Ohio Issue 2: Election Day Robocall Instructs Voters To Go To Polls Tomorrow [UPDATE]

WASHINGTON -- Union officials in Ohio are questioning whether proponents of an anti-labor ballot initiative are trying to trick opponents of the measure into staying away from the polls on Tuesday, pointing to a robocall message voters received on the morning of Election Day.

Ohio residents are voting Tuesday on Issue 2, a ballot referendum on a controversial measure known as SB 5. The law restricts collective bargaining rights for state employees, among other provisions. Opposition to the legislation inspired large protests around the state earlier in the year.

At 9:37 a.m. on Tuesday, a Service Employees International Union (SEIU) staffer in Ohio received a robocall message inaccurately telling voters the election was "tomorrow."

"Hi, I am calling to remind you that tomorrow is Election Day," said the voice on the message. "It is critically important that you go vote and protect the future of our country. Tomorrow, please go to the polls and vote YES on Issue 2, and vote YES on Issue 3. Paid for by American Future Fund and not authorized by any candidate or candidate committee. 866-559-5854."

Voting yes on Issue 2 means voting in favor of SB 5, Gov. John Kasich's anti-collective bargaining law.

The number on the call goes to an automated message, directing callers to the website of the American Future Fund, a conservative advocacy group. The message also asks people if they would like to be added to the group's do-not-call list.

The American Future Fund did not immediately return a request for comment, so it's unclear whether the call was simply a mistake in timing.

But one union official suspected shenanigans, saying it was unlikely the American Future Fund would make the mistake of instructing its own supporters to turn out on the wrong day, if it was truly interested in increasing turnout.

"When you set an auto-dial to dial, you know how long it will take to go through those batch of numbers," said a union official. "And if they were legitimately trying to turn out their people they would make sure they didn't get the calls today."

Anthony Caldwell, a spokesman for SEIU District 1199, said it was the union's information technology officer who received the call and noticed, curiously, that the time stamp was slightly after 9:30 am this morning. The IT official is a registered Democrat, which made the call more suspicious.

"For a group [American Future Fund] that has coordinated a million dollar mail campaign, I find it highly unlikely they would make a simple clerical error and send out a robocall to non-supporters telling them to vote the day after Election Day," said Caldwell.

Polls have pointed to an overwhelming defeat for Issue 2 and the anti-union law, but as HuffPost has reported, some caution may be in order, since polling can be unreliable when it comes to ballot measures.

UPDATE: 1:25 p.m. -- Mandy Fraher, a spokeswoman for American Future Fund, acknowledged that automated phone calls were being made on Tuesday telling recipients that the election was being held "tomorrow." She insisted that the mix-up was due to "gross incompetence on behalf of the phone vendor" and that the group was "working to correct that problem immediately."

"As soon as we realized the problem we stopped those calls and we started calling those people back who received a call to inform them that today is Election Day," said Fraher.

So, where's the phone vendor's mea culpa? If I was thrown under the bus by the GOP, I'd want to have my explanation out there. Anyone have a lead on who the vendor was? Have they been paid to say nothing?

This kind of trickery needs to be stopped. Seems voting has always been down and dirty by the politicians. Why can't they just put out their ideas and let the voter vote for them without the tricks. Unless they know they are wrong why try to cheat the voter with deception and trickery. Voters when voting will see through the lies they aren't stupid.

republicans ran a phone jamming scheme here several years ago....they know they have lousy ideas so they MUST use deception and dirty tricks to win...George Washington would be ashamed of these pigs, so much for democratic ideals

And if you believe Mandy Fraher, i have a really good deal on some ocean front property in Arizona.
There are just to many coincedences, and the fact that the calls went to registered democrats instead of the republicans they were meant for.

Democrats did robocalls too, and they did not have any issues. I find the excuse by the American Future Fund suspect to say the least.

Most of these folks make a better living than I do...I just don't want to support them anymore.....I pay 1500 a month for healthcare for my family...what does the average teacher pay? Care to foot the bill for me?

Several points are now clear regarding these actions: First, I find it highly unlikely that Mandy Fraher is speaking with complete honesty here. This is not the first time the GOTP has engaged in literal "strong arm" tactics in order to further their agenda. Second, if this was, in fact, the result of an incompetent phone vendor as Fraher implies, why is it that not one other individual has come forth to verify the story? Furthermore, why is it that the phone vendor is not being asked about the matter? I am quite sure if Mandy Fraher wants to "prove" they had no ill intent, then Mandy should have absolutely no problem unveiling just who that phone vendor was. Third, after engaging in these tactics coupled with the million dropped in the State by groups endorsed by the tea party, they STILL LOST! What should the outcome say to the current GOTP in Washington? It should tell them a lot! However, I remain pessimistic regarding a change in the tea party's behavior. This is why we cannot rest on our laurels after this victory. If anything we ought to be planning our next step of attack against this corporate welfare endorsing machine!

No, the cut the firefighters because the first thing all these new GOP Gov's did was give out BIG Tax cuts to their wealthy donors under the fake "jobs creators" title.........THEN they cried they didn't have money and would have to cut public sector jobs.

I'm glad people are waking up the GOP games and this robo-call thing.......they did the same cr*p in WI. The GOP will do anything to get elected.
