Mississippi Teen Deryl Dedmon Charged With Hate Crime In Shocking Hit-And-Run Slaying Of James Craig Anderson (VIDEO)

JACKSON, Miss. (AP) -- CNN released surveillance footage Monday showing the death of a Jackson, Mississippi man in what police and prosecutors are calling a brutal hate crime by a group of white teenagers.

A prosecutor has called the June 26 attack that killed James Anderson a hate crime because he claims the two accused teenagers drove from about 15 miles away into Jackson with the intention of finding a black man to assault. One of the teen's defense attorneys says they went into the city to buy beer because stores in their town of Brandon stopped selling alcohol earlier in the night.

Deryl Dedmon, 19, is accused of running over Anderson in a green Ford F-250 just before dawn on June 26 near a Jackson hotel. Dedmon is charged with murder and is jailed on $800,000 bond.

His companion that night, John Aaron Rice, appeared in court in July. He was previously held without bond on a murder charge, but the police detective's testimony placing away from Anderson's death led the judge to reduce the charge.

The detective testified that Rice left in a different car before Anderson was killed. Members of Anderson's family gasped when Hinds County Judge William Barnett made his decision. Rice's relatives embraced and hurried from the courtroom.

Rice's charge was reduced to simple assault and it will be sent to a grand jury. He posted $5,000 bond and was released Monday afternoon.

Hinds County District Attorney Robert Shuler Smith said after the hearing that a grand jury could consider a stiffer crime than assault for Rice and that the decision deals mainly with the bond amount.

"You never know what one of the judges will do. We know the facts support the (murder) charge," Smith said.

Detective Eric Smith testified that Dedmon had been robbed in the weeks before Anderson's death and that he was looking for "some sort of revenge," though there was no evidence Anderson was responsible for the robbery. On June 26, Dedmon and Rice were at a party when Dedmon came up with the idea to "come to Jackson to mess with some people," the detective said.

Seven people allegedly headed to Jackson in two cars, with Dedmon and Rice in separate vehicles.

The detective said Rice was a passenger in a Jeep that arrived first at the Jackson hotel off Ellis Avenue. He said Rice saw Anderson near a car and thought he was trying to break into it. Instead, it appears Anderson had locked his keys inside his own vehicle.

Rice told authorities he tried to help Anderson get into the vehicle, but the detective said an altercation took place when Dedmon arrived.

The officer said Rice punched Anderson, knocking him down, before Dedmon attacked the dazed man.

The detective said surveillance tape from the hotel shows the vehicle Rice was in leave the hotel first. Then, less than 30 seconds later, the truck Dedmon allegedly was driving ran over a curb and hit Anderson. The officer's testimony contradicted earlier statements by the district attorney that Anderson had been run over "several times."

Prosecutors say Rice is just as responsible for Anderson's death because he is accused of starting the fight.

Rice's lawyer, Samuel Martin, however, argued that his client shouldn't be charged with murder because he wasn't at the scene when Anderson was struck. Martin said the fight happened separately from Anderson's killing.

"It's not reasonable to believe that he had any idea that (Anderson being run over) was going to happen," Martin told the judge.

Rice sat stoically through most of the hearing, wearing a blue jumpsuit and shackles. Attorneys for Dedmon, who was not in court at Rice's bond hearing, have not responded to several messages left by The Associated Press since Anderson's death. During a previous hearing for Dedmon, his lawyer, Lee Agnew, said he's seen nothing to back up the "racial allegations."

I'm not often heard to say this but:

After charging ALL the meatbags involved and not just the 2 most guilty cretins:
Death Penalty for the Driver of the truck.
Plain and simple.
Eye for an Eye works for me here.

All should do time but the racist, $#@bag, that ran this poor man down?
That would make certain that his genes, and belief system can't continue on.
If he goes to jail, he'll come out holding that same hatred and, likely, blaming the victim for having to spend time in jail.

What a lovely part of the world this took place in.
Makes me Sofa King Angry.
And the fact that only 2 have been charged:
Mississippi appears to still be burning.
Maybe not enough....

As horrible as the details are that have so far been released, there is a part of me that suspects we are not being given the whole story. The whole of the south and the whole of Mississippi are imbued by their sordid pasts, allowing us to more readily conclude a racial component is more central to this than may be the case. That could be what happened, but let us gather as much more information as possible before reaching a conclusion. I cannot shake the feeling that there is more going on here than we are being told.

It is how my Christianity manifests itself. My flesh wants vengeance when I hear stories like these, but I have learned to give a lot more to Jesus. I couldn't have survived this long and remained sane otherwise.

I am sadly sickened by your response. I don't see how anyone can think that race is possibly not an issue with this whole story. I think that maybe the feeling that you need to shake is common sense trying to break through your line of thinking. I am so tired of people not being able to see race issues when they are so clearly shown. When will people open their eyes and see that racism is still alive in America?

You are also referring to when blacks gang up on whites,that is racist as well , it is not a one way street.We only here more about whites against blacks as it sells more news papers and get more media attention.Live in Chicago for some time, then you will see black on white killings, beatings etc,they do not even make the news.

