Michigan Legislature Passes 'Partial-Birth' Abortion Ban

WASHINGTON -- Michigan lawmakers passed legislation last week that will ban "partial-birth" abortions, which have been federally outlawed since 2007 and have not occurred on record since then.

The state-level ban -- sponsored by Republicans -- is modeled almost exactly after the federal ban that George W. Bush signed in 2003 and that the Supreme Court upheld in 2007. Doctors who perform the procedure, in which the fetus is partially delivered before being aborted, would face up to two years in jail and a $50,000 fine unless they can prove the mother's life is in danger. Democratic opponents of the measure tried to amend it to include exceptions for cases of rape or damage to a woman's health, but those proposals were voted down.

Since the federal ban was upheld in 2007, there have been no charges of partial-birth abortions in Michigan or any other state, according to the American Civil Liberties Union. Only a handful of doctors in the country will perform the procedure to save a mother's life, and none of them reside in Michigan.

The term "partial-birth" abortion is not in medical textbooks and is a political term coined by the National Right to Life Committee in 1995. The medical and political communities have argued for years about what exactly the term means and at what stage of the pregnancy it occurs.

Opponents of the Michigan law say the ban is a purely political attempt for Republicans to mobilize their base by evoking a highly sensitive, emotionally charged issue.

"It's a very gruesome thing to talk about, so it really riles up their base," said Shelli Weisberg, legislative director for the ACLU of Michigan. "They use this description of a procedure as a basis for getting their people to get invested and give money and call their legislators in ways we can't seem to do on our side, in terms of protecting a person's freedom for medical choice."

State Rep. Phil Cavanagh (D-Redford) said on the House floor that while he agrees that partial-birth abortion, as described, is a "horrific procedure," he wishes his conservative colleagues would focus on jobs and the economy instead of banning something that is already illegal.

"House Bill 4109 and 4110 represent all that is wrong with our political system,” he said. “Instead of working on legislation to bring jobs back to our state, diversify our economy, promote public safety or improve the quality of life in our communities, we are wasting time enacting legislation that duplicates existing federal law so that House Republicans can have talking points come next election cycle."

But the bill's sponsor, state Sen. Goeff Hansen (R-Hart), said the duplicate law was necessary to establish sentencing guidelines for offenders and to help Michigan's prosecutors and local police departments enforce the law, since the FBI does not have the resources to do so.

The result, Weisberg told HuffPost, is that Michigan prosecutors could begin to more aggressively poke into women's private medical decisions and that doctors will be reluctant to perform life-saving abortion procedures for fear of being sent to prison.

"Our fear is that it will embolden some overzealous prosecutors to begin trying to monitor operating rooms, or to go after women that have already had abortions," she said. "We certainly have overzealous prosecutors in Michigan, so we are worried about this further encroaching on women's medical privacy and reproductive health rights."

The bill now heads to the desk of Republican Gov. Rick Snyder, who has indicated that he will likely sign it.

They also think the ban keeps fetuses "alive" when all it actually does is cause doctors to use an older method with a higher chance of dmaging the woman's womb and preventing future children.

Which is a crying shame since less than 1% of abortions happen after 20 weeks and if you got that far its virtually certain that the reason to abort is medical, not elective.

Which means you want a child. But if your womb is torn up because they weren't allowed to use the safest method to end the failed/life threatening pregnancy you won't get a chance to try for one.

So basically its a bill that randomly maims women for having pre-eclampsia or fetuses with the organs on the outsides of its body or whatever tragedy lead to the late term abortion. Ending not just that pregnancy but pre-emptively aborting every one that would have happened after.

A fetus that dies within the womb must be removed this way, but this law would require a police investigation "in case" foul play was involved. It is amazing how these men are trying to give a dead fetus more rights than a living woman.

Actually, when a fetus dies in utero, the body will naturally go into labor (usually within 2 days) and the baby will be born that way, stillborn. Or, if the mother & doctor chooses, she can be induced at the hospital. A dead fetus does NOT have to be delivered this way.

Georgia, State Rep. Bobby Franklin wants to criminalize not just abortions—but miscarriages as well. His 10-page bill would make any “prenatal murder” a felony punishable by death or life in prison—and that includes miscarriages, in the event the woman cannot prove that there was "no human involvement whatsoever in the causation" of her miscarriage.

The soviets had the Red Terror. Now we will have the Fetus Terror. The above would require a police state as every miscarriage, still birth, false pregnancy, and every accusation of abortion will require a police investigation which would put the burden on the woman to prove her innocence rather than what presently exists where the accused is innocent until proven guilty.

Soon women will lose the right to their own bodies and will live in terror.

Imagine that! The FBI does not have the resources to check on the contents of every uterus in Michigan, nor to read every female resident's medical records every day... what is this world coming to?

Hey -- is this part of the jobs agenda? Is the government going to have a government representative standing around the ER or the L&D rooms, watching all deliveries to make sure there are not any accidental abortions, miscarriages, or damage to fetuses. You could do what Georgia did and make all miscarriages illegal and investigable, arresting women who have had miscarriages until they PROVE they were miscarriages. This is the jobs agenda the repugnicans promised us. Next ban: Birth control.

To force a woman to give birth is on the level of forcing a person to be attached to another and serve as a kidney dialise machine, or to force people to hand over a kidney as they have two.

For those who are against late term abortion. Would you allow an abortion if the fetus was found to have Anencephaly?

Very true! When the deck is stacked many "pro-lifers" and conservatives get abortions if they feel like they need to. Almost half of all women will have an abortion in their life time and they are not all "libs". There have even been abortion protesters who have gotten abortions but then go right back to protesting. Over 90% of women who have a fetus with downs syndrome have an abortion, regardless if they consider themselves pro-life or pro-choice to begin with.

I mentioned this condition along with a host of other non-viable complication to a "pro-lifer" and he/she called it lies. They refuse to accept biological facts.

(They also didn't like my picture of "Buddy Christ" from the Kevin Smith movie Dogma. I was amused.)
