Student Arrested For Burping In Class: Shannon Kennedy Sues Albuquerque School

ALBUQUERQUE, N.M. -- A 13-year-old was handcuffed and hauled off to a juvenile detention for burping in class, according to a lawsuit filed against an Albuquerque school principal, a teacher and school police officer.

The boy was transported without his parents being notified in May after he "burped audibly" in PE class and his teacher called a school resource officer to complain he was disrupting her class. The lawsuit also details a separate Nov. 8 incident when the same student was forced to strip down to his underwear while five adults watched as he was accused of selling pot to another student; the boy was never charged.

The suit was one of two filed Wednesday by civil rights attorney Shannon Kennedy, who says she has been fighting the district and police for years over the use of force with problem children. She says a review of school and Bernalillo County records shows more than 200 school kids have been handcuffed and arrested in the last three years for non-violent misdemeanors.

In the second lawsuit filed Wednesday, the parents of a 7-year-old boy with autism accuse a school officer of unlawful arrest for handcuffing the boy to a chair after he became agitated in class. New Mexico law prohibits officers and school officials from restraining children under 11.

The suits come one year after the same attorney settled a class action lawsuit against the district that was prompted by the arrest of a girl who Kennedy said "didn't want to sit by the stinky boy in class." And Kennedy says she has a number of other cases she is preparing over treatment of students in Albuquerque by school officials, school police, city police and sheriff's officers.

"I am trying to get all the stake holders in a room to get people properly trained to prevent this from happening," Kennedy said.

Kennedy said the problem lies with the schools more than with the law enforcement agencies.

"It lands in the lap of the principal. There are good schools and bad schools. The principals ... who are handling their schools properly don't need to have children arrested. It's ridiculous."

A spokesman for Albuquerque Public Schools did not immediately return calls and emails seeking comment on Thursday. A police spokeswoman said the department does not comment on litigation.

One school board member, Lorenzo Garcia, said he had not seen and could not comment on the lawsuits, but he did say he was concerned about what appeared to be schools getting stuck on a "zero tolerance policy."

"Really, in my opinion, this really increases the whole idea of the schools-to-prison pipeline," he said.

The stupidity of some people. Recently, eight to ten eighth graders had gotten a Saturday for simply touching the basketball rim. Another student had gotten a lunch detention for playfully hitting a friend. Really, why are people so ignorant and stupid? Really no one at my school likes either the principal or assistant principal. They both act like they have so much authority over everyone, and even my bus driver is following in there dictating foot steps. One of my closest friends had been abused on the bus, and the driver admitted to it but now he's denying it. The bus driver and both principal and assistant principal are getting out of hand. Idiocracy of many people are really pissing off all the students. We deemed that the adults have no control over any of the five hundred something students at this school. We are no longer scared of authority, we are the ones who create more power for ourselves.

I thought thats about all 13 year old boys did was burp. I think this is a problem with power hungry school administrators. I dont understand why the police arrested the child. Just because someone wants an arrest made does not mean the cops have to go ahead and make the arrest.

... if they were only for the people - not brainwashed and now work to protect business.

My dad was a cop - and he has said time and time again that the police are now a local military - and protect and serve now means to stop living by the constitution, and instead to live by what business and a corrupt government lays down on them. He said he would have to quit being a cop if it was like this when he was on the force.

There's controversy over in-school police officers using pepper spray inappropriately. If they're arresting so many for disciplinary infractions, someone will use a taser if they have one.

I am no conspiracy theorist....but I am noticing a lot of stupid things happening from people who are supposedly educated. Somehow common sense is not even considered these days....why in the name of Jesus would anyone think it's appropriate to do this for something that is natural (although admittedly can be controlled in most circumstances). If it was intentional, why not send him to the principal's office?

I mean really....wouldn't common sense dictate that is not the way to discipline and we wonder why kids are so damn angry with everyone. I'm not trying to defend bad behavior, but there has to be some civility and appropriate punishment meted out....not this insanity. I think people truly are getting more and more stupid....and this seems to happen mostly in the USA....this incredibly stupid stories.

Now for the conspiracy....I wouldn't be surprised if some foreign gov't is screwing with the water supply and driving us all bonkers. lol I hate to say that I am only half kidding though.....

That's my point as well this seems a bit more sinister than is being reported. It's either there is more to it or the people that are charged with keeping order seriously need counseling

Educated people are not taught HOW to think, only WHAT to think. That is why there is no such thing as "common sense" anymore. As for the conspiracy theory, I'm of the opinion that there are signals coming through the cell phones that are jacking people up. :-)

As for the child with autism, his IEP should have a behavioral intervention plan that specifies what methods can be used to deal with him when he displays inappropriate behavior. This sort of plan prevents draconian methods and is very much hated by regular education administrators who really want the child gone. They have saved many a special needs child from being inappropriately punished for something he has no control over, while teaching appropriate behavior in ways that help the child learn. If he does not have such a plan then someone is not doing his or her job and the parents need to check the certification of the teacher.

Schools and systems that have excessive and intolerant disciplinary policies tend to also be low performing. New Mexico vies with Louisiana and Mississippi for the top of the "worst school system" heap. They suspend readily, have "zero tolerance" policies and do other things that dehumanize students and give teachers little real power. I don't know about New Mexico, but the other two also force chldren to wear uniforms, another issue that says: IF you are not like me you are second class.
