WASHINGTON -- The White House Counsel's Office has formally rejected a congressional subpoena of documents relating to the $535 million loan guarantee that the administration shepherded for Solyndra, the now-defunct solar energy company.

In a letter to the chairs of the House Energy and Commerce Committee and Subcommittee on Oversight and Investigation, Kathryn H. Ruemmler, counsel to the president, calls the request for documents made by House Republicans a "vast fishing expedition" and a "significant intrusion on Executive Branch interests."

"As written, [the subpoena] encompasses all communications within the White House from the beginning of this Administration to the present that refer or relate to Solyndra, and the subpoena purports to demand a complete response in less than a week," Ruemmler writes. "Thus, any document that references Solyndra, even in passing, is arguably responsive to the Committee’s request, and you reaffirmed this week that you intend for the request to be that broad. There is no basis for such a broad request beyond a “vast fishing expedition," as Congressman Dingell noted yesterday. Moreover, responding to such an expansive request would require the devotion of substantial resources to gather and review many documents that are of no legitimate oversight is itself an unreasonable burden on the President's ability to meet his constitutional duties."

In rejecting the subpoena, the White House has taken one of its sharpest stands to date against the House GOP's oversight capacity. When Republicans gained control of the House in the 2010 midterm elections, many predicted that these types of standoffs would become routine. Only recently, however, have investigations into administration actions or programs, such as the loan program in which Solyndra participated and the gunrunning initiative known as Operation Fast and Furious, gained real national attention.

The administration has already given congressional investigators more than 85,000 pages of correspondence between the Treasury Department, the Office of Management and Budget, the Energy Department and the White House. And in a meeting with the House Energy and Commerce Committee Wednesday, the White House Counsel's Office offered to turn over even more.

According to Democrats in the meeting, administration officials said they would comply with a subpoena that related to four aspects of the Solyndra investigation: whether or not campaign contributions influenced the decision to grant the company a loan guarantee; White House involvement in the decision to "make a conditional commitment to Solyndra for its loan guarantee"; White House involvement in the decision to end the loan guarantee; and the White House's decision to subordinate the government's interest (in favor of the shareholders) in restructuring the guarantee.

Congressional Republicans's request for information beyond that prompted the rejection of the subpoena. But officials familiar with the ongoing dialogue aren't convinced that the two parties have now reached an impasse. The hope is that Ruemmler's letter will prompt further negotiations over which documents to request and hand over.

Wow, the same type of behavior that "tricky Dick" Nixon and his administration used when information was requested from them. Nixon kept refusing to provide the requested information, then provided some heavily redacted information and was then run out of town on a rail with even his own party toting the tar and feathers. Nixon was excoriated for this and impeached. Will the public today give Obama a pass?

Actually it was the Bush administration that wanted to give Solyndra the loan and did all they could to push it through BEFORE the Obama administra­tion took over the helm. The Loan Guarantee Program was created in 2005 under Bush.

* May 6, 2008: Solyndra submits a full application, seeking funding for its Fab 2 manufacturing facility. Bush's DOE begins due diligence.

* Sept. 4, 2008: Bush's DOE loan programs staff draft a memorandum indicating that Solyndra was the “earliest mover” and may receive conditional commitment. And then DOE engages RW Beck to prepare an Independent Engineering Report for the Solyndra transaction on Sept. 30, 2008.

* Dec. 4, 2008: The Bush DOE CFO notifies Acting DOE Deputy Secretary that presenting the Solyndra transaction for approval by Jan. 15, 2009 is one of the loan program’s three highest priorities!

* Jan. 9, 2009: the Solyndra transaction is reviewed by the DOE Credit Committee, and remanded for further analysis.

* Jan. 15, 2009: Loan Programs staff notifies the DOE Credit Review Board that it has developed a schedule to complete Solyndra's due diligence and would bring the project to approval in early March 2009

* Jan. 20, 2009: Obama Administration takes office

It's a shame Obama is a pushover. If he was a strong Democrat like he claimed he was going to be, things would be a lot better than they are now. Instead he allows himself to be bullied by FRESHMAN Republicans and feels bad for it because he's unable to synthesize with a party that's located on the other side of the political spectrum.

Let's make it simple, just send the stuff that shows you guilty of collusion. It will save a lot of time and money. Better now than later Mr. Obama. Comply with the request, and prove your innocence. Or perhaps you can fall back on "national security" somehow showing that if they are given over, you might be impeached, and that would mess up security. Maybe even jailed. Joe Biden takes over, that would cause a lot of sleepless nights, nuff said.

The only way we will ever have honest government is via:

1- an aggressive and objective investigatory news media that will go after all individuals regardless of their politics, connections or religious cronyism with top media management.

