First Deportation Cases To Benefit From New Immigration Policy

One week after its announcement by Homeland Security, two young men in Georgia were two of the first apparent beneficiaries of a new policy aimed at making undocumented immigrants with no criminal record, a low-priority for deportation.

The new official policy --revealed August 18th in a letter by DHS Secretary Janet Napolitano to a group of Senators--echoed the so-called Morton memo, an ICE (Immigration and Customs Enforcement) statement from June 17th which outlined new guidelines for use of prosecutorial discretion in deportation cases. That document was signed by John Morton, ICE Director.

Luis Enrique Hernandez, 18, and Pedro Morales, 19, can breathe a sigh of relief after their lawyer, Lino R. Rodriguez Jr. successfully filed a petition to halt their removal proceedings. Rodriguez said in a phone interview with The Huffington Post that past cases like Hernandez’ and Morales’ “would have ended in deportation”.

“We haven’t had this argument [the Morton Memo] before, we didn’t have the tool to use. I think there would have been a very good chance that this would have ended in voluntary departure for both of them,” said Rodriguez.

While regular deportation generally bars individuals from entering the US, “voluntary departure” allows for undocumented immigrants to leave the country on their own and to be admissible for reentry under certain circumstances.

The new policy could potentially lead to the suspension of removal procedures for up to 300,000 undocumented immigrants. Thousands of them were brought as children to the United States.

Pedro Morales is one of them. He has lived in the country from the age of seven, graduated from Gordon Central high school in Calhoun, and says he will be attending the Georgia Northwestern Technical College in the coming months.

“I feel great being able to stay here, I grew up in this country. I don’t know anything about Mexico. This is my home,” he said in a phone interview with The Huffington Post. Pulled over at a traffic stop, Morales was apprehended for driving without a driver’s license and brought to a detention center, where he awaited trial for two months. According to Morales, a few of his friends have been since deported. “Their cases were exactly like mine, they were at a traffic stop. But they were deported,” he said.

During his incarceration, Morales met the other beneficiary of the new federal policy, Luis Enrique Hernandez. Hernandez was brought to the United States by his parents when he was two years old, and is currently a high school student and two-sport athlete. Like Morales, Hernandez was stopped while driving, and waited trial for over two months in the Stewart detention center. During this time, his coaches and teachers wrote letters to the authorities describing Hernandez’s moral character and benefit to the community and pleading for his release.

The Stewart detention center is a private correctional facility operated by CCA in Lumpkin, Georgia.

Sean McKenzie, who has been Hernandez’s soccer coach and his US History and Government teacher, described him as “a good ole’ Southern boy” with a “good Southern accent.”

“We had this program called ‘Steps to College’…he went with me, and he was the only kid from our school who went. He’d ride with me thirty minutes every day. We’d talk social studies, geography, whatever… He’s always got a smile on his face, one of the kids you get into teaching to deal with,” McKenzie told The Huffington Post in a phone interview.

Hernandez and Morales are “hands-down winners” because they are students with community support and without a criminal record, said Aggie Hoffman, an immigration attorney based Los Angeles. She believes the young men’s trials are indicative of what’s to come in pending deportation cases, but expressed frustration that the Los Angeles ICE in particular has been slow to act on the June 17th Morton Memo.

“I was at a lawyer’s meeting with ICE in Los Angeles only last night and it seems like their message was totally opposite of what happened there in Georgia. What are they waiting for? I’m puzzled -- this memo was released in June, and it’s already the end of August,” Hoffman said in a phone interview.

While many undocumented immigrants still await trial, Morales says he is thankful for how his case concluded.

“I feel very fortunate and relieved that I don’t have to go through this anymore,” he said.

and ever since Janet Napolitano left office as her last and finale day of being governor of Arizona 30,000's of those illegal mexican drug cartels has been smuggling more and more and more of the drugs over here accross the border and knowing the fact that they all don't have no business being here in the United States Of America because they all are not U.S. citzens?

Janet Napolitano is the reason that we have so many illegal aliens in my state of Arizona, she was governor down here back in the bush years and what did she do not a damn thing she was suppose to deport alot of illegal aliens out of here back in the years from 2002 to 2008 she still kept them here at those very hard years well she failed because all she was trying to do is to get more and more of those illegal mexicans here illegally and do nothing but break all of our Laws and draining down our Healthcare system.

Why even have a law enforcement, judical, or prison system at all??? When we keep tying their hands as to how they carry out their jobs to appease all these different human interest/rights groups? Don't these people realize: They are against everything the laws were made for, and that is to protect the rightful, hard-working, tax paying, legal citizens of this country. We who do all that are finding that these services are now being cut due to budget constraints, but our taxes don't get cut. So line up America, pay your more to receive your less.

Sugar, that is the reality. What you fail to see and understand is that these people, despite being hard-workers (which is to their credit in some avenues) are a huge part of the reasons alot of programs are being cut. By educating the children of these poor, undocumented people, the results are that class sizes are larger and the schools have to layoff teachers or take furlough days just to maintain, but I have noticed that ESL classes and such are not cut. So where's the justice for the kids in this country?? Now here's the clincher, despite all their hard work, they do not pay taxes into that system, so the cuts continue. Everyone is tightening their belts and they are tightening it on those of us who are rightful citizens.

