Alabama Immigration Law: Opponents Rally Around Deli Owner, Latino Workers

Last week HuffPost told the story of Steve Dubrinsky, a Birmingham deli owner who was pilloried by strangers for defending his Latino workforce in an interview with the Birmingham News. Dubrinsky had told the paper that even documented Latinos were scared of Alabama's sweeping new immigration enforcement law, and that many legal workers would end up leaving the state because they no longer felt comfortable there.

Outraged by Dubrinsky's support of immigrants, strangers flooded his inbox with threats to boycott his restaurant, Max's Delicatessen. Typical of the missives Dubrinsky received: "I hope your unamerican establishment closes down!!!!" His restaurant suddenly received dozens of negative one-star reviews on Google, mostly from anonymous first-time posters.

But since late last week, Dubrinsky has witnessed an outpouring of support from a different set of strangers. After reading of Dubrinsky's plight, opponents of the new law have rallied around his deli, leading to one the busiest stretches at the restaurant that Dubrinsky can recall. He tells HuffPost that new diners have been driving from up to forty miles outside the city just to try his reuben and thank him for standing up for Latino workers.

"I've shaken more hands in the last two days than in the previous two years. It's been amazing," Dubrinsky said. "The restaurant has been pretty darn busy."

One reader told HuffPost that her friend had visited Max's this weekend to show her solidarity, but it was so busy the woman had to go eat elsewhere. Another reader from Georgia told HuffPost that she and a group of friends were putting together a caravan to travel to Max's from Atlanta just for lunch.

The restaurant's Facebook page has been inundated with fan requests from all over the country, Dubrinksy says. Rather than bashing him and his workers, visitors to the page have been telling the staff at the Jewish deli to stand tall: "Thanks for being a mensch, Max's Deli. Hang in there and I'll be bringing my very hungry teenagers to your deli the next time we're in town."

His score on Google, which had plummeted to 1.5 stars, has climbed back up to 3.6 thanks to positive reviewers.

Among the many emails Dubrinsky has received was this one from a Nevadan: "I'm sure this has been very difficult for all of the employees who work at Max's, and their families, but reasonable people have to stand up on this issue instead of spewing hate. I'm sorry that I live in Nevada -- too far to support your restaurant -- but if I'm ever back in Birmingham, you'll be my first stop!"

When he spoke out against the Alabama law, Dubrinsky was wading into controversial territory. The law -- the toughest of its kind in the country -- authorizes police to demand documentation during a stop if they have "reasonable suspicion" someone is in the country illegally. Although hard-liners have praised its harsh measures, many business owners have said the law has already led to a labor shortage in certain industries.

Several of Dubrinsky's Latino employees have told him he should look for replacements. But just as many farmers have had difficulty finding non-Latino workers to pick their fields for modest pay, Dubrinsky hasn't had much luck finding non-Latino workers who will toil in his kitchen at an entry-level wage. "It's easier said than done," he said last week.

The show of support hasn't fixed any staff problems Dubrinsky may face, but it has lifted his spirits after a week of feeling embattled. It's also convinced him that many people in Alabama and beyond share his worries when it comes to the new law.

"Last week I was thinking I was on the wrong side of this issue," Dubrinsky says. "Now, I don't. It's clear from the response that there are far more people concerned with this law than you would think."

There are thousands of culinary graduates happy to take these jobs but they are going to want shocking things, like a lunch break, a 5 day workweek, OT pay when appropriate.

Restaurant owners often want slave labor and frightened immigrants allow them to have it.

Bullshit.

You find one ONE culinary grad willing to take an entry-level job at a no-name deli in the middle of Alabama and I'll buy you lunch. Culinary grads do not want these jobs, and they shouldn't really. They've gone to culinary school to AVOID this path.

I've worked in a deli surrounded by legal Latino workers and they got breaks, lunch breaks, regular hours and overtime. Just like every employee. You're judging the whole industry based on a handful dishonest owners and you're so full of crap your eyes are brown.