2- an opposition Party that makes it a high priority about exposing the corruption and crony capitalism of the opposite Party. I suspect we have collusion between both because a third unnamed interest exerts control over both Parties and their interests supersede the publics.

I voted for Obama but I wasn't expecting Bush 3. The people in the USA have been hoodwinked by the pundits of the Ds and Rs into believing that there's a significant difference. There isn't and they both take care of their campaign bundlers and the 1% at our expense, both as a nation and as individuals.

The fact that Pelosi took impeachment of Bush off the table should have told us that there is an agenda in place to take care of the political elite regardless of what criminal activity they do. Pelosi was protecting the establishment and others from further investigations into Iraq WMDs and 9-11. How could Congress have given immunity from investigation to Bush before the investigation.

Solyndra most certainly has criminality at its base and big NYC money donors just does the 2008 crash, yet nothing has or will be done. The people need the right to establish recall petitions so as to keep politicians honest via threat of a new vote.

Since you claim there is no difference in the partys I will point out just ONE of many.

Bush appointed Roberts and Alito (you know, the corporations are people guys.)
Obama appointed Kagen and Sotomayor.

There are many other differences but surely even if there weren't this one alone should make you realize President Obama is NOT Bush 3. No doubt President Obama has disappointed you for some things but has also done many things you like (even in the face of obstructionism.)Please, let's not divide!

The Parties have one thing in common and that is the penchant of pols to scratch the backs of the 1% at the expense of the 99%, and it is driven by cronyism and corruption.

Concerning the SCOTUS. We need a court with a fair and objective judgement. To get that outcome we need the diversity of the nation represented, and not an expansion of crony interests. These appointments are about cronyism and political payback. Bush appointed two Catholic corporatists and Obama two Harvard "Js". The pathway to equal justice comes from a broadly diverse court that represents middle America and that will represent the 99%.

Religion and culture have been intertwined for thousands of years. It is relevant in human behavior and religious/ethnic connections are highly connected to the cronyism which destroys objective justice. The fact that a one percent + minority in a nation of 300+ million receives 3 or 4 plum positions on our highest court puts egalitarianism and the validity of our democracy is question, unless we accept a caste society. Justice comes from fairness, knowledge and common sense with objectivity, not from some overrated and supposed technical brilliance.

I agree that Citizens U was one of the most outrageous recent decisions made, but I would agree that anything that took away the 2nd Amendment rights would be as bad or worse.

I agree. This shows the Whitehouse staff is as knowledgeable about handling negative press as Herman Cain. Why didn't either the Republicans and Democrats learn from Nixon's 'stonewalling' covering up or appearing to cover-up justifies the allegations and accusations. "Stonewalling' just makes a bad mistake seem intentional and multiplies the negative effect.

More of the Obama administration being Bush-Cheney-Lite.

Reading the comments on articles such as these makes me sad because it highlights how many people still buy into the false left-right political paradigm that is sold to the masses. Politics as it is presented by the mass media is merely a theater of the absurd meant do distract and fracture social cohesion as a means to advance corporate agendas.

Capitalism and communism are two sides of the same coin, both are ideologies whose sole intent is the consolidation of capital into few hands as a means to control government and society. Only the means of accomplishing this are different between the two. I'm afraid many of the 'conservative' pro capitalists don't truly understand the roots of capitalism and how little it has to do with truly free markets. At least they understand something is wrong with the system, unlike the masses of modern 'liberals' who want capital and the means of production controlled to give them a false sense of stability.

Capitalism and communism are 19th century ideologies born of a morose imperial age and should be viewed as they truly are, atavistic remnants of a time when benighted aristocrats thought they knew best to control the people they were meant to lead.

Truly we must stand on the shoulders of giants to glimpse the vast expanse of human potential, but should we not choose very wisely what shoulders offer us the best view?

IMO-Obama is jerking their chain, because as they have all along, the republicans over reach. It is fun isn't it? Like when they had all those ethic investigations of the Clinton's? He was having people murdered all over the place, sneaking out in the middle of the night for affairs, Hillary was gay and hired women accordingly, that they had Vince Foster killed...gosh it goes on and on. How much of that was true? None of it.
If they had anything on Obama they would have had the proof out along time ago. This is just a scam to create suspicion.
Fred Upton is from MI. He is way over his pay grade here. His biggest claim to fame in MI is a light bulb bill that is useless because we don't make lightbulbs here. If we did we can now legally buy them here.

Note the start date of the project as 2006.
Project Gunrunner is an operation of the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) intended to stem the flow of firearms into Mexico, in an attempt to deprive the Mexican drug cartels of weapons.
In early 2011, the operation became controversial when it was revealed that Operation Fast and Furious and other probes under Project Gunrunner had allowed guns to "walk" into the hands of Mexican drug cartels since as early as 2006.