So is our budget deficit. The vast majority of 'undocumented' immigrants cost the US more than the pittance they pay in sales tax and social security taxes. One child in a public school, one visit to a hospital emergency room, and one car accident with no insurance, and the cost far outstrips any perceived benefit.

the link you posted is not coming up...so where do you stand??? First, you post a link on how an illegal immigrant hit and alomst killed a man in MA and now you are posting this?? I see by the pic you have, you are an Air Force veteran ( a TSgt by the amount of stripes), my father was one as well, so I was raised believing in the USA. Now, not so much since the government on all levels have been content to give this country away to folks, whose first action in coming here was an illegal one, and giving rights/privileges of a rightful citizen (and that includes those who took the proper channels to come here legally and contribute to this country). I do not hate these people, and I am not against anyone coming to this country to make a better life for themselves and their families, just do it legally and all is good. From what is going on now, it is a slap in the face to all those who went through such places as Ellis Island and had to register themselves and their families (often times having to change their names to do so).

This is against our constitution. So let other undocumented people stay here. Let's give all of our jobs to illegals. Does immigration mean anything now. Why have an immigration department since it means nothing. Why be born here because someone can come here and get the same rights as people who are are illegally. What does it mean to be an Amercian anymore? Nothing. We have to speak Spanish now to even get a job. America has become a joke. There is no 'America'.

you hit the nail right on the head. If people hate the new laws coming out move. They have to understand that most of the immigration issue comes from people being dragged here as minors, with out any clue on how the society works. And yes... I would rather have an illegal work anywhere with a great attitude then a bad attiude American. Do you want to cut lawns out side in the dead of summer in Florida?? Do you want to wash dishes in a restraunt full of germs?? Do you really want any job that most of them have?? Most of you couldn;t last a day.

Our President is a disgrace. Why even detain people who have violated our immigration laws if they are released and allowed to remain here with the other millions of illegal aliens?? People have spoken and the majority of us want our immigration laws enforced and our borders secured. It doesn't matter what the story of these people are, the first part of the story is that they violated our laws and came here. America needs to take care of their own citizens first and Mexico and the other countries need to take care of their own. NO AMNESTY!

Part3: We looked at the immigration provisions of the Mexican constitution. [1] Now let's look at Mexico's main immigration law.

Mexico welcomes only foreigners who will be useful to Mexican society:

•Foreigners are admitted into Mexico "according to their possibilities of contributing to national progress." (Article 32)
•Immigration officials must "ensure" that "immigrants will be useful elements for the country and that they have the necessary funds for their sustenance" and for their dependents. (Article 34)
•Foreigners may be barred from the country if their presence upsets "the equilibrium of the national demographics," when foreigners are deemed detrimental to "economic or national interests," when they do not behave like good citizens in their own country, when they have broken Mexican laws, and when "they are not found to be physically or mentally healthy." (Article 37)
•The Secretary of Governance may "suspend or prohibit the admission of foreigners when he determines it to be in the national interest." (Article 38)

Part 2:The law also ensures that:

•immigration authorities have a record of each foreign visitor;
•foreign visitors do not violate their visa status;
•foreign visitors are banned from interfering in the country’s internal politics;
•foreign visitors who enter under false pretenses are imprisoned or deported;
•foreign visitors violating the terms of their entry are imprisoned or deported;
•those who aid in illegal immigration will be sent to prison.
Who could disagree with such a law? It makes perfect sense. The Mexican constitution strictly defines the rights of citizens -- and the denial of many fundamental rights to non-citizens, illegal and illegal. Under the constitution, the Ley General de Población, or
General Law on Population, spells out specifically the country's immigration policy.

It is an interesting law -- and one that should cause us all to ask, Why is our great southern neighbor pushing us to water down our own immigration laws and policies, when its own immigration restrictions are the toughest on the continent? If a felony is a
crime punishable by more than one year in prison, then Mexican law makes it a felony to be an illegal alien in Mexico.

If the United States adopted such statutes, Mexico no doubt would denounce it as a manifestation of American racism and bigotry.

An eye opener for all you folks pleading for these folks:

Not to mention, they do not want anyone who they may suspect as illegal, who even being arrested for a crime, subjected to have to submit fingerprints. I have to submit mine to the DOJ and even to the local school district for my job and I am a natural born citizens who has never been convicted of anything, but they are saying to do so would be considered 'unconstitutional'. How so? Our Constitution does NOT apply to them!

Law abiding people don't drive illegally. I don't care what the excuse is...if you don't have a license then don't drive. I am sick and tired of all the excuses that illegals use to justify the fact that they do break laws other than illegal entry to the US. Driving illegally is a crime. Gotta wonder what other inconvenient laws these two have broken. Not having a criminal record only means they haven't been caught....not that they haven't broken any laws.

As long as the laws are just, applied ethically, and so on...  and economies set up to reward people who study and work, then I agree with you. 

But stack the economy or laws against workers, and that is why they leave in the first place.

I am not fond of people doing illegal acts, right down to multinational corporations illegally using illegal workers to pad their bottom lines (and in turn gives them an excuse to chop wages down on everybody else.)  But if a country's country is so corrupt, that would explain people leaving it.  At what point do we nation-build others' nations, or even our own if ours becomes corrupt?

Even in the US, the fact that a $12/hr job requires a Bachelor's degree... and the cost to work to earn a Bachelor's degree is through the roof... and how even our bankruptcy system let's one discharge gambling debts but not college loans?!!!!!  Give me strength...  the whole of the issue transcends your point, even though I can't disagree with it because I am not keen on lawbreakers.  But as much as the rule of law exists, there is the spirit of the law that maintains the human factor.  Without the spirit of the law we end up with fascism.  Which is the sort of condition many workers are fleeing from, globally.

Crossing the border illegally is a crime.

Driving without ever having had a license is a crime.

Using a false name or false/made-up social security number is a felony.

Find me one illegal alien over the age of 18 who has not done at least one of these things.