Equally tragic. It didn't say in the story you attached, and however I presume - from your question and the implied sarcasm - that the victim was white, since I see that the perpetrator was black. See here's the problem with the false equivalency that you are attempting to draw. While each death is tragic, and it appears that the perpetrator in this case has been sentenced to a length of time (as he should). I am not clear what the reasoning was for this attack, do you presume that it was racially motivated? However this case appears to be the teenagers singling this man because of his skin color. That's the difference - although it really makes no difference to the victim or the family, dead is dead i would think. What also makes this case particularly disturbing is not only because of the death (hey he's dead either way), but because of the number of people involved, the psychological impact on the community, and the almost callous disregard of all involved for the humanity of this individual. See the difference?

first of all the story is 5 years old. Did you go back five years to see if it was published at that time?
second, although newspaper accounts from the time say the person who brutally attacked Mrs. Breland could be charged with murder there is no evidence that any charge was ever made.
third, you could potentially be sued by this inmate and his family. He is serving time for armed robbery and burglary, not murder. Therefore you could be sued for libel for suggesting this man is a murderer.
fourth, I could not find a photo of Ms. Breland on line, how do we know she is white?

According to WLOX's sister station WLBT in Jackson, there have been no arrests in the crimes against Breland, although 22-year-old Chancellor Christmas is said to have made a jailhouse confession to the attack. Christmas was convicted of a separate attack on an elderly person, but authorities have not been able to positively link Christmas to the use of Breland's credit card.

What everyone WANTS to happen and what is actually GOING to happen are 2 different things.

1. Those who think everyone involved should be charged with murder obviously didn't watch the video because it clearly stated that several of those involved in the beating got into a white SUV and DROVE AWAY. This happened prior to the event causing the victim's death. Worse case scenario they're charged as acomplices after the fact along with some sort of battery charge.

2. For those that think the girls in the truck should be charged with murder, you have to understand (based on the report)it's a bit unlcear they were invovled other than being present and witnessing and they certainly didn't perform the act causing the death of the victim...Murder charge out the door. If they didn't coooperate with the police when questioned or attempted to cover it up, then an accessory charge is more than likely what they would get. However, if they cooperated when questioned, more than likely they get nothing.

3. Now everyone is going to HATE this. An attorney is more than likely going to come in and use the "drinking" aspect of the story into his/her argument. What does that have do with anything??? Well being under the influence/drunk has been used to get a murder charge reduced to a manslaughter charge or a manslaughter charge down to an involuntary manslaughter charge. So you might as well prepare yourselves now for that potential outrage.

This being a hate crime the federal government will step in. Just like the police in NOLA found out really fast that dealing with the federal government is going to make the case a lot different. I hope he's prepared for that.

Did the girls try to stop the beating? Did they report the beating? Did the girls try to stop the killing? Did they report the killing? No, no, no, and no. They alone were uniquely positioned to prevent the death, but did not.

In response to the "why no death penalty?" comments -- Mississippi has its own statutory structure for determining what is and is not a death-penalty-eligible murder, and this was not one based on the facts. To suggest that Dedmon escaped a capital murder charge because of racial bias in the MS court system is incorrect (and cynical), it's a legislative threshold.

Below are the only types of murder which can be punished with the death penalty according to Miss. Code Ann. § 97-3-19:

(a) Murder which is perpetrated by killing a [law enforcement official or fireman]

(b) Murder which is perpetrated by a person who is under sentence of life imprisonment;

(c) Murder which is perpetrated by use or detonation of a bomb or explosive device;

(d) Murder which is perpetrated by any person who has been offered or has received anything of value for committing the murder, and all parties to such a murder, are guilty as principals;

(e) When done with or without any design to effect death, [while committing or attempting to commit rape, burglary, kidnapping, arson, robbery, sexual battery]

(f) When done with or without any design to effect death, [while committing felony child abuse]

(g) Murder which is perpetrated on educational property...;

(h) Murder which is perpetrated by the killing of any elected official of a county, municipal, state or federal government with knowledge that the victim was such public official.

This senseless crime breaks my heart. Why did it take 2 days for me to come across this story? Racism is alive and well in this country, although it seems like many of us like to pretend that it is not. There are some parts of this country where people still have a 1950's mindset regarding race. Perhaps that is why the story was buried. However, this story needs to be front and center to serve as wake-up call to those who try to deny the existence of racism.

Some parts of the country? I suspect the attitudes are still more widespread than just some parts. However, you are wise to see the schizophrenic-like dichotomy that is race relations in America in 2011. On the one hand these types of things happen, and the other anyone who brings up why these things still happen is immediately tagged as a "racist", "race-baiter" or "playing the race card" (whatever that really means - just some politician BS in my mind, its not a card, its a fact).

No, because as a "group" they committed battery. The act of murder occurred when the driver of the truck struck and ran over the victim (resulting in his death). In order for the group to be charged with murder, it would have to be argued that the beating would have resulted in the death of the victim had he not been struck by the truck. Only a medical professional would credible enough to testify to this and I assure you no medical professional in the world would do so at the risk of purjury charges and the loss of their license.

I thought that any death arising from the circumstances of the group act counted as Felony Murder - like the driver of the getaway car at a bank robbery where folks get killed - the driver isn't part of the group in the bank doing the shooting, but is just as guilty. The victim was run down as a result of the group attack, don't you think? I'm not trying to argue here, I'm genuinely curious.
