Update and correction at 4:06PM EST: The Dallas Voice is now reporting that a third man, Mickey Joe Smith, 25, is expected to face the same charges as the other two suspects -- aggravated assault with a deadly weapon and aggravated assault causing bodily injury. The charges are second-degree felonies, punishable by up 20 years in prison, and not first-degree felonies as previously reported.

Since these are not first-degree felonies, having the crime be classified as a hate crime would upgrade the charges to first-degree felonies, which as noted below, are punishable by five to 99 years in prison.

The Dallas Voice spoke to Lamar County District Attorney Gary Young, whose office is handling the cases, who said:

“We’re in the process of receiving all the information as a result of the investigation... We will present all that information to the grand jury, including all the information as to whether it’s a hate crime or not. The grand jury will make a determination whether it [a hate crime] is or isn’t as part of the charge. If their actions of committing the aggravated assault are based on race or sexual orientation or whatever it may be, the grand jury can choose to enhance the offense up a level.”

Two men have been arrested for a shocking attack on a Reno, Texas gay man.

26-year-old Burke Burnett received 30 stitches to close stab wounds on his back and forearms inflicted by a broken beer bottle, reports the Dallas Voice, as well as second-degree burns and severe bruises after being assaulted at a private party on Sunday.

The attackers reportedly screamed slurs like "pussy-ass faggot," "gay bitch," and "cock-sucking punk," as they punched, stabbed, and eventually threw Burnett onto a fire.

Now Daniel Martin, 33, and James "Tray" Mitchell Laster III, 31, have been charged with the assault reports to the Dallas Voice.

But, though Burnett said the officer who investigated the assault told him the attack would be deemed a hate crime, it looks as though it may not be classified as such after all.

Both perpetrators are being charged with one count of aggravated assault with a a deadly weapon, and one count of aggravated assault causing serious bodily injury -- first-degree felonies punishable by five to 99 years in prison the Dallas Voice notes.

Because there is no further penalty for a crime already labeled a first-degree felony if it's also designated a hate crime, it looks doubtful that prosecutors will pursue that route.

The paper reports that Reno police spokeswoman Alicia Myrick said it will be up the Lamar County District Attorney's Office to determine whether the case is prosecuted as a hate crime.

"That’s not our decision," Myrick said.

Burnett is, sadly, one of several gay men who have been attacked and set on fire in recent weeks.

In September a Pennsylvania man awoke to find that his "friends" had doused him in rum and set his leg on fire. On October 22 a Scottish man was found dead after being beaten and burned.

I am so glad the animals were caught. Maybe, if all goes well, he can have some closure. I was not as lucky. Several years ago, I was walking with my partner of 4 years and we were bashed. I was pistol whipped, crushing my skull and jaws and when my partner came to help me, the guy blew his head off. He died in my lap 8 minutes later. The man, and the one waiting in the car to get him out of there, were never caught. I have been through therapy, grief groups, support groups, etc. and still sit with this, lie in bed with this, always thinking about the why's and how come's? I cannot imagine having so much hate, enough hate to kill someone. Where do they acquire this hate? My personal belief is that it is handed down from parent/s to child. It is a cycle that until broken, will continue over and over again, generation after generation. Why is it, too, that so many that hate are self proclaimed Christians who follow Jesus, but completely omit his message of love. I wish my partner, Pj, was still here with me and I wish that the guy who pulled that trigger was found. Maybe I would sleep, again and move on. I have not moved on. I pray they call this crime a hate crime and therefore a 1st degree felony. I hope that this young man will have peace in his life. Peace!

Hitler killed 11 million people and the Jews and the Russians and the Catholic priesthood and the homosexuals are all still with us. What are these people trying to prove? If you dont like somebodys religion, country, homosexual behavior, hair color, shoe size, taste in wall paper, it doesnt give you the right to kill them or beat them up. You arent going to get rid of every single person you don't like because I think the person they really don't like is themselves.

...and let's not forget the brutal death of Steven Lopez-Mercado in Puerto Rico, who was stabbed, burned, decapitated & dismembered...This crime bears similar markers and can be seen as a "copy-cat" attempt against the life of Burk Burnett. The harshest legal penalty shall be applied!

Okay so I have to say something about Texas. Im from here and I am a lesbian. I honestly have no issues in my area. Its the WASP (White Anglo Saxon Protestant) area of Texas you have to worry about (Pan handle and far east Texas) but, honestly in San Antonio, Austin, and El Paso...we really have no issues in these cities. Its the little towns in between we have to be careful in.

I'm with ya', William. Although hate crimes such as these happen everywhere, there really seems to be a disproportionate amount taking place in Texas. I guess they have more courageous "real men" out there. Ugh.

I don't understand this at all..... why do people have to hate another person because they are gay, or bi, or fongdongwingianishian, or whatever? This is beyond the pale, uncivilized, savage, pointless, stupid! Turns my stomach! I mean... why would you do this? I have several friends who are gay, one is a very close friend of mine, the thought never crossed my mind to hate anyone based on who they fell in love with. I love him to death and couldn't think of a better friend, or a more decent human being. I apologize for sounding disheveled and unorganized, i am just truly very upset by this..

Ever notice none of these little sucmbags never seem to be so outraged by someone being Gay when they are alone? Only when they are in a group that far outnumbers the Gay person does their hatred somehow need to be vented??

Imagine the outrage, rallies, marches and demands for justice FOR SOMEONE BEING SET ON FIRE had the victim been anything but Gay...............

Had this brutal attack just ended with the beating (with knives and bottles), I'd say why is this not a hate crime...but the fact that AFTER all of this they decided it wasn't enough, and then threw him INTO A FIRE, should most certainly be ATTEMPTED MURDER.

But this happened in Texas, the American Terror Sta-er, Lone Star State. If a judge convicts them, as he should, he's painting a big target on his own back. These people have demonstrated their willingness to kill anyone who doesn't fit in or work with them.