I've notice a trend lately (which even Mitt Romney is guilty of) to dehumanize people by calling them "illegals." Not "illegal immigrants", just "illegals". Either the people using this shorthand never learned their grammer that "illegal" is an adjective, not a noun, or there is a real campaign out there to take the humanity away from people, all the better to mistreat them. We've stopped using shorthand to describe Japanese people, Italians, and African Americans, let's not start it with this group.

Cant comment on the Mitt thing, but the left media certainly stopped the term "illegal" and now uses the catchy phrase "undocumented immigrants". Clever huh? Stop worrying about labels and peoples' feelings and start concentrating on the immigration laws these people are breaking.

I propose the following be the definition of "due diligence" when hiring anyone, whether citizen or legal immigrant. The employer shall be required: 1) to verify identification and all legal work documents with the federal government and receive a specific, signed authorization from INS verifying the validity of all documents 2) shall conduct a thorough background check on all potential employees verifying not only their eligibility to work, but also the legal status of every member of their household and all known associates. No person who is, is related to, knows or has routine (once a week) contact with any person who is or knows and illegal immigrant shall be deemed ineligible to work or conduct business in the United States. This provision shall apply to citizens as well as immigrants. No half measures. 3) Routine drug testing shall be required for all employment and at the time of all bank transactions in the United States. Results shall be reported directly to the DEA for potential enforcement response. 4) Due to the fact that disloyal factions within the United States, possibly affiliated with al Qaeda, will have an interest in diminishing the effectiveness of this policy, it shall be illegal for any person or organization to express any opinion critical of this law. Anyone who utters any disapproval of this law will be stripped of all assets and executed. Any corporation that supports any criticism of this law shall be dissolved and its assets sold.

Okay, I propose the following:

Whenever unemployment is above 7% in this country, it shall be ILLEGAL on penalty of forfeiture of ALL assets, revocation of citizenship and loss of all right to conduct business within the United States if any individual or employer is found to have hired any non-citizen, legal or illegal, to do any labor no matter how short-term or low-level.  Funds from seized assets shall be applied against the deficit, specifically INS or any other immigration enforcement budget.

This shall apply to any and all persons and corporations.  If any business, no matter how large, is found to have hired any immigrant, legal or illegal, during the blackout period...or any illegal immigrant at any time...the entire corporation shall be seized and sold off without possibility of appeal or reversal even by the Supreme Court (yes, this will require a constitutional amendment...we'll keep it simple and start with a law that can potentially be set aside by activist judges.)

All persons in the business found to be anywhere in the chain of decision to hire the illegal, up to the CEO who will be deemed personally responsible for all hiring, shall be stripped of their citizenship and held incommunicado until they can find a country that will take them.

BiggPuss; Apparently you did not read the article and hopefully the agents in the Atlanta ICE office have an intellectual capacity one or two points above yours as a raid on the deli could prove incredibly embarrassing when it is discovered that ALL of the workers at the deli are documented and legal! Dubrinsky's concern is that his totally LEGAL employees have indicated that some of them will be leaving the state and he will have to find new employees that are as hardworking as the ones he already has.

I'm sure you'd sing a different tune if you had to carry YOUR papers and birth certificate on you at all times, and even then you could get arrested if one of the Barney Fife officers thought maybe those papers were "forged."

I hope one day the Native Americans take back their land and make all the pale faces carry papers.

And BTW, I'm a pale face, but I think it would be completely appropriate.

I think it's fair to say we will not agree on this issue as our view of things is just to far apart. I respect your right to stand by your opinion as hopefully you do mine and mine is this; should there be an effort to focus on illegal immigration and resolve the issue? Yes but not to send them packing but make them legal US citizens. Maybe even give the option, help them through the process to become legal or go home. My belief is that people come to the United States for a better way of life (naive maybe) and as human beings we should help achieve that goal. The rest of my opinion is this, the law was written in a knee jerk fashion. If I were a policeman, I could ask anybody for documentation that has an accent or is something other than Caucasian. A good friend of mine is from Bosnia. She came here as a refugee and it took 5 years before she was sworn in and became a US citizen which she did 12 years ago. She still has a very heavy accent. Would someone ask her for proof?

