Casey Anthony Jail Video: Florida Judge Delays Decision On Controversial Footage

A Florida judge Wednesday recessed court without delivering a decision about the possible release of a video that shows Casey Anthony's reaction when she learned her daughter's remains had been found.

Orange-Osceola County Chief Judge Belvin Perry Jr., the same judge who presided over Anthony's murder trial, listened to arguments from Orlando media outlet WKMG-TV Channel 6 and Anthony's attorney, Jose Baez.

According to CNN, Baez argued that the Health Insurance Portability and Accountability Act prevented the tape from being released because Anthony was receiving medical attention when it was recorded.

WKMG attorney Jack Kirschenbaum argued that the tape is part of public record because the regulation pertains to medical data and not treatment, the International Business Times reported.

The footage was recorded on Dec. 11, 2008, the day two-year-old Caylee's skeletal remains were found. The discovery was made some six months after the little girl was last seen, and two months after a Florida grand jury indicted Anthony on first-degree murder charges.

The video reportedly shows a visibly distraught Anthony suffer an anxiety attack.

In June 2009, Judge Stan Strickland sealed the video because he did not want potential jurors to see it. This June, after a jury was seated for Anthony's trial, WKMG-TV filed a motion to unseal the video, saying it could no longer prejudice Anthony's right to a fair trial.

On July 5, a jury of seven women and five men acquitted Anthony of killing 2-year-old Caylee, but found her guilty of lying to investigators. Credited with time served, Anthony was released from jail but ordered to complete a one-year probation term.

After listening to both sides Wednesday, Perry recessed the hearing without ruling.

After the hearing, Chief of Due Process Services Karen Connolly Levey would only say, "Judge Perry will not be issuing a ruling on this matter today." It remains unclear when he will do so.

Jose Baez did not immediately respond to a request for comment from The Huffington Post.

If the person who put the victim in harm's way and death occured because of that act, it would be that person who was responsible for their death...the second person would be charged with improper disposal of a body or a similar charge.

1. failure to call 911 to report a drowning
2. removing evidence from the scene of a crime where a death took place
4. perjury and tampering and planting false evidence
3. lying to obstruct justice and mislead LE investigations
5. conspiracy

The video is out..TMZ is already posting it. I watched it...no big deal. Grainy footage of CA watching something off camera (the tv, suppoedly) then putting her face into her hands, obviously upset over watch she saw.

You might want to review the facts, "Bubba"...according to her mouthpiece (Bikini boy Baez) she KNEW her daughter was dead...knew from June 16, 2008. How the baby's body got into the swampy woods is anyone's guess, but whoever put it there wasn't very smart to think it would never be discovered.

At the time this video clip was taken, CaA was still maintaining that her daughter had been kidnapped by the fictitious nanny. The whole 'drowning in the pool' story woulnd't come out for another 2 years.

Incredibly poor quality. Why tape at all if this is the end product?

Still, you can see her chest heaving. Clear consciousness of guilt in my book given that she supposedly had no idea whose remains these were yet she had already supposedly told Baez Caylee was dead. She showed no reaction when hearing remains may have been found in Blanchard park.

Question: Was the first part shoot in the clinic waiting room or the clinic itself?

Question: How long before Baez arrived and had she been medicated already at that point?

I saw a woman wearing what I thought were scrubs enter and go off into a room adjoining. However, X was led out through that right (in video) door, prior to receiving the medication--that would violate the Hippa I suppose--releasing that part of the video--if there are cameras in the clinic.

Baez was not allowed to enter while her reaction was filmed. He was livid about that. X appeared somewhat sedate when we do see him arrive--guessing at least 20 min. after medication?

I'll tell you what I think. I think that x did an awful lot of talking, Baez an awful lot of listening, [looked concerned with his hand to his forehead several(many) times]. If x were truly upset about the findings I would think that Baez would have shown her some comfort, if even briefly, but I saw no signs of a person comforting a grief stricken person, only an attorney who seemed very nervous and concerned, and x who did almost all of the talking. What was she explaining/saying, I don't know, but she didn't require comfort.

I watched it..It was so fuzzy..you would think it would be clearer, being inside there in jail..clean your camera lens..but, i dont see anything about this that says any thing at all one way or another..she was told her daughter remains were found..what did they expect..sit there storic.? i dont get it..?

No, she was told some remains had been found. They were not identified for 8 days. And if her atty told the truth - she already knew her child was dead. What interested folks was the very fact that she didn't know whose remains they were...and when what were thought to be remains found at Blanchard Park - she had no reaction. The reaction appeared to be the location of the remains - since they were not identified at the time.

I didn't see anything that was "egregious", as even the prosecution claimed. (ABC new article). Did you? But this vid is only 2:24 minutes and the full is close to 15 min. Video is of poor quality and not much to "study" perhaps?

Bugged me that the later half seems to show Baez and X--but it breaks...first with coat on he sits, then, a color vid with his shirt off. He had claimed that the staff would not allow him to enter and speak with X...yet when was this part of the video taken?

Yes, I did notice her chest heaving--took the 3rd video. It was pretty powerful heaving. Hives too.

I am wondering if Baez did not touch her because it was against rules--even though he touched her before--or was it later when all the touching occurred? In this video he seemed to be weary, he was touching his face often. I could interpret that many ways...he thought he was SOL. That may be another reason he didn't want it viewed.

The more I think about it, I find it incredulous it was not permitted as evidence. Ashton, if he has not already included this in his book---I hope he now adds the chapter.

Ok, now I've watched this one with the commentary. I rechecked that ABC article..may have had it confused with another article that said the prosecution wasn't going to use this video (and I wondered why not!) In this link you provide, they say the prosecution DID want to use it but it defense made sure that it was not.

I do wonder about that.

All of the evidence needed to convict this murderer was not allowed in this case. Had this video been seen and the jury known she did not react to the remains found in Blanchard Park in this way, because she knew Caylee wasn't there, they would have undoubtedly convicted her. She was one lucky murderer.

She claims Caylee drowned in the pool on July 16th...why would she only now be distraught if she already knew the baby was dead months earlier, maxom? This was in December, her defense was that the baby drowned in July.

Here lawyer agreed with the prosecution on the date of death, also keep in mind the defense was trying to show how an accident was a possibility, not someone else killed her, if Baez would have gone that route it would have been a he said she said arguement and given the fact the proof of her already lying to police would have given the credibilty to the other, she did not state herself that she knew that Caylee had died the 16th, and say what u will about Baez, if he lied to keep an innocent person alive I give credit rather than to tell the truth to see an innocent person die, whether it be against the Bar code ot ehtics or not.

I hope I don't get slammed for voicing my opinion here but, I believe it's very possible that her story that child drowned is true. With saying that, I also believe she is a horrible person and should go to jail. She's lied the whole time and has shown no remorse.
