Cook County Votes To Free Immigrant Inmates Wanted By Feds

When it comes to federal immigration compliance, Illinois lawmakers have been bold in their rejection of some Obama administration policies in recent months. On Wednesday, the Cook County Board of Commissioners decided to tell the feds that if they want suspected illegal immigrants to stay in prison longer, they'll have to pay for the detention.

Before Wednesday, a federal mandate required the Cook County Jail to hold inmates suspected of immigration violations for two days longer, even in misdemeanor cases such as traffic violations and minor drug arrests. The criminal cases are then turned over to Immigration and Customs Enforcement (ICE), which decides whether or not to deport the immigrants.

The process is costly, according to Cook County Board President Toni Preckwinkle, who said the feds should cough up $142.80 per inmate, per day if they want the jail to hold them longer than needed. The ordinance gives jail officials the right to release inmates without holding them for two days extra, as long as they post bond, have charges against them dropped or are found not guilty.

The ordinance, a version of which was originally drafted by County Board Commissioner Jesús García earlier in the summer, was created in response to a federal ruling in Indiana, where a judge determined that ICE detainers are not mandatory, and counties can opt out at their will.

"It's important to recognize that this is about improving public safety, it's about serving our taxpayers better and it's about keeping families together," Preckwinkle said, according to the Chicago Tribune.

Supporters of the measure originally said that the ordinance applies to low-level offenders only, and that it would not allow violent criminals to go free. It turns out to be much more complicated than that, as the Chicago Sun-Times reported Friday:

Cook County Commissioner Joan Murphy Thursday went as far as to say she “misspoke” when she earlier declared that only those locked up on misdemeanors would be impacted.

“It’s a misdemeanor — it’s nothing, this is the people that we’re talking about that are going to be released, not anyone that has a felony,” Murphy said during Wednesday’s meeting.

“That’s not what I meant,” Murphy said Thursday. “The point is that the majority are being held for misdemeanors.”

The Sun-Times pointed to the case of Eduardo E. Sanchez, a man who was charged with a felony after allegedly punching an arresting officer after blowing a red light earlier this week. Despite the felony charge, Sanchez was able to post bond and walk out of jail thanks to the new ordinance.

“The [ordinance] affects anyone charged with a misdemeanor or felony crime who posts their bond or has their case adjudicated," Steve Patterson, a spokesman for sheriff Tom Dart, told the Sun-Times. "If they also have an immigration detainer, normally that person would be turned over to immigration authorities within 48 hours. Instead, they will freely leave the jail.”

Garcia told WBEZ the ICE detainers allow for the deportations of people who pose little or no risk to public safety, and said the judicial system would keep the bad guys in jail. The theory is, if a crime is bad enough, the criminal's bond will be high enough or a judge will require a felon to stay in prison. Supporters say those charged with offenses such as murder or rape would be held in a state prison and not be impacted by the ordinance, according to the Sun-Times.

According to WBEZ, complying with ICE detainers costs the Cook County Sheriff's office $250,000 per year. Despite the cost, opponents of the ordinance say it puts the public at risk, and ICE agreed.

"What do we do, disregard the rule of law? These people should be deported," Commissioner Timothy Schneider told the Chicago Tribune. ICE issued a statement saying that "jurisdictions that ignore detainers bear the risk of possible public safety risks."

“As far as I know, Cook County would be the first local jurisdiction in the country to quit complying with ICE detainers,” Chris Newman, legal director of the Los Angeles-based National Day Laborer Organizing Network, told WBEZ.

The new ordinance says the county will not comply with ICE detainers “unless there is a written agreement with the federal government by which all costs incurred” through the process are reimbursed by the federal government.

This is not the first time Illinois has stood out when it comes to opposing federal immigration policy.

In the spring, Gov. Pat Quinn announced that he would not comply with Secure Communities, an immigration enforcement program that shares fingerprints with the FBI and Homeland Security to detect illegal immigrants. Quinn used some of the same points as Preckwinkle and Garcia to defend his stance, saying the program often leads to the deportation of nonviolent offenders, and that less than 20 percent of Illinois residents deported through the program have been convicted of a serious crime.

Homeland Security fired back, however, saying the state's participation in the program was mandatory and that they would require local police departments to share the fingerprints.

Illinois probably doesn't even have a real huge illegal resident problem like some states do. I agree ICE should be able to get there faster but sometimes if they can't then hold them. Surely the cost isn't that bad. I don't see southern states with the biggest population of illegals complaining about this.
I agree with one of the comments before where illegals may have helped the economy years ago, but in a time where we need jobs, many don't get hired because there is cheaper labor waiting down the road at the corner of the service station.