Fortunately, this problem solves itself.  When Americans are unwilling or unable to do the work that immigrants do and you kick out all the immigrants, the work won't get done and the local economy will fail as it should.

I have no problem with this.  I also have no problem with saying screw it, we don't care one way or another about people's immigration status, we just want the best people we can hire.

Either or is perfectly fine with me.

Yes, you are correct. Mexicans come in droves across our border for a better life. But having lived amongst them for many years in California I am aware that they only want the better life. They have no intention of becoming American citizens. I remember a fellow student telling me that our exams would be easier for him if they were presented in his home country's language.(Mexico) I did feel compassion for him(being a recent immigrant, or so I thought) until further conversation revealed that he was fourth generation to be living in this country. He was in fact (despite his heavy Mexican accent) born in and grew up in San Bernardino, California.. His home country (is the United States) and the language of his home country is English! However, he and the rest of his family refuse to become Americans!!

Interesting JShankel, but I think I would not be afraid to bet my "reading comprehension" is superior to yours, lol=) First of all, he DOES indicate that immigrants are leaving the state, and several of his workers have said they might do the same due to the possibility of the new law. HE is being UN-AMERICAN in that he is fabricating nonsense at the expense of LEGAL AMERICAN CITIZENS! AND, those that threaten to leave his place of employment, and the state are doing likewise. So, being that you are such an incredible LIBERAL, go read a book and find where it says, that BLACK AMERICANS started leaving the states or going back to Africa when our country was burning with anti-Black issues? Nope! Because Black WANTED to be a part of The USA and also fly the American Flag and therefore, REMAINED and fought with blood, sweat and tears, to the point of today there is a Black President (Even though he is not that good, NO fault to the color of his skin!). Someone should check Dubrinsky's status. Anyone who harbors and provides aids a criminal is a criminal themselves. These "feel good" stories are really a huge part of the problem. And illegal immigrant is a criminal period. Not just in some states or cities but in the whole country. Just because this man chooses to not pay a livable wage so that HE can make more money makes him just as wrong as the man who sneaks into the country.

Good question. How DO YOU KNOW what wages he pays? If he paid a decent wage he would have Americans working there. I live very well because I turn in to ICE any illegal or any person that hires illegals. So I live well. How do you live with yourself defending criminals? Are you a lawyer?

I have to agree (not) with certain republicans...we have no one but ourselves for the mess we're in....

And I'll tell you why I say this....We have allowed the "Know Nothingers" to lead us down the road to distruction, we are letting the republicans rape us, hurd us, tell us what to think and soon jail us on charges they have fabricated. They have passed laws to enforce the law of their wills. Like using the Active US Army to put down Civil Unrest (OWS) or patrol our boarders.

Operative words here are documented and legal and is the reason that this law is seriously challenged because a great many Mexican immigrants are documented, legal or even citizens but now they will be targeted simply because of race. There is a serious equal protection issue here if this law is not applied to "everyone" i.e., white, brown,black, people who speak with accents et. al

This is the paradox for the "legal immigration" crowd - they fail to apply that same concern with "legality" to laws that may potentially be unconstitutional. This failure offers camouflage for the inherent racism of some because "we just want laws respected." Tell that to the Alabama farmers of Alabama and please don't begin with they don't pay taxes the IRS has a different story.

You remind me of a overbearing boss I once worked for. He was German, (in every sense of the word and being). Most people would not consider me of Hispanic decent, (I am). One day he was trying to have some fun with me and asked me if I had my green card. I had some fun with him, I replied that I had swimed across the Rio Grand and jumped the fence like every one else. He walked away in a huff. LOL
