Pomona College Protest

Story has been updated to reflect the latest arrest numbers.

Pomona College dining hall workers and their supporters conducted a sit-in Friday to protest the school's termination of workers who cannot verify their legal citizenship. Sixteen dining hall employees were terminated, effective Friday, and instead of collecting their last paycheck, they came to work chanting "We're here and we're not leaving."

The dining hall workers were joined by supportive students, professors and alumni from Pomona College anlos d the other Claremont Colleges, as well as by a number of campus employees who also received threat of termination.

Unite Here Local 11 Communications Coordinator Leigh Shelton told The Huffington Post that there were roughly 300 protestors in attendance. School officials estimated there were 150 to 200 demonstrators.

The organizers made it clear that it was their intention to have 17 protestors arrested, in solidarity with the 16 terminations, plus one stalled termination pending documents. The university declined to arrest demonstrators as long as they were peaceful, but later, as a result of negotiations with the organizers, the Claremont Police arrested 17 demonstrators for blocking an intersection.

Shelton tweeted from the protest, "100s of students rush @pomonacollege dining hall in protest unjust firing of immigrant workers;" "'Above all this is humiliating,' says fired @pomonacollege cook of 9 years;" and " After 23 years @pomonacollege fires Felipa Sanchez for not showing her papers."

The terminations started with a Nov. 7 letter the university sent to 84 employees stating that, if they did not resolve deficiencies found in their files by Dec. 1, they would face termination. The letter explained that the Board of Trustees had received a complaint that several campus employees were in the country illegally.

The action comes as dining hall workers have been trying to organize an independent union for about two years. As the Los Angeles Times reports, union negotiations with the college are currently stalled.

Cynthia Peters, media relations director for the college, told HuffPost, "The terminations had nothing to do with the union organizing. The two issues are completely separate."

In a school-wide email, Paul Efron, chairman of the Board of Trustees, wrote “We agree that the College and some of its employees have been placed in a difficult and unfortunate situation, which we wish could have been avoided. However, while many of us believe that the country's immigration policies are in need of reform, it is important to emphasize to the Pomona community that the College has a responsibility to comply with the current laws.”

As the Pomona College student paper, Student Life, reports, Pomona visiting professor of politics and Yale law graduate Michael Teter challenged Efron’s legal reasoning in an open letter to the Board of Trustees, “The decision to conduct an audit of the I-9s demonstrates, at best, overzealousness and, at worst, a fundamental disregard for the dignity and privacy of every employee. To seek to justify the College’s actions by referring to a discredited allegation and to federal law is disingenuous."

Regarding the close timing of the termination to union organizing activity, Teter wrote that the college's “intrusive and arbitrary verifications.. may also have violated the National Labor Relations Act.”

Dining hall employees--some of whom have worked for the college for 10 to 20 years--say their citizenship status has not come up with the school until now. Christian Torres, who was a cook at the college for seven years, told HuffPost, "After seven years of working very hard, I feel confused, disappointed and sad. I just don't understand why they're doing this."

This nation always looked away when it came to ilegal immigration. Now, ilegal aliens feel to have the right to be here, regardless their legal status. The question is; what about those who wait or waited to come here for 10-20 years by legal means. Don't you feel we own them an appology?

Anything but completely looking the other way = overzealous.

"referring to a discredited allegation and to federal law is disingenuous"

Typical anti-enforcement response. The law is not to be followed or enforced because the issue is really something else. Just becuase he is a Yale law graduate (oooh) does not make that a legal argument. It's just rationalizing illegality.

It's real simple, it's against the law for illegal aliens to work in this country. This is like saying, i have been driving all these years and i never got caught, why are they arresting me for not having a license now? Just wait until a national E-Verify law is enacted, alot of people are going to lose their jobs. There will be alot of surprises too, people who you think are US citizens will turn out not to be.

Felipa Sanchez was fired after 23 years and it never occurred to her to get herself legal to work in this country? I don't understand what all of the whining is about. You come here illegally, you are breaking our laws. What's so hard to understand here? Why do I always come away from an article like this feeling like the illegals in this country have entitlement issues? What are they so deserving of anyway? If you come here illegally in the first place, even with the best of intentions, do you really think you are so deserving of that job?

The status of these workers should have been more thoroughly checked at the time of hiring. The protesters will now probably involve the ACLU or some other organization, with the argument that they've already been working here and should therefore be allowed to stay. In addition, the person or people responsible for their hiring should also be held accountable.

Put them in the back of a truck, drive in reverse really fast, and when you hit the border, slam on the brakes. They will all tumble out in their homeland.

It seems that 14 jobs just opened up in California for legal immigrants and Americans. How fast will they fill them up. Oh, sorry, they are already filed. See, Americans will do the work of illegals, especially under OBama.

Are we back to calling them undocumented? Last I checked, they are illegal. I wonder what would happen if another group of criminals, all got together and protested. Id love to see a bunch of bank robbers protesting their right to rob banks. Or rapists. Sounds ridiculous, right?

Yes, we should amuse ourselves coming up with new names, since self-deportation has become such a hit.

So no more rapists. They are "unanticipated amorous partners".

Breaking and entering can now be called "keyless entry".

Bank robbery is an "expedited withdrawal".

I'm feeling more inclusive already.

But For The Grace of God Go I

As a retired US Border Patrol/INS/ICE agent who has witnessed the death of not only two co-workers, but the death of migrants too, I ask people who are so angry about immigration to consider the possibility that the undocumented are really a symptom of a much larger and insidious problem, and not the cause of that problem.

First of all, may I ask you two questions about the Mexican undocumented? I focus upon the Mexican undocumented because they are our direct neighbors and make up almost 50% of the total amount of undocumented present in the US.

(1) Would the Mexican undocumented come or stay here if they could make a comparable living wage and have comparable social services living and working safely at home with their families?

(2) Why do we seldom if ever hear US politicians criticize the corrupt Mexican government for its contribution to, and its responsibility for illegal Mexican immigration to the US?

Failed immigration is very similar to other failures in our country which are destroying the middle class. Those include but are not limited to our disastrous mortgage meltdown, failed health care, high unemployment, the high exportation of jobs, and our high cost of living.

"Would the Mexican undocumented come or stay here if they could make a comparable living wage and have comparable social services living and working safely at home with their families?"

It is not our duty to make THE ENTIRE REST OF THE WORLD equal to living in the U.S.

You do however have the right idea. Make living here extremely unattractive for illegal immigrants, and they will have no reason to either come or stay.