Matthew Denise was k.ill.ed in MA by an illegal with prior arrests that was never deported because MA wont comply with the feds. So pretty much the policies of the liberal Gov't of MA lead to this persons death. Why?

Hope IL doesn't continue this nonsense and get some one k.ill.ed.

It's all about money. Cook county doesn't want to pay to hold Federal prisoners. Exactly why can't ICE pick them up promptly?

2] In the Chicago Area, and the USA, an individual NOT AUTHORIZED to be in the USA, will be free to commit another crime in the USA

And then he was deported last Tuesday afterwards.

CC and the state claim that it is a fiscal problem. Perhaps they could balance the safety of its citizens with the annual cost of providing cars to its "prized" employees.
(Also don't forget that the state just raised the income tax by 66 percent!)

That is a good deal. I hope they all move to Cook County. Then, we won't have to pay for them here.

Its going to cost Cook County big in lawsuits when one of these ILLEGALS commit a crime that injures or kills an American citizen. They refused to hold inmate for 2 days until ICE takes over and instead releases those arrested who SHOULD be deported. Yep I see some big lawsuits coming.

When I first read this I thought abt Ted Bundy...almost always arrested for a traffic violation....thank goodness some agencies took the time to check his records etc, otherwise he might still be on the loose.

Someone said earlier that immigrants were good for the economy. That may have been true 20 years ago but today this is not the case. With the drug wars, violence, welfare fraud attributed to illegals they are far from being a positive impact on our economy. We pay for their schooling, welfare, WIC, medical, kids get free meals at school. All of this comes from the tax payers. And no they are all not like this bottom line illegal means illegal they need to go back and apply to be here. Then you may say that they are contributed to our economy by having to pay taxes.

You need to get a better understanding of the UN. All this talk about rights from them and they order our President to bomb Libya usurping our Congress.

They are not protecting our human rights.

You have no idea what this country would be like today if our rights actually were protected. What we have left is hanging out there tenuously.

What we have now is a society where what we earn (our labor) is taken from us and spent on someone's pet project, their idea of charity or the destruction of other societies. And before you tell me how bad all these dictators are and that they should be bombed, go read your history and see that WE put them all in place.

Human Rights.... Please.... You are mistaking human rights for some idealist's idealogy of a utopia. What you should be focused on is individual rights because we can't take care of each other if we aren't taking care of ourselves first.

It's like when you fly and the flight attendant goes through her safety check list. When the masks fall from the overhead compartment, she tells you to put yours on first, then on children or anyone next to you having problems.

These masks are falling all over the States and our citizens, we need to get them on ourselves before we go trying to save the world or who knows what we will end up with, but it certainly will not be human rights.

Again, another post from someone who is actually defending a state government that has driven the state of Illinois into a fiscal wasteland.
Sure, the repub gov was almost as bad, but the dems have had full control of govt at all levels and Illinois now ranks second from the bottom (above Cal.) on the list of troubled states.
How did they tackle the huge state deficit? Perhaps they cut spending. NO. They postponed expenditures into the NEXT YEAR'S BUDGET!!!

Come on IL, read all the reports put out by progressives, La Raza, etc, that illegal immigrants are good for the economy. You can't claim on one hand that illegals are not a drain on fiscal resources and then blame letting them go because keeping them is causing you financial distress. I guess we now know the answer and all those previous reports about the benefits to the economy of illegal aliens isn't worth the paper it's written on. Keep this situation in mind the next time one is published.

There's illegals parking cars in places like the club owned by the ex-wife of the Dallas basketball player (forgot their names) in Bev Hills making 200.00 to 800.00 cash per day....The valets have to pay under the table the head man then the head man has to pay the other head man but the valets still keep 80%.........Google: illegals parking cars and maybe it will come up..........It's all over big and small city all over the country (in 5 star hotel, country clubs, etc)

I think the Federal government should pay for keeping them. Like AZ and GA, the people of IL can't afford to basically subsidize the Federal Governments failure to secure the border, as well as enact laws/policies that make it impossible for illegals to be hired/work/receive benefits here in the US. Once all the liberals from states that have not had the Illegal Roadshow come to their part of the country yet have to start coughing up money to pay for them, we'll see a crackdown on illegal immigration into the country.

The "people" (i.e. dem state and local govts) could easily afford the $250k per year of this cost for public safety if they (the dem govt) didn't totally overspend and also REFUSE to cut spending ANYWHERE to achieve some fiscal sanity in Illinois.
