cleared up. That is a ridiculous hospital bill. Why was a hospital giving free health care. The free clinic has revenue through the state. We wont hear anymore about this case.

Please read the info I quoted from a local tv station's website. It is clearly stated that this is NOT a bill. It's a claim made against the deceased's estate.

The deceased passed away without one penny being paid against the medical bills. The hospital filed the claim on the chance that the deceased estate had any money/comes into any money, so that they can recoup their losses.

The mother is making it sound like this is a bill she was presented and expected to pay. That is completely untrue. The money -- if any -- would come from the estate of the deceased. Since not one penny had been paid of the bills for the 5 years she was in the hospital, common sense would suggest there is no money in the "estate".

So, the hospital -- or rather the taxpayers -- will eat the entire cost of the bill.

I feel for the deceased and what she went through, but she got 5 years of very expensive medical care for free.

The inflated costs of healthcare are the core problem, yet all we ever hear is bickering over who pays for it. We need something akin to NHS because it addresses both issues. NHS isn't perfect, but it works, unlike our system.

I went to the Hospital (In Florida) because I was in so much pain I couldn't stand myself....into the emergency room wait 2 hours...fill out papers...wait another half hour...got escorted down a long hallway (I could barely walk) no wheel chair nothing..sat outside an office almost two hours while the nurses yak yaked in the office and talked on cell phones to their sweeties..the I get called into that office and there is no doctor..a nurse practicioner or whatever they are..does not examine me..tries to gvie me meds that I am allergic to..I keep telling her I cannot take those she insissts that that is ALL she has to offer me. That there is NO Doctor on duty and take it or leave it.... I got up barely able to walk again and just left...then I get a bill for almost 700 dollars for emergency treatment...Of course I call the Hospital and tell them where the bear S****s and I will not pay the bill...nor will I ever. I finally went to see a Doctor..turns out I have fybromyalgia...I'm thinking of sueing...

I'm sorry but for 9.2 mil I could open my own private hospital hire my own staff,most medical facilities treat the issues anyway with the FDA regulating everything this is why medical expenses are so high, they ad surcharges to every thing here here is an aspirin at 5 bucks a pop, my brother way in a similar predicament I his wife was said (supposedly) over dilated, tried to tell him it was a scam driving up medical cost ,they transported her 90 miles by ambulance to another hospital to give her a solution they could have given her at home they wanted to keep her there a whole mo until she gave birth but their was nothing wrong , once my brother finally realized they where driving up the medical cost he immediately took her back home ,so yeah there is no sympathy towards the medical facilities we don't need Hillary care we need reasonable medical cost.

Dear Family: If ever I am in the hospital hooked up to tubes, "dropped to 37 lbs", I cannot speak and have very little myelin sheath left to control my nerve impulses--(side note: I know I'm dead and I would like to help you)--but please don't put me on YouTube. It's just not like how I'd like the memory of me to go out.

I am sorry to know that Ms Campbell suffered for 5 yrs. As previously noted the hospital attempted to get the family to apply for Medicade. I am hoping the hospital offered Palliative Care consult to Ms Campbell and her family explaining care options including comfort care and Hospice. Ms Campbell was unable to speak for her self (maybe when she was first admited to the hospital). A public guardian was appointed. Sounds like there was disagreement (possibly among family members) on care treament for Ms Campbell. The family obviously was not capable of caring for or making decisions in the best interest of Ms Campbell. I commend the doctors and nurses who spent five years caring for Ms Campbell. Lastly, Ms Campbell was 29 years old. The mother is not responsible for her adult daughter's bills, so any small stipend the hospital may be fortunate to be reimbursed would come from the estate of Ms Campbell, which is not the mother's money. To all of us a lesson to be learned no matter your age- end of life issues are diffiuclt. Fill out your advanced directive, clearly stating your wishes. Choose an advocate who will follow your wishes. In other words they will make about YOU not about them.

There is obviously much more to this story than has been made public. Five years is a long time for a concurrent, inpatient stay! Does this suggest that the hospital could not devise an effective treatment plan? Should she have been in a SNF or a hospice center? There could be some truth to the mother's claim of malpractice....37 lbs?!? What about insurance of any kind? Why would the hospital wait two years after her death before filing its claim against the estate? Even if she did have a life insurance policy, it is not reasonable to expect that the family would wait two years before using the money. Unfortunate and odd story...

If this woman had to pay for the hospital say of her daughter, I would guess that she wouldn't have been kept in the hospital for all that time. If she had to pay a co-pay like the rest of us, she wouldn't have kept her in the hospital all that time.

BINGO! Decisions would have been made 41/2 yrs ago and we would not be reading this horrible story. If $100/day was charged poor souls like Ms Campbell would not become victims of family members who make it about themselves not about the patient.

Lets see... no insurance. That means the taxpayer is footing the bill. Would medi-caid cover 5 years without questioning the cost of service ? Did this woman threaten to sue the hospital prior to this ? What is the history of lawsuits filed by this woman ? I hate to say this, but she seems like the typical ungrateful person that expects everything handed to her, while she has no responsibility to say a simple "thank you".

Again, this is a great example of why our country is so broke. Taxpayer payments to subsidize this type of lifestyle. ENOUGH ALREADY.

We are about the only country in the world that has a pay or
die system. I think that it is terrible for any family that would
have to make a decision of pulling the plug because you cannot
afford treatment. Usually, the families involved are lower income
families with limited financial resources. The end result, the family
will be paupers for the rest of their lives. There has to be a better way.

Five years in a hospital? I'd imagine that you you didn't receive a bill within a few weeks you might be curious as to how much it's going to cost.
Did she think that the medical care was going to be free?
Also if the hospital was allegedly starving her daughter why did she wait till after her daughters death to make this claim?
It sounds a bit suspicous... this woman knew her daughter was terminal and probably did not want to discuss putting her in a hospice.

Funny that the hospital didn't bill the family regularl for services rendered and waited 5 years to send a bill. My Dad was in surgical intensive care for two months while they were weaning him off of a resperator after surgery. At the two month mark his social security benefits ran out they didn't know where to put him so they stuck him in the heart unit (which he didn't need) and he died two days later. My mom then had to file for bankruptsy because she couldn't affort even the two days of bill he was in the heart unit!!

If these charges were submitted to an insurance company such as Blue Cross, I doubt if they would exceed half of what is being billed. Every time I get a medical statement from the hospital and compare it to the insurance payment, it is always half or less. Being a PPO, I am not required to pay the balance.
