Arizona Immigration Law Day Laborer

PHOENIX — Groups opposing Arizona's immigration enforcement law have asked a federal judge to put a stop to a section of the statute that bans the blocking of traffic when people seek or offer day-labor services on streets.

The Mexican American Legal Defense and Educational Fund and other opponents filed a preliminary injunction request on Friday seeking to block enforcement of the provision, saying it unconstitutionally restricts the free speech rights of people who want to express their need for work. The request was filed in an existing lawsuit by the groups.

The state can't justify the statewide ban based on scattered instances of solicitations creating traffic problems in Phoenix, they said, adding that there are already laws on the books to deal with people who block traffic.

The ban was among a handful of provisions in the law that were allowed to take effect after a July 2010 decision by U.S. District Judge Susan Bolton halted enforcement of other, more controversial elements of the law. The blocked portions include a requirement that police, while enforcing other laws, question people's immigration status if officers suspect they are in the country illegally.

Gov. Jan Brewer has asked the U.S. Supreme Court to overturn Bolton's ruling after she lost an appeal in a lower court.

Brewer's lawyers have also opposed attempts to halt enforcement of the day-labor restrictions, which they argue are meant to confront safety concerns, as well as distractions to drivers, harassment to passers-by, trespassing and damage to property.

They told the court that day laborers congregate on roadsides in large groups, flagging down vehicles and often swarming those that stop. They also said day laborers in Phoenix, Chandler, Mesa and Fountain Hills leave behind water bottles, food wrappers and other trash.

Bolton previously denied an earlier request to block the day labor rules, but opponents were allowed to bring it up again after the 9th Circuit Court of Appeals ruled on a similar issue in September.

The appeals court had suspended a law from Redondo Beach, Calif., that banned day laborers from standing on public sidewalks while soliciting work from motorists. The court ruled the law violated workers' free speech rights and was so broad that it was illegal for children to shout "car wash" to passing drivers.

This is why i do not buy my produce from the super market. I buy it from a local farm here in the area i live. they set up a little store of their own and sell pretty much anything you might need as far aas veg and fruits. and i am giving my money to a local. a neighbor, not a big chain grocery store.

This is just silly. There are plenty of laws on the books to deal with illegals. The problem with the Arizona approach is that it is overbroad. (You American "purists" won't get that until you can't stand in a parking lot and talk to your neighbors without being told by the nice policeman to 'move on' - and that won't happen to you unless you "look" like an illegal). This thinly veiled bigotry won't stand up to the Constitution these people pretend they support.

How many people in AZ, who are out of work, are rushing to fill all the jobs the illegals "steal"?
Not too many. Same is the case for Georgia and Eastern Washington State.

See, "Legal" Americans would much rather sit at home and complain about the high price of produce & how all the "illegals" are "stealing" the jobs, than to actually go out and work these low paid, crappy jobs.

Like it or not: America isn't the "victim" some would like to make her out to be. Legal Americans/business owners KNOWINGLY hire "illegal" workers. "Illegal" workers dont wake up one morning and decide its a great day to risk their life by sneaking into America just so they can rip the American tax payer off!! Its the LEGAL Americans who SET OUT and SEEK to rip the tax payer off by GIVING "illegals" jobs!

I support living wages for those who work the jobs that are valuable but pay the least, along with amnesty for all working "illegals" or a guest worker program.

That said, any business that knowingly hires an "illegal" should indeed be fined and forced out of business.
My frustration is for the "legal" Americans who evade taxes by hiring 'illegals' for the jobs "legal" Americans ARE willing to work. Contractors with HUGE bank accounts do it so they dont have to pay the 'going rate' for framers, flooring installers and painters. Major retail chains hire illegals and dont HAVE to give them annual raises, paid holidays, sick leave & vacation. And honestly, "legal" Americans have been hiring "legal" Americans & paying them "under the table" for YEARS!

Many of the jobs "illegals" work are the jobs "legals" wouldn't even consider working because the pay is too low for the labor. (How many women do you know who are willing to clean houses for 9.00 ph, no benefits? or willing to pick produce in 108 heat for $7.25 ph? and NO, we shouldn't be "more willing" to pick apples in hell heat or change an 88 year old's diapers for min wage!)
I dont believe there's one single solution, but I do know that if we didn't have a market for "illegal" employment, as well as drugs, "illegals" crossing the border wouldn't be an issue.

You simply can not answer my point. People illegally entered this country and committed varying degrees of crimes. Be that crime murder compounding the initial crime of entering the country ,rape compounding the initial crime of entering the country, shoplifting compounding the initial crime of entering the country or the single crime of entering the country illegally oh wait that is NOT a SINGLE crime after that they have to get fraudulent ID (a federal crime).That fraudulent ID USUALLY means stealing someone else’s identity. (that means ruining a citizens life). These are serious issues. Even the “non criminal” illegal’s are committing crime(more than one in fact). SO having said that these people should not be here . And you continue to “say yes there should be punished” but you do not say they should be removed. And because I and millions of other AMERICAN CITIZENS want these law breakers removed(as its not our financial problem to deal with them) from the country we are racist. That is just nonsense.

You refuse to answer this and it is paramount to the issue. Why do you refuse to acknowledge the valid points I and others have made.
If we(meaning law abiding citizens before someone puts a spin on that) want rapists dealt with its not a problem. If we want embezzlers dealt with it is not a problem. If we want drunk drivers dealt with it is not a problem. If we want petty thieves (pick pockets shoplifter­s etc) it is not a problem. If we want pedophiles dealt with it is not a problem. Heck if you pass bad checks you get arrested. However if we want people who entered this country illegally dealt with suddenly we are racist!!?!?I do not understand why wanting the law obeyed makes people racist. Also the crime committed by illegal’s to obtain fraudulent ID. And what the ramifications of that crime entail. These are serious issues that should not be *shrugged* off.
