Deportations Leave Behind Thousands Of Children In Foster Care

An unprecedented increase in the deportation of undocumented immigrants has left an estimated 5,100 children languishing in U.S. foster homes -- a troubling figure that could triple in the coming years, according to a November report from a New York-based advocacy group.

The "Shattered Families" report from the Applied Research Center, which the activist group says is the first to analyze national data related to the separation of families involved in deportations, offers a look at the human dimension of the highly contentious immigration debate.

The Obama administration deported 46,000 parents of children who are U.S. citizens in the first six months of 2011, the ARC report says. Government data shows a total of 397,000 expulsions in fiscal year 2011, with half involving people with criminal records.

"This means that almost one in four people deported is the parent of a United States citizen child," said Seth Freed Wessler, the report's chief investigator and author. "ARC's research has uncovered a troubling collateral effect of these deportations: Thousands of children enter the child welfare system and are often stuck there."

Ross Feinstein, a spokesman for U.S. Immigration and Customs Enforcement, said the agency had not reviewed the report.

"Our agency does work with individuals in removal proceedings to ensure they have ample opportunity to make important decisions regarding the care and custody of their children," Feinstein said. "Furthermore, as outlined in the agency's June 2010 Civil Enforcement Priorities memo, ICE will typically not detain individuals who are the primary caretakers of children, unless they are legally subject to mandatory detention based on the severity of their criminal history or their risk of flight."

But once separated, the "Shattered Families" report says, the children face enormous obstacles to rejoining their parents, even though child welfare agencies are required by federal law to reunify them with parents who are able to care for them. Because child welfare authorities lack formal policies for dealing with deported parents, the report says, children often fall through the cracks.

After parents are deported, the researchers found that families remain separated for long periods, with child welfare agencies and juvenile courts often moving to terminate the parental rights of deported immigrants. Children who don't have other immediate family are then put up for adoption.

"One of the most common responses from the hundreds of caseworkers and child welfare attorneys that we interviewed all over the country ... was something like, 'When a parent is detained or deported, they basically fall off the face of the earth when it comes to the child welfare system,'" Wessler said.

The researchers concluded that controversial federal programs such as Secure Communities, which allows federal authorities to screen fingerprints of those arrested by local police in order to detect undocumented immigrants, had turned parts of the country into "deportation hot spots" where families were being torn apart. Critics have said that Secure Communities nets large numbers of noncriminal undocumented immigrants and takes the focus away from violent offenders.

"When we violate that commitment to keeping families together, when we take kids away from loving families, the result not only runs counter to the values that Americans place on families themselves," said ARC President Rinku Sen. "It also starts to look a little too much like abduction to be tolerable."

Send the children along with the parents. Simple. With all the talk about changing the immigration laws, perhaps the law that makes one a citizen of the the United States simply because they were born here needs to be changed. It's simple. If one of the parents is here illegally, then the child gets deported along with the parent.

Hispanic immigrants pay far less taxes than the services that they receive. Lets start with medical care, food stamps, school lunch program, more medical care, SSI payments. Simply look at the demographics of the schools and it will tell you that the largest income group of hispanics is low income. In this group, no taxes are paid.

Its true they did come into the country illegally but think about this: aren't all white "americans" here because many centuries ago their ancestors came from Europe illegally? I mean there were no such laws then because the natives weren't greedy and racist but the Europeans DID come here in search of whatever freedom. They not only came here for that though, they took away the land from the natives and made it their own. Is this why they are jerks to "illegal immigrants" today?

The US is not kidnapping these children. The parent or parents are breaking the law if they are here illegally. He/she/they have two choices: Take their kids with them to their home country or leave them in the US. They are the ones breaking up their families.

Yet another example of how being intolerant costs more money that the supposed "problem" in the 1st place! These are U.S. Citizens according to the constitution who now need to be raised at tax payer expense.

To all those that would say "send them back too" I ask you this: Do you honor and obey the constitution or not? It's not an a la carte menu. If you don't like it as it stands then pass your own amendment(s).

Solution? Keep the families intact and send the under-age children with their parents back to their parents home country. When the "kids" come of age, then they can return legally to the U.S.

It is the parent's fault, plain and simple.

If you know you are here illegaly and you do nothing to validate you status in this country and do not make arrangements for the care of your children in the event of your deportation....

....then it is your fault and yours alone that your child is now in foster care.

If people think that sending these parents back and putting these children into foster care is a solution, I hate to tell what the outcome will be. If people think that illegals are a burden wait till we have to provide Mental Health, juvenile and court services, etc. to these children. America I am ashamed of your stinking thinking as a former Juvenile Counselor I have seen and worked with the outcome. For the Lords sakes these are American Children and their parents need to be given a green card to stay and raise them with love and caring. The blame is not on the illegals that come here but our government for political and greedy reasons allow illegals to pour into our country. Stop blaming the children and keep the parents together here!!!

I did not address crimes in my comment however even Americans who commit crimes and get out of jail can petition their parental rights back! Sounds like this board is showing its bias and prejudice especially when you stereotype groups of people! Yes even those who claim to be hispanics! Just put yourself in a position where you got your children jerked and abducted out of your life because the US Government decides that certain other ethnic groups need to be shipped back to their country, even though they are citizens!! You may be in that ethnic group!! Are there any other humanitarians on this board! I do understand what illegal means however like I posted this society has created this outcome! The children do not need to be punished for the illegal entering of their parents into this countrly. I believe we can come on with a more humane way to resolve this issue. Solution: Once a child is born here from an illegal, make the parents citizens. Then the parents will have to pay taxes just like all other Americans. As for the fruit pickers, this would hurt the companies that hire illegals. Companies who employ illegals do so because they can use them, pay them cheap and don't have to pay out taxes for them. As of right now, an illegal person can apply for benefits - foodstamps, mediciad and cash assistance - and the children receive it only. But, if they were citizens, then the parents income gets counted and it will make the cash assistance go away, and foodstamps drop in amount. Yes, this country was built upon immigrants but they all went through Ellis Island and were given citizenship. It is not hard to become a citizenship of the US. You just need to have desire to do it.

wow..i cant believe what i am reading..especially the ones who call themselves hispanics, latinos or mexicans...i am an american and i will tell you not all of them are perverts, alcoholics or womanizers..as many latinos i see pregnant i see white, black and every other race out there with more than one children..alot of them do work and work in the fields where none of you americans will go out there and work..you wont go out there bending and squatting picking the fruit and vegetables all season long..most of them come out here looking for a better life for their families..they all want the american dream and unfortunately the dream isnt what they expected..yes the money is good to them but they take alot of humility from us..we treat them like they are non existance yet if it wasnt for them we wouldnt have a vegetable or fruit section in our grocery stores..one day take the time to actually just sit there and look at how hard they work and think to your ignorant self if i lost my job would i be willing to do what they do out there? my family came from another country, my grandfathers fought for this country during the war with japan and were pow's..i am proud of what they have become and what they have done for the generations of our families..
