THE HAGUE, Netherlands -- A Dutch court refused Friday to grant Samsung an injunction banning Apple from selling iPhones and iPad tablets in the Netherlands, dealing the South Korean electronics giant a defeat in its global patent battle with its American rival.

The civil court in The Hague rejected Samsung's argument that Apple should not be allowed to sell devices such as tablets and smartphones that use 3G mobile technology patented by Samsung because the Cupertino-based company does not have licenses to use the technology.

In Friday's ruling, the court said that because the 3G technology has been accepted as an industry standard Samsung is obliged to offer Apple licenses under "fair, reasonable and nondiscriminatory" – or FRAND – terms.

The court said in a statement that the licensing fee Samsung sought from Apple "was so far out of step with the obligation to make a FRAND offer that it can be concluded that Samsung is not genuinely prepared to enter a FRAND license agreement with Apple."

The ruling added that if Samsung makes Apple a fair and reasonable offer for a license fee and the companies still cannot reach agreement then Samsung can file a fresh patent dispute injunction request.

At a hearing last month, Apple lawyer Rutger Kleemans claimed Samsung sought the injunction to "hold Apple hostage" because Apple had accused Samsung of copying its iPhone and iPad designs in a separate Dutch case.

"It's a holdup," Kleemans said. "Because Apple dared to take action against Samsung's copycat tactics."

In April, Apple Inc. sued Samsung in the United States, alleging the product design, user interface and packaging of Samsung's Galaxy devices "slavishly copy" the iPhone and iPad.

Samsung Electronics Co., based in Suwon, South Korea, fought back with lawsuits of its own, accusing Apple of patent infringement of its wireless telecommunications technology.

Though of course it's completely legal for companies to pursue injunctive measures against their competition, I am ambivalent; is it ethical for corporations to use patent infringement merely as an anti-competitive tactic, or should these disputes be settled in the marketplace, where they belong?

This is starting to sound like dueling brothers. Apple being the younger, but more ambitious of them. Samsung trying to make the rules and stick to them. (Don't care who came first)

Your cannot patent a chair, cup or car in such a way as to exclude others. The issue before the court is are other tablets significantly different from Apples. I suspect when it is all said and done Apple will lose.

People are mixing emotions on different facts here. Patent laws are in place so you can make all the money off of your ORIGINAL design for several years, then the patent is free to copy. Now if you hate Apple for their Foxxconn Factories and with their profits can still see profits by manufacturing here in the states, fine, agreed. But Samsung ripped off the whole design of the phone and user interface and expect to be considered Original and legal and hadn't waited the legal wait period. Take the huge conglomerate out of the equation and ask yourself, as an individual, if you designed something and patented it, would you want another person using that design to make money and potentially steal some customers away from your product? Samsung is scrambling and so upset they don't have the creative minds working for them so they resort to a failed blackmail court case.

Samsung and Korea are great at copying, great at it. What Samsung did was take the wireless issue to court to react to Apple's suit for virtually copying the iPhone and iPad. Samsung is going to lose these and may lose the patent case Apple brought against them. I believe they did in Australia. There are no rules in Asia.

I found the following quote some place a while ago, glad I saved it. If anybody gets on Apple about FoxConn, send them this.

FoxConn clients include the "who's who" in the tech industries­: Apple, Acer, Amazon, Intel, Cisco, HP, Dell, Nintendo, Nokia, Microsoft, Sony, and Motorola. To the extent that Apple is culpable for the poor treatment of workers at FoxConn plants, so to are the before mentioned companies.

I'm on Apple's side in this because they are an American company and Samsung is not. It's strange that because of the fierce loyalty of some to their phones, they would rather see a Korean company win this.

Since the US is being sucked to a dry carcass by "Wall Street" and kids can't afford college, assuming they have any motivation left after vegging in front of the TV for 15 years, prepare for a future where China, et al own all the intellectual property on the planet.

Wrong China does not own and will not own the intellectual property unless they file that in each country or countries that have reciprocating agreements if there even are ones. There are not the same laws in Asia as the US/Europe and other countries have.

Apple makes lousy idiosyncratic products that follow Steve Jobs' view that Steve knew best, and you should be honored to empty your bank account for everything he deigned to sell you. If it doesn't suit your business or personal model, then Steve Knew Best and you need to change your model. I have an iPad and just went through the messy upgrade and what did it give me? New tools solely to get me to buy stuff! I had a Samsung Omnia for a year before the first iPhone came out, and even running Windows Mobile 6.1, it still did everything the iPhone did, cheaper, in a more compact package, with a far better phone. I now have a Galaxy Phone and, having the iPad, wouldn't trade the Samsung for an iPhone. The "Look and Feel" Apple is claiming was actually on the Omnia first! I bought the iPad because Samsung doesn't yet have theirs in 3g, only Wi-Fi, and I do use my iPad frequently where I can only get cell service. Samsung also needs a stronger app base.

Why change your model? Just change your phone. One person said he uses a Windows phone so he can sync with his Office products for business. Great, terrific. He's practicing free will and buying what works for HIM. Apple owes you nothing except to ask you to figure out what works for you and take responsibility for the choice you make.

This is True. The same thing happened to Microsoft. Heck we should all return to using Amiga's They had 25 brands of word processors, 35 kinds of Paint Programs. Somebody please combine an Amiga with Petscii and Atariscii and all the special Graphics keys of the C64 and the graphics modes of the Atari 800 for an Android an Ipad and a Kindle Fire and Nook Color and rest of smart phones. Remember the Standards wars of the 90's that was a fun time.
