Senate Kills Effort To Ban Indefinite Military Detentions Of U.S. Citizens

WASHINGTON -- Senators compromised Thursday on a bill that attempts to spell out the military's right to detain Americans indefinitely, killing a bid to bar the practice but passing an amendment that says current laws on the matter stand.

The provision in the National Defense Authorization Act aimed to codify a string of court cases and current anti-terrorism practices involved in the capture and treatment of terrorism suspects. It initially opened what opponents saw as the prospect of letting the military haul away any citizen about whom it had suspicions.

The new amendment specifies that the current practices may not change, although it also says explicitly that the military can pursue Americans at home.

"Nothing in this section shall be construed to affect existing law or authorities relating to the detention of United States citizens, lawful resident aliens of the United States or any other persons who are captured or arrested in the United States," says the compromise amendment, which passed 99 to 1.

Sen. Jon Kyl (R-Ariz.) was the lone opponent.

The passage may head off a showdown with the White House, which had threatened to veto the entire bill on the grounds that the section on detentions tied the hands of counterterrorism officials in law enforcement and the military.

The White House did not immediately weigh in on the new measure.

Left unresolved by the new language is just exactly what is constitutional when it comes to detaining American citizens in the United States. But opponents of the original provision said at least it would remain up to judges, not politicians.

"To this day the Supreme Court has never ruled on whether it is constitutional to indefinitely detain a U.S. citizen captured in the United States. Some of my colleagues see this differently, [but] the language we've agreed on makes it clear," said Sen. Dick Durbin (D-Ill.), who had been adamantly opposed to giving the military what he saw as greater reign over Americans at home.

"The Supreme Court will decide who can be detained; the United States Senate will not," Durbin said.

The deal was cut by Sens. Lindsey Graham (R-S.C.) and Dianne Feinstein (D-Calif.), among others, but Feinstein still insisted on a vote for her own amendment that would have explicitly barred the military from detaining U.S. citizens without hearings or a trial. It failed 45 to 55.

Senators who favor giving the military explicit power in the U.S. said the new amendment allows the country to use whatever means it needs to to keep America safe.

"The threats we face as a nation are growing. Homegrown terrorism is going to become a greater reality, and we need to have tools," Graham argued. "Law enforcement is one tool, but in some cases holding people who have decided to help al Qaeda and turn on the rest of us and try to kill us so we can hold them long enough to interrogate them to find out what they're up to makes sense."

"When you hold somebody under the criminal justice system you have to read them their rights right off the bat," Graham added. "Under the law of war you don't because the purpose is to gather intelligence. We need that tool now as much as any time, including World War II."

Earlier, Feinstein made an impassioned plea for preserving American freedoms.

"This constant push that everything has to be militarized .... I don't think that creates a good country," Feinstein argued. "Because we have values. And due process of law is one of those values. And so I object, I object to holding American citizens without trial. I do not believe that makes us more safe."

The overall Defense bill passed Thursday night 93-7, but it will now have to be meshed with a differing version in the House. As part of the detention compromise, Feinstein extracted a promise from Senate leaders that they would insist on the Senate's new language remaining in the final product. It could change, however.

The American Civil Liberties Union found the compromise troubling, and said the president should still veto the bill because even with the no-change language, the measure sets in stone the military's ability to operate inside the U.S. borders.

"The bill is an historic threat to American citizens and others because it expands and makes permanent the authority of the president to order the military to imprison without charge or trial American citizens," said ACLU senior legislative counsel Christopher Anders in a statement.

"The final amendment to preserve current detention restrictions could turn out to be meaningless and Sens. [Carl] Levin [Michigan Democrat] and Graham made clear that they believe this power to use the military against American citizens will not be affected by the new language," Anders said. "This bill puts military detention authority on steroids and makes it permanent. If it becomes law, American citizens and others are at real risk of being locked away by the military without charge or trial."

Don't satisfy yourselves to comment here only. Write your congress person, senators, and the WH urging them not to enact this bill. It is abhorrent.

A comment on this law from a friend of mine who grew up in South Africa:

This initiative is one that I know only too well. It was in place in South Africa for the entire duration of the 30 years that I was a resident of that country and it was the cornerstone of the Apartheid system. So much suffering was created through this iniquitous law as you might imagine, because it allows the authorities to detain indefinitely, without trial, anyone who may hold a different opinion than that of the government. If it becomes law, it is certainly the end of our democratic freedom and will be the clear birthing of a true police state.

This means they can arrest you, hold you in detention in FEMA camps without trial, without reason simply because they want to. STAND UP! DO SOMETHING! Every single American is at risk. Are you just going to sit there and let it happen? This is exactly what Hitler did, only he just did it, he didn't pass some law to do it.

Actually, HItler DID get the law passed, just as we are about to pass this one. The best way to subvert any system to get fascist control is to work within it.

They always do this...say one thing do another..they say the current laws stand ..why are they not adequate ? becasue they want free reign to "label" and then abuse the US citizen at will when they deem it convenient...So any body protecting endangered Bunnies can be held indefinitely...even this idea is preposterous that they get to hold someone indefinitely in the first place... enter the new F@C|SAM

The American military is going to keep pushing buttons until Americans revolt. Does the American military not remember why England had to come here in the first place?

The government thinks it has the upper hand due to military and corporate loyalty.

That would be correct except for one thing: all of these people have families they love and will die to protect.

The soldiers/corporate slaves will obey until it comes time for them to betray their families-it will be then that most of them turn on the corrupt American government.

We will never stop this madness until we are forced to. The only terrorists we have in this country are the bankers and politicians. Have you ever noticed that when another country wants to fry us it's because of something corrupt that our government enacted? We judge other countries while doing the exact same crimes. It will never stop unless the citizens force it.

America will forever be hated if we do not change. Our land is wanted by everyone on the planet. We will never have enough money to conquer our regularly chosen enemies. We are well known as traitors to ourselves and other countries.

America has no loyalty to themselves or anyone else. It is why America will be destroyed if people don't wake up-right now.

American arrogance (and willful,deliberate ignorance) is disturbing to watch.

SPOT on...the deeper psychology is that they are in FULL denial and only want to see the inside of the gilded cage and stare at the TV and lap up the propaganda that is Mountainous. they wont wake up becasue they are afraid the truth is far worse then the dream they want to stay under....

Why do we need new laws to fight terrorists, few people seem to be pointing out that we already have plenty! Our congress is simply not working in the best interest of the American people. What is this "home grown terror thing"? Are they talking about the Senate? Can this bill help lock up Grahm and Levin? Can it help lock up BOA executives?

It is long past time that we start indicting our elected representatives in the U.S. District Courts within the districts from which they have been elected.

The federal grand jury system is still in fact run and operated by people from local communities. All that is needed now is “local education” of these grand jurors, and encouragement for them to start issuing indictments.

If you are questioning how this may be possible, folks, these traitorous fools have given themselves enough rope for the grand juries to hang ‘em.

For example: Title 18 § 2331. Definitions (United States Code – Criminal Provisions)

[READ THE DOMESTIC TERRORISM SECTION CAREFULLY - especially the part about violating the criminal laws "of any state"]

They are openly committing treason; announcing their plans to make war upon the states and the people of this nation. Forget the “recall petitions,” it’s time to indict them, send in the United States Marshals with felony warrants, arrest them, remove them back to their home districts and try them as criminals in the various U. S. District Courts.

This amendment is a poor and sad excuse for any sort of provision. The Republicans stood against the Udall amendment who is more intelligent then Jon Kyl and McCain put together, we need to get those old men out of congress now. Arizona, Wake up.
